A regular meeting of the Council of the City of Fort Collins was held on Tuesday, July 25, 1978, at 1:00 p.m. in the Council Chambers in the City of Fort Collins City Hall. Roll call was answered by the following Councilmembers: Bloom, Gray, Suinn and St. Croix. (Secretary's note: Councilman Wilkinson arrived at 1:05.p.m. and Councilman Bowling arrived at 1:10 p.m.) Absent: Councilman Russell. Staff Members Present: Arnold, Lanspery, Hogge, Kuppinger, Bugglin, Polifka, Deagle, Bingman, Liley and Lewis. Liability Insurance Bids Awarded Following is the City Manager's memorandum and recommendation on this item: RECOMMENDATION: We reccnmend acceptance and approval of the General and Auto Liability proposals with the Home Insurance Company totaling $157,017. Procurement of False Arrest and Public Officials Liability coverage through the International League of Cities and Vanguard Insurance Company at a cost of $22,704. BACKGROUND SUMMARY: With the, assistance of Mr. Wayne Jurgen, staff prepared bid pro- posals for liability insurance which were distributed in early June. The specification were designed to request proposals for deductible insurance which would allow the City to consider a self-insurance program. We were also looking for quotes on excess liability insurance coverage. We are extremely pleased with the bids. Our recocmendation is to V a complete coverage policy for general and auto liability with the Home Insurance y at a price of $157,017. The policy`would offer coverage of Joe Wright Reservoir -396- July 25, 1978 but would not include errors and omissions coverage. To secure coverage on the latter, ' it is reconvended that we obtain a policy for false arrest and minimal public officials liability coverage through the International League of Cities at a cost of $22,704. These policies total $179,721 and essentially duplicate the coverage of our present. policy with Gulf Insurance Company which costs us annually $187,832. Considering that- (1) The City is growing, (2) Our own capital plant is expanding (including Joe Wright's completion), and (3) Last year we received only one bid for this coverage, the recommended Policies aryl their costs are very canpetitive.. The full coverage policy is also cost effective when compared to the deductible quotes. We would also like to discuss the options of obtaining excess coverage for both liability and public officials coverage. The Colorado statutes pro- vide for limits on the liabilities of municipalities as a vestige of the old doctrine of sovereign immunity. These limits are presently $lo0,000 per individual and $300,000 per occurrence. However, to the extent a municipality insures above these amounts, the liability limits are raised accordingly. There have been some recent court decisions - concerning limited liability and municipal employees which should be taken into considera- tion when examining the question of excess coverage. Legal staff can discuss this matter at the meeting and assist you in determining whether the risk is significant to justify payment of the premiums for this additional coverage. Assistant City Manager Lanspery presented the following recom- mendation for award. - 1. General and Auto Liability Recommendation Exhibit A - The Home Insurance Company _ General Liability - 96,226 - Auto Liability - 60 7791 2. False Arrest and Public Official Liability Recommendation Exhibit E - International League of Cities and Vanguard Insurance Company Public Official - 5,477 False Arrest 17,257 $ 2 Mr. Wayne S. Jurgens, Insurance Consultant and Assistant City Attorney Deagle addressed Council questions regarding the insurance proposals. 39.7.- 1 July 25, 1978 ' Councilman Wilkinson made a motion, seconded Bowling to approve the Home Insurance Company International League of Cities Policy through the Public Officials (Policy) through Forum, of the property insurance as of December 10. members Bloom, Bowling, St. Croix, Suinn and Councilwoman Gray. THE MOTION CARRIED Executive Session Authorized by Councilman Policy, the Vanguard, and the purchase Yeas: Council - Wilkinson. Nays: City Manager Arnold stated Council had asked that an executive session be held to discuss personnel matters. Councilwoman Gray made a motion, seconded by Councilman St. Croix to adjourn into executive session for the purpose of discussing personnel matters. Yeas: Councilmembers Bloom, Bowling, Gray, St. Croix, Suinn and Wilkinson. Nays: None. THE MOTION CARRIED Adjournment Mayor Suinn declared the meeting adjourned at 1:30 p.m. ATTEST: City Clerk -3398-
