Motion was made by Councilman.Kissock, seconded by Councilman'Kruchten, that the reading of the minutes of the last regular meeting held August 28, 1969 be dispensed with. Roll was called resulting as follows: Ayes: Councilmen Carson, Troxell, Lopez and Kissock and Kruchten. Nayes: None. The Mayor declared the motion adopted: 3(o The Mayor advised the Council that he had signed a proclamation recog- nizing the week of Reptember 17th as "Constitution Week" in Fort Collins. This is the date of the 182nd anniversary of the adoption of the Constitution. Also a proclamation by members of Lulac requesting that September 13, 1969, be proclaimed as Mexican Fiesta Day. This was approved by the Mayor The following ordinance was presented on second reading: k'i0 ORDINANCE NO. 49" 19,09 BEING AN ORDINANCE VACATING AN ALLEY IN BLOCK.106, HARRISONfS ADDITION TO THE CITY OF FORT COLLINS, COLORADO The City Attorney advised the Council that since the utilities are being installed underground, in order that this ordinance would not be miscon- stru.ed,.he recommended that the ordinance be amended by inserting "or as the same may be constructed in the future, whether above ground or underground." Motion was made by Councilman Kruchten, seconded.by Councilman Troxell, that the ordi- nance be amended in accordance with the recommendation of.the City Attorney. Ryan was present and explained the reason for the re- zoning, stating this residence and other business on the.corner of Taft Hill and'West Elizabeth had been there for the past 15 years, with several other small bueinesses in this area. Councilman Troxell asked about .filling stations. The Planning Director advised him that they were permitted.. Councilman stated that he would -like to see this area improved, there were some drainage problems that could be solved. The following ordinance was presented on first reading and read at length: ORDINANCE N0. 60, 1969 B-Z ING AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT COLLINS BY CHANGING THE ZONING CLASSIFICATION FOR CERTAIN PROPERTY. ii The City Attorney advised the Council that they could table this ordinance, being the rezoning of.the Rulon property from R-M to B=L zone, or withdraw it, which would require starting all over again when rezoning was again desired. Motion was made by Councilman Lopez, seconded by Councilman Kissock, that this ordinance be tabled indefinitely. The Director of Public Works stated that this would allow them to build up to the property line without a side yard. Tile City Attorney stated that there has been no use of this alley f r 43 years. Councilman Kissock questioned that it might be,used by the Fort Collins High School sometime: The City Attorney advised the Council that when an ,alley is. each of vacated, one-half goes to/the adjacent property owners. The following report was presented and read at length: May 7, 1969 _ TO: Fort Collins City Council FROM: Planning and Zoning Board SUBJECT: Consider plat of the Leeper Subdivision involving approximately 4.4 acres with M-M, Medium Density.Mobile Home Zoning. The Board considered this item at the May 6, 1969 meeting and recommends' approval with the understanding that the Planning Department staff would work with the owner to resolve the discrepancy at the north end of the plat involving ,land which has not been annexed to the City. This land should be annexed or ` the plat corrected to show only that portion which is in the City. The City Manager advised the Co uncil that the matter of the rent increase rider between the City of Fort Collins and the C & S_Railway Co. on the parking lot at LaPorte and Mason, be tabled until further investigation and conference with the Railway Co. and Vice President Mr. Terrell Motion was made by Councilman Kissock, seconded by Councilman Troxell, to refer this matter to the City Manager for investigation and report back to the Council. The Mayor declared the motion adopted The Mayor stated that the Police Department reported that they super 1i3 vised and directed 432 Kindergardners in the "I Walk Safely" program, and that the 1police- epartmez._t should be commended for carrying on this program. Also the Break ast Optomi$t Club who helped in this program. � - 493 n The City Attorney p^esented the following communication: City Council August 26, 1969 City of Fort Collins (.Fort Collins, Colorado The undersigned being the owner of property adjacent thereto petition the City Council to vacate the alley described as: Alley designated A in Block 282 Plan or Subdivision of West Side Addition to the City of Fort Collins, Colorado, according to plat filed April 26, 1892, for the reason that the same has never been opened to the public. Nayes: None The,Mayor J;'The City Manager stated that bids had been opened on the new Golf Course and that the lowest bid was $5,500.00 over the estimated cost, and re- commended that all bids be rejected and start over again at a later date. Stat- ing that the construction of the golf course and sprinkling system were separate items. Mr.'Frank Hummell, Golf Arcitect, was present and spoke briefly on this matter, stating that the lack of interest in the bidding at this time was due to the time bids were advertised and felt Viat the contracters interested in this type of construction, were hurrying to get their present contracts completed before frost, and recommended that the City re -advertise for bids in a month or so, also stating that in the later hart of the.year contractors had a slack season. Councilman. Troxell asked what was the best time to do the work. Mr. Hummell said the contractor could start the dirt work this fall and complete .1 the project by the fall of 1970 and open the course in early 1971 to the public. Motion was made by Councilman Kruchten, seconded by Councilman Troxell, that the bids be rejected and re -advertised at a later date. Roll was called resulting as follows: Ayes: Councilmen Carson, Troxell, Lopez, Kissock and Kruchten. Nayes None. The Mayor declared the motion adopted. The City Manager advised the Council that the Public'Service Company had filed with the PUC, adjustments in the Gas and Electric rates and a 10% surtax on consumer bills, which amounts to an electric rate increase of 1.998% and a gas rate increase of 1.627%. The rates for electricity would be reduced and rates for gas would be increased. The City Manager stated that he thought it important `, in __._ Septembers( ,1969 that the.City join in filing an objection along with -the other cities in Colorado. The cost .to.the City of Fort Collins would be approximately $1200.00 or .03 per capita. 93 cities are involved -in this. It might run as high as $20,000 total to fight this rate increase and surtax. Motion was made by Councilman Kruchten, , seconded by Councilman Lopez, that we also file an objection as the Colorado Municipal League and the City of Denver have filed. Councilman Kissock stated that he thought that the traffic lights at Mulberry and South College and Laurel and College should be readjusted to the same series that they were timed.in order to speed the flow of traffic on College Avenue, due to the extra traffic that opening of College will cause. The City Manager advised Mr. Kissock that it would be changed back.to the original' series as soon as possible.
