Present: Councilmen Carson Lopez and Peterson. Absent: Councilmen Preble and Fead. Staff members present: Brunton, Liquin, Reynolds, Cain and Marion Turner, Secretary of Verna Lewis. Absent: Verna Lewis, City Clerk Minutes of regular meeting of December 21 1972 - Dispensed with reading Motion by Councilman Lopez, seconded by Councilman Peterson, that the reading of the minutes of the December 21, 1972, meeting was dispensed with. Yeas: Councilmen Carson, Lopez and Peterson. Nays: None. Renewal application for Southland Corporation dba 7-11 Store 1001 Lemay - Approved A report from the Police Department stated no legal basis to recommend denial of this renewal. Motion by Councilman Lopez, seconded by Councilman Peterson, that this renewal be approved. Yeas: Councilmen Carson, Lopez and Peterson. Nays: None. Second reading of Ordinance No. 84, 1972, Sidewalk Improvement District No. 3 Adouted. Motion by Councilman Peterson, seconded by Councilman Lopez, to adopt Ordinance No. 84, 1972, on second reading. Yeas: Councilmen Carson, Lopez and Peterson. Nays: None. Ordinance No 851972 - Village Square Annexation - Adopted. Motion made by Councilman Lopez, seconded by Councilman Peterson, to adopt Ordinance No. 85, 1972, on second reading. Yeas: Councilmen Carson, Lopez and Peterson. Nays: None. Ordinance No 86 1972 - Village Square Annexation Zoning - Adopted. Motion made by Councilman Lopez, seconded by Councilman Peterson, to adopt Ordinance No. 86, 1972, on second reading. Ordinance NO. 87, 1972 - Appropriating funds from Water Equipment, Water operating and Light and Power Funds Adopted Motion was made by Councilman Peterson, seconded by Councilman Lopez, that Ordinance No. 87, 1972, be adopted. Yeas: Councilmen Carson, Lopez and Peterson. Nays: None. Ordinance No 88 1972 - Appropriation Ordinance. Adopted on second reading. Mr. Andy Anderson appeared and asked for an explanation of the ordinance and reason for the appropriations. City Attorney March explained the different items as listed in the 1972 overruns of the budget (recorded in the Central Files). City Manager Brunton stated that a part of these funds were for termination pay to Mr. Tom Coffey, former City Manager, also part,fox an increase in his own salary.' Motion made by Councilman Lopez, seconded by Councilman Peterson, that Ordinance No. 88, 1972, be adopted on second reading. Yeas: Councilmen Carson, Lopez and Peterson. Nays: None. Second reading of Ordinance No. 89 1972 - Vacating a right -of -Way Easement. Adopted Motion by Councilman Peterson, seconded by Councilman Lopez, that Ordinance No. 89, 1972, be adopted. Yeas: Councilmen Carson, Lopez, and Peterson. Nays: None. Hearing and first reading of Ordinance No. 109, 1972 - Adopting the Code of Ordinances ,',.pproved. ^�3 City Attorney March recommended that this ordinance be adopted using the format as defined. He stated he was satisfied with the Code, except the building codes are scattered, that there was a need for better procedure with the Clerk's office in getting all the information and material to the publishers. He stated that what ordinances said in the past, no longer applies to the new ones. City Manager Robert Brunton stated that the Code Publishers suggested either an initial charge for each supplement or charge a flat fee, and he recommended a flat fee charge which would include the Code and Supplements. City Attorney March suggested that we order copies of parts of ordinances relating to zoning and annexations that realtors especially ask for. City Manager Brunton asked that a flat fee of $2.00 be charged for Subdivisions and annexa- tions. Nays: None. Sole Source Justification for repairs to roof at Service Center - Tabled Motion by Councilman Lopez, seconded by Councilman Peterson, that this item be tabled. Yeas: Councilmen Carson, Lopez and Peterson. Nays: None. Bids for 1000 GPM Pumber with 50' Tele-Squirt Aerial for Fire Department - Tabled City Manager asked that this item be tabled also. After discussion, motion by Councilman Lopez, seconded by Councilman Peterson, to table this bid. Yeas: Councilmen Carson, Lopez and Peterson. Nays: None. Foothills Meadow Planned Unit Development, involving 17.39 acres with RMP zoning. Approved. Don Reynolds, Planning Director, explained this development, that 345 units were proposed. Councilman Lopez expressed concern about lack of streets through the 17 acre tract, stating that streets border the proposed project, but only parking lots are planned in the interior and that no streets through the area could be a hindrance as far as fire engines, trash collection and delivery trucks were concerned. City Manager Brunton spoke to the question stating the Planned Unit Developments are tending to look like a "sea of houses and cars", that this one is no better or worse than others, but it was not imaginative and felt that the so called Planned Unit Deevelopments are being used to get a higher density on a smaller piece of property. He suggested that the Council and Planning and Zoning Board discuss the use of Planned Unit Developments at their joint work session scheduled for February 3, 1973, to decide if this is what we want for the future of Fort Collins. Planning Director Don Reynolds said the project meets the usual requirements, that a club house, swimming pool and tennis courts are almost standard fixtures in such projects and normally the plans are so far in advance by the time they see them, it is very difficult to backtrack. After further discussion, motion made by Councilman Peterson, seconded by Councilman Carsonj, that this be approved. Yeas: Councilmen Carson and Peterson. Nays: Councilman Lopez. Bernice Hoover appeared stating that the policy of the City paying for the wives of Council- men accompanying them on conventions, terming it as "second honeymoon", should be brought to the vote of the people. Councilman Lopez stated this term impinged on his wifes honesty, saying he would rather be criticized for taking his wife than be criticized for "going out on -the town" without her. Mayor Carson said he resented the inflection made by Mrs. Hoover and all Councilmen present expressed the part their wives play at the conventions and their interest in City affairs. City Manager Robert Brunton stated the Capital Improvement package, recommended by the DTT2 Committee, will be formally adopted by the City as a master plan that we will try to follow. The group has recommended that the City institute a $16.1 million Capital Improvement program to be financed by a one -cent sales tax. This will be voted on in the February 20th election. Fie said the City officials do not favor tying the Improvements down in too much detail, but flexible in case some recommendation becomes absolete or some unforseen critical need arises. Mayor Carson made the following predictions for the new year 1973: "I have considerable mixed feelings about 1972, but it is past history and I won't dwell on it. Reactionary forces have turned us in many directions. Sometimes, it seems we stood still,sometimes we moved horizontally; and sometimes we went in circles." "Hopefully in 1973 with the plans now laid, we can move forward with confidence and dignity. I personally pledge to do the best I can to serve the public in this position. I challenge all the Council to state to the public their intentionz and l.caallei� e the press to report city affairs accurately and completely. We have witnessed confusion due to lack of information or inac- curate information for which we are all to blame. I hope we can move forware in 1973 with a sense of confidence and a feeling of dignity. Ile are a community of people who have a single purpose - to live confortable, to live harmonously and to make the best of opportunities.
