Ordinance Denied Amending Section 84-2 of the Code Relating to the Possession, Use or Distribution of No More Than One Ounce of Marijuana and Setting a Penalty Therefor Following is the City Manager's memorandum on this item: "On Thursday, February 15, the City Clerk received an initia- ted measure relating to the decriminalization of marijuana. The petitions for this measure have been officially certi- fied by the City Clerk. There are sufficient signatures to require Council to: 1. Adopt the Ordinance; 2. Place it on the April 3, 1979, ballot; 3. Call a special election to decide the issue. Technically, the oetition was filed too late to compel the Council to place the issue on the April 3rd ballot. However, there is enough time remaining before the April election for the Council to voluntarily put the issue on the April 3rd ballot and avoid the need for a special election. Council considered the proposed ordinance at a work session on October 24, 1978. By a 5 to 1 poll vote, it was decided not to bring the matter before Council as a .formal ordinance, proposal. Based upon this action, it is recommended that ( Council not adopt the ordinance and submit it to the elector- ate on the April 3rd ballot. -290- February 27, 1979 Also attached is a memo from the City Attorney addressing the substance of the initiative."
