MEETING November 9, 1972 The City Council of the City of Fort Collins met in regular session at 1:30 P.M. in the Council Chambers of the Municipal Building on Thursday, November 9, 1972. Present: Councilmen Carson, Lopez, Preble, Peterson and Fead. Also present: Robert Brunton, City Manager Michael DiTullio, Assistant City Manager Arthur March, Jr., City Attorney Charles Liquin, Director of Public Works Don Reynolds, Planning Director Verna Lewis, City Clerk Mayor Carson pres- DISPENSING OF MINUTES Motion was made by Councilman Lopez, seconded by Councilman Preble, that the reading of the minutes of the last regular meeting held November 2, 1972, be dispensed with. PROCLAMATIONS WHEREAS, the sacrifices of those Nvno have. lost their lives, their health, or their livelihood as a result of their military service are rightly the concern of all citizens; and CfIRiLS, the annual sale of Buddy Poppies by the Veterans of Foreign Wars offers an opportunity for the people of this commu— nity to express their. solicitude for those unfortunate persons who have paid more than their share of the cost of freedom; and WI-H;RFAS, V.F.PJ. Buddy Poppies are assembled by disabled vet- erans, and the proceeds of this worthy fund-raising campaign are used exclusively for the benefit of disabled and needy veterans, and the widows and orphans of deceased veterans, in the desire to "Honor the Dead by Helping the Living"; therefore I Karl E. Carson , Mayor of the City of Fort Collins, Colorado do hereby urge the citizens of this community to recognize the merits of this cause by contributing generously to its support through the purchase of. NOW, THEREFORE, I, Karl E. Carson Mayor AGENDA ITEM 3A The Mayor declared the Council sitting as Liquor Licensing Authority SPORTSMAN'S BAR, 210 Walnut Street This license was considered to -day with the agreement November 2, 1972, to continue the final hearing on this application until November 16th. Motion was made by Councilman Lopez, seconded by Councilman Preble, that this be continued to November 16, 1972. Ayes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Naves: None. AGENDA ITEM 3B RFNEIVAL APPLICATION FOR HOTEL -RESTAURANT LIQUOR LICENSE BY FLOYD $ REGINA BAKER DBA BAKES, 640 SOUTH COLLEGE REPORT: On November 2, 1972, the above name person made application for renewal of their Malt, Vinous, and Spirituous Liquor License. On November 6, 1972, this officer received the renewal application for review. This officer checked the records of the Fort Collins Police Department and found that this department has encountered no problems with this establishment. AGENDA ITEM i 4A ORDINANCE NO. 70, 1972 BEING AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF FORT COLLINS Motion was made by Councilman Fead, seconded by Councilman Lopez, that Ordinance No. 70, 1972, be adopted. Ayes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nayes: None. AGENDA ITEM SA ORDINANCE NO. 76, 1972 BEING AN ORDINANCE AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLi.INS, COLORADO, 19SS, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE AND CLASSIFYING FOR ZONING PURPC,SES THE PROPERTY INCLUDED IN THE ANNEXATION TO THE CITY OF FORT COLLINS, Colorado. Director of Planning Donald Reynolds reviewed the existing zoning in the area. Councilman Lopez again expressed his desire to have the '.'City take in", or at least plan for, larger parcels of land at one time in order to have more effective planning. Motion was made by Councilman Peterson to approve Ordinance No. 76, 1972, on first reading. Seconded by Councilman Lopez. Ayes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nayes: None. AGENDA ITEM 6A EST ON CENTER PARKING BY AGGIE THEATRE City Manager Robert Brunton reviewed the request from the Manager of the Aggie Theatre and expressed his con tention that this restriction was a Public Department problem rather than a traffic problem, and suggested eiiminating the prohibition on parking with the stipulation that the situation be watched closely. Input into the question was given by Councilman Lopez, Assistant City Manager Mike DiTullion and Traffic Engineer Joe Rice, as related to the problem being one of loitering and rubbish and time needed for flushing the Center Parking. ?lotion was made by Councilman Lopez to authorize the Administration to remove the existing parking restriction in the three block area, seconded by Councilman Preble. Ayes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nayes: None. AGENDA ITEM 6B REQUEST FOR CITY SEWER SERVICE LUTHER 6 EVELYN JACKSON DBA THE DOG HOUSE 720 Willox Lane Public Works Director displayed the area requesting service and recommended authorizing the extension, subject to the provisions of the Utility extension policy under consideration by Council. Mayor Carson expressed the general views of the Council that in addition to the Extension Policy requirements, it would be well to have some input from the Planning office pertaining to any zoning proposed or annexation petitions. Motion was made by Councilman Fead to table this request, seconded by Councilman Lopez. Ayes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nayes: None. AGENDA ITEM 6C BIDS - SOUTH COLLEGE CURB (HIGHWAY DEPARTMENT) PUBLIC WORKS DEPARTMENT The City has received bids for the construction of curb and gutter on South College Avenue, from Rutgers to Mathews, for the median separating the frontage road from the main highway. The bids received are the following: 1. Concrete Construction & Placing, Inc. $10,460.00 2. Kiefer Concrete, Inc. 15,862.50 3. F. & F. Concrete Construction No Bid due to large backlog Of work. The estimated cost was $15,100.00. The Highway Department has agreed to pay the full cost of this curb and gutter installation. We have submitted the bids to the Highway Department for approval, and they have informed us that we can proceed with the contract. We therefore recommend the award of the contract to Concrete Construction $ Placing, Inc., with the City to be reimbursed by the Highway Department in the full amount of the contract. AGENDA ITEM 6D BIDS - TRAFFIC LIGHT POLES FOR TRAFFIC ENGINEER REPORT: Bids received and evaluated covering consideration for purchase of two steel traffic light poles with 32' mast arms and two steel traffic light poles with 25' mast arms. Mr. Joe A. Rice,'Traffic Engineer, has evaluated the bids. Based upon Mr. Rice's letter, the recommendation is that the bid be awarded to.Union Metal Manufacturing Company in the amount of $2,458.84. /s/ E. M. Kuppinger Purchasing Agent Traffic Engineer .Joe Rice stated these poles would be used at College and Willox, that they were approved in the 1972 budget signalization project, and explained the delay in getting the work under way was the work being done in the downtown area. Additionally, he hoped the installation would be completed before Christmas. Motion was made by Councilman Lopez, seconded by Councilman Peterson, that this be approved. Ayes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nayes: None. AGENDA ITEM 6 E. RIGHT-OF-WAY AGREEMENT FOR SEWER LINE AT ASH AND LAKE STREETS 1 Motion was made by Councilman Peterson, seconded by Councilman Lopez, that this be approved. jAyes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nayes: None, AGENDA ITEM 6F UTILITY EXTENSION POLICY This item has been under consideration for some time by the Council; the initial report from the Rater Board was presented to the Council on October 10, 1972 Since then much Staff work has been done and the following summary of the progress was giver}�ythe City Attorney and City Manager: Changes recommended by the Administration: 1. That petioners request be channeled to the Electric Department for approval or disapproval. 2. The question of applicability of County verses City Codes: the City would accept County inspections generally. In those areas not on par with City regulations, the City would in- spect. 3. Tile City would accept the County Subdivision regulations. These requirements were established to eliminate present difficulties in petitioners circumventing regulations and then coming back and requesting annexation. Councilman Fead again expressed the need to know what these extensions cost the City. \lotion was made by Councilman Lopez,.to instruct the Administration to draw up this policy in formal form, including the recommended changes, seconded by Councilman Preble and adopted. AGENDA ITEM 6G SOLE SOURCE OF SUPPLY BID FOR RIVERSIDE PAVING RE: aids for Asphalt Paving for Riverside Drive from 'Magnolia to Oak Pie have received quotations from Flatiron Paving Company and Sterling, Paving Company for the Riverside reconstruction. The ,-mounts bid were Flatiron Paving Company $9.20 per ton and Sterling Paving Company $8.50 per ton. The approximate amount of paving required is 600 tons. We are requesting that this contract be awarded to Sterling Paving Company in the amount of $5,100 on a Sole Supplier JustificaIion since these are the only contractors in the area capable of doing tine work. Naves: None AGENDA ITEM 6H PLAMNED UNIT DEVELOPMENT TRACT K SOUTILWOR VILLAGE, THIRD FILING The area in question was reviewed by the Director of Planning who stated the water retention pond would double as open space. The Citv Attornc% advised the Council the City must receive an easement from the developer for drainage hui;•,ces. Motion was made by Councilman Fead to approve PUD, subject to an easement for drainage purposes, seconded by Councilman Peterson and adopted. Ayes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nayes: None. AGENDA ITEM 6I INSTALLING SCHOOL FLASHING SIGNALS CODLMUNICATION: RE: Traffic Studies at Drake & Tulane and Mulberry at Dunn Elementary School, For Possible Upgrading of Controls. . Since school has been in session, I have had numerous calls from parents and from the school principals at the respective schools that are served by the subject mentioned locations. These calls were requesting some type of control in addition to those that now exist. I have made studies of the two locations and the results are as follows: Drake h Tulane (O'Dea Elementary) By examining the attached pedestrian -vehicle and radar sheets, you will note that ehere are 107 children and 257 vehicles in the A.M. period and 132 children and 449 vehicles in the P.M. period. This is an increase of 14 percent pedestrians and 25 percent vehicles over the counts taken in November, 1971. The speed radar sheets reflect an 85 percentile speed of 34.5 miles per hour through the crossing. Ftulberry at Dunn Elementary By examining the report sheets for this location, you will find the totals for children and vehicles,to be 116 and 527 in the A.M. period and 137 and 667 in the P.M. period. This is an increase of 21 percent pedestrians and 18 percent vehicles over the November, 1971 count. Radar indicates a 34.5 mile 85 percentile speed at this location also. In February of this year the Council approved the installation of reduced speed flashers at seven locations on some of the major streets. In comparing the figures of this study with those of the November counts, these two locations are as high as the previous figures with the exception of two of the seven locations and are above the other five locations. i•Tien the, flashers were installed there was no set criteria other than the speed factor. I can only recommend that these two locations be given serious consideration for flashing speed limit signs on the basis of speed and due to the fact that there are locations controlled by these flashers that have a much lower volume of pedestrians and vehicles. If further information is necessary, please check your files for my memo to the City Manager of December 10, 1971, and the City Manager memo to the Mayor and Council of January 14, 1972. Respectfully submitted Joe' Traffic Engineer F'- -; 7 ..a 241 Nomember_8.,_1972 It — City Manager Robert Brunton stated that the best way of alerting people to traffic con- ditions is to issue traffic tickets. Joe Rice, Traffic Engineer, said there had been some problems with speed th'7ough this area and the flashers slow it down some, stating there had been no pedestrian accidents at the school crossings and felt that the pedestrian light is effective. He said the approximate cost of these lights are $750.00 each. Motion was made by Councilman Fead, seconded by Councilman Preble, that these lights be approved. Ayes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Naves: None. AGENDA ITEM 6J TWO SPEED GUNS - POLICE DEPARTMENT City Manager Robert Brunton stated that this item is not budgeted but recommended the purchase of these guns, as will be reimbursed 100% by Federal funding. Motion was made by Councilman Peterson, seconded by Councilman Preble, that the City Manager's recommendation be approved. Ayes: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nayes: None. AGENDA ITEM 6K ALLOWING CSU TO USE ONE STREET LIGHT POLE, TWO TRAFFIC SIGNALS AND TWO PARKING SPACES - ATMOSPHERIC RESEARCH PROJECT City Manager Robert Brunton reported that he had met with Mr. Reiter, head of Apmospheric Science at CSU, and he had requested the use of one street light pole on College between Mountain and LaPorte and two traffic signals at the intersection of College and LaPorte for the temporary installation of atmospheric testing devices, also two parking spaces for the storing of the necessary measuring and recording instruments, stating the testing would not take place until after January 2, 1973, not to exceed four weeks. City Attorney Arthur March, Jr., advised the Council the State Eoard would not sign a "hold harmless,' agreement, however, he would be in touch with John Bush and work out an agreement whereby CSU would be responsible. City Manager Robert Brunton recommended that this be waived in.lieu of copies of the reports of the studies be furnished the City. Ayes: Councilman Carson, Lopez, Preble, Peterson aid Fead. Nayes: None. City Attorney Arthur March, Jr., reported on the matter of the local taxi cab incident with a CSU transportation vehicle and charges brought against two drivers. Ile advised the Council that this was outside of his jurisdiction but lie would report to the PUC. Councilman Fead said he felt this should be reported to the PUC and that this incident which happened in September, go on their license record. Councilman Lopez inquired into the situation of taxi cabs being parked parallel on Walnut Street, and further stated he felt it was a traffic hazard. Public Works Director Charles Liquin advised the Council that this parking situation had been worked out between the Taxi Company and the Traffic Engineer. Councilman Preble brought up bycycle safety and the lack of concern the bicycle riders have for traffic. City Attorney Arthur March, Jr., advised Councilman Preble that they cannot set fines for the students. Fie said that warning tickets are issued which the parents sign and on the third warning the parent is required to be present with the child when ticket is presented to the Police Department. He said that adults are given tickets the same as with a car. Councilman Fead read from the following proposed statement: With much ts]_k about piacn^ci growth and I_lie need for orderly development, we are nrocccci7:.; to do nothin, about implementing a comprrlunsi.ve development policy. One could not accuse us of being i_nconsistene' We have consistently zoned or rezoned street corner by street corner for the sli_f,htly less than two years that I have served on council. Most frequently, such actions simply formalize the establishment of the developer's request -- often in complete disregard of our professional Land Planners' advice. Each time that a cOiicrover9ial problem arises, we hear that it was done this way some place else in town -- usually on South College Avenue -- and that to change now would be unfairly changing some : V A 2 November 9, 1972 Motion by Councilman Fead, seconded by Councilman Preble to award the bid. as recommended. Yeas: Carson, Lopez, Preble and Fead. Nays: None. Resignation from Human Relations Commission by Mrs. Jesse Godinez - Accepted. Mrs. Jesse Godinez sub mitted her resignation from the Human Relations Commission, stating an increase in family members and conflicting school activities precluded regular attendance at the meetings. Motion by Councilman Lopez, seconded by Councilman Fead, to accept the resignation with regret and instruct the administration to convey the Council's appreciation for years of service on the Board. Proposed NoiseGrdinance taken under advisement At the request of Councilman Preble, the City Clerk read at length a letter to the Council from Jack A. Willeford, Ph.D., Director Division of Audiology and William E. Lentz, Ph.D. Di- rector, Hearing Clinics, in which they submitted a proposed Noise Ordinance, with the desire that Council study the proposal carefully and critically and then schedule a meeting with Council to discuss the features of the document. Each member of the Council received a copy of the proposed ordinance and the City Attorney will also review the proposal. Report of Wednesday Night Council Talk Session Councilman Fead gave a brief report on his Wednesday Night talk session, stating items of discussion were (1) proposed electric substation, (2) the Liquid Metal Breeder Reactor and (3) Planning concepts. Charter Review Committee Appointed Mayor Carson appointed nine members of an eleven member special committee to recommend changes in the City Charter. It was the Mayor's desire to get representation from a cross- section of the community. The appointments announced are as follows: Charles N. Shepardson, Chairman; David E. Watrous, William Stover, Nicholas Massaro, Mrs. Duane Barnhart,- Mrs. Dennis Burrnett, Ray Greer, Maurice Nelson, and Alvin Kruchten. Motion by Councilman Fead, seconded by Councilman Preble, to ratify the appointments. Yeas: Carson, Lopez, Preble and Fead. Nays: None. Four Special Meetings Announced. Mayor Carson reminded Citizens of a meeting on Foothills Development to be held November 20, 1972 at 7:30 at Belvins Junior High; City Council to meet Wednesday, November 22, 1972, at 1:30 P.M. instead of Thanksgiving. A meeting on cemetery policies on November 27, 1972, at 7:30 P.M. in Council Chambers and a meeting on possible revisions to the Dog Ordinance on November 29, 1972, at 7:36 P.M. in Council Chambers. Mayor Carson also announced the third annual Public Employees Appreciation Day to be held Sunday, November 19, 1972, at 3:00 P.M. at the Presbyterian Church, 531 South College, Dr. Edward A. Lindell, Dean of Denver University to be the speaker, and urged all to attend. Adjournment The meeting was adjourned on motion by Councilman Lopez, seconded by Councilman Preble.
