A regular meeting of the Council of the City of Fort Collins was held on Tuesday, November 4, 1975, at 5:30 P.M. in the Council Chambers in the City of Fort Collins City Hall. Mayor Russell called the meeting to order noting the following Councilmembers present: Bloom, Bowling, Gray, Reeves, Russell, Suinn and Wilkinson. Staff members present: Brunton, Bingman, Cain, Kaplan and Lewis Also: City Attorney Arthur March, Jr. Minutes of the Regulur Meeting of October 21, 1975 • 5ahled Mayor Russell announced that the minu:es of the October 21, 1975 meeting have not been distributed and will be put on the agenda for consideration ' at the November 18, 1975 meeting. Ordinance Adopted on Second Reading Assessing Costs in Water Main Improvement District No 6 Councilman Bloom made a motion, seconded by Councilman Bowling to adopt Ordinance No. 64, 1975 on second reading. Yeas: Councilmembers Bloom, Bowling, Gray, Reeves, Russell, Suinn and Wilkinson. Nays: None. ORDINANCE NO. 64, 1975 BEING AN ORDINANCE -ASSESSING THE COST OF IMPROVE— MENTS IN WATER MAIN IMPROVEMENT DISTRICT NO.'6 AND PROVIDING FOR THE PAYMENT AND COLLECTION THEREOF WHEREAS, heretofore by appropriate ordinances and resolutions duly adopted by the Council of the City of Fort Collins, there was established Water Main Improvement District No. 6 for the purpose of installing water mains to serve certain properties in the City of Fort Collins, Colorado, all pursuant to Chapter .1.6 0' the Code of the City of Fort Collins; and 308 309 ' WHEREAS, pursuant to said ordinances and resolutions, said improvements have been installed and accepted by the, City of Fort Collins, Colorado; and WHEREAS, upon accepting said improvements, the City Council adopted the report of the City Engineer respecting the cost of such improvements and the 'schedule of assessments prepared by the City Engineer and ordered notice to be published as provided in Chapter 16 of the Code of the City of Fort Collins, which said notice was duly published as d- therein provided; and WHEREAS, October 21, 1975, is the date set for the hearing of complaints and objections and the determinations w of the same and for acting upon an ordinance assessing the cost of such improvements; and WHEREAS, all complaints and objections in writing filed by property owners within the District have been considered by the City Council. ' NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the total coei: of the improvements in 'Water Main Improvement Distric. No, 6, in--luding the cost of engineering, legal, publication, interest during construction and collection, to -wit: $93,364.10, less the portion of said cost to be paid by the City of Fort Collins, to -wit: $39,357.33, is hereby assessed upon the real estate in said District in accordance with the provisions of Chapter 16 of the Code of the City of Fort Collins, and the proportion of said costs assessed upon each lot or tract of land in said District shall be as follows: 1 f ,r 309 • . ...-. All assessments herein provided for shall be due and payable within thirty (30) days after the final publication of this ordinance, without demand, provided that ' all such assessments may, at the election of the owners of the property assessed, be paid in ten equal installments, the first installment being due on the first day of May, 1976,•and on the first day of May of each year thereafter until the full amount thereof has been paid, together with interest on the unpaid principal at the rate of six percent s (6%) per annum, said interest to be payable at the time of the principal payments. Failure to pay the whole of such assessment within thirty (30) days as aforesaid shall be conclusively considered and held as an election on the part. of the persons interested, whether under disability or otherwise, to pay in such installments. Section 3. In the case of election of any person to pay in installments as aforesaid, the failure to pay any installment when due, whether on principal or interest, shall cause the whale of the unpaic'. principal to become due " and payable imr!iediately and the whc:le amount of unpaid prin- cipal and accrued interest shall '.hereafter draw interest at the rate of one percent (1%) per month until the date of sale as hereinafter provided; provided, however, that at any time prior to the date of sale, the owner of the property - assessed may pay the amount of all unpaid and due install- ' ments, together with all interest that has accrued as afore- said, and all penalties accrued, and upon such payment shall be restored to the right to pay the installments in the same manner as if the default had not occurred. The owners'of any property not in default as to any installments or payments may at any time pay the entire unpaid balance of principal, together with interest accrued thereon, to the first day of the month following such payment. Section 4. Payinents-may-b-e--made to the Director of Finance at any time within thirty (30) days after the final publication of this ordinance and in such event an allowance of five percent (5%) as a discount shall be made on all payments during such period only. Section 5. In case of the default in the payment of any installment of principal or interest when due, all property concerning which such default is suffered shall be advertised by the County Treasurer and sold for the payment of the entire unpaid assessment thereon at the same time or times and in the same manner under all the same conditions and penalties and with the same effect as•provided by law For the sale of real estate in default of the payment of general taxes, all as provided by Charter 16 of the Code of the City of Fort Collins. 314 315. Section 6. The Director of Finance shall prepare the foregoing assessment roll in proper form as provided in Chapter 16 of the Code of the City of Fort Collins, and shall keep a record of all payments made during the thirty - day period after the final publication of.this ordinance and upon the expiration of said thirty -day period, he shall deliver said assessment roll to the County Treasurer of Larimer County with his warrant for collection of the same, all as provided in Chapter 16 of the Code of the City of Fort Collins. r,, Section 7. All collections made by the County Treasurer cyl. on said assessment roll in any calendar month shall be CC accounted for and paid over to the Director of Finance on Gi the first day of each and every month with separate statements for all such collections for each month in the same manner as general taxes are paid by the County Treasurer to the city. _ Section B. The owner of -any divided or undivided . interest may pay his share of any assessment upon producing evidence of the extent of his interests satisfactory to the officers having the roll in their charge. Section 9. If any property owner eligible therefor is granted a deferment from the assessments made by this ordin- ance pursuant to the provisions of ordinance No. 106, 1973, then the lien created on such owner's property by this -ordinance shall remain in full force and effect, but the same shall not be due or payable until the deferment granted pursuant to Ordinance No. 106, 1973 has expired. All assessments herein provided for shall be due and payable within thirty (30) days after the final publication of this ordinance, without demand, provided that all such assessments may, at the election of the owners of the property assessed, be paid in ten equal installments, the first installment being due on the first day of May, 1976, and on the first day of May of each year thereafter until the full amount thereof has been paid, together with interest on the unpaid principal at the rate of six percent (6%) per annum, said interest to be payable at the time'of the principal payments. Failure to pay the whole of such assessment within thirty (30) days as aforesaid shall be conclusively considered and held as an election on the part of the persons interested, whether under disability or otherwise, to pay in such installments. City Manager Brunton recommended this be an item of consideration for the November 11, 1975 Work Session., Council concurred in this recommendation. Recommendations from Human Relations Commission Scheduled for Work Session At its October 16, 1975 meeting the Human Relations Commission recommended that a revised ordinance and bylaws be approved by the City Council. City Manager Brunton again recommended this item be scheduled for a Work Session. 344 - - - -- 345 1 1 1 Special Assessment District On Taft Hill Road: Authorized to Proceed Following is the City Manager's memorandum on this item: At its October 28, 1975, work session, the City Council received a report from Roy Bingman, Director of Engineering Services, with regard to the status of our urban systems money and various projects. One of the needed projects that was included was a special assessment district on Taft Hill Road between Laporte Avenue and Prospect. The City's contribution to the special assessment project is $80,000 which could be funded through the urban system revenue. Because of the tight right of way and the closeness of the houses, especially on the West side of Taft Hill, it will be necessary for us to have a roadway in this area no wider than 50 feet. Because of severe deadline problems, we would have to proceed with this project as soon as possible. Special assessment projects are never popular; however, it is the City's only way of financing street improvements except when a street is put in by a developer as part of the subdivision requirements. This street is needed because of the severe north -south traffic problems as was indicated before. We will have to put this project as number one priority if it is approved by the City Council. Recommendation: The Administration recommends that the City Council authorize the Administration to proceed as rapidly as possible with a special assess- ment project on Taft Hill Road between Laporte Avenue and Prospect Street. Old Fort Site At.the October 28, 1975, work session, the City Council heard a report from Charles Hagemeister and Colonel John Hughes of the Centennial -Bicentennial Committee in regard to the old fort site project. Because of many circum- stances beyond their control, they feel it is not possible for them to proceed with this project at this time. They feel that the report prepared was extremely helpful and beneficial in this process. They hope that at some future stage this project can be reactivated. However, for the time being, this should be officially canceled. Councilman Bowling made a motion, seconded by Councilman Suinn that letters of appreciation be sent to those persons who had worked on the project and to.officially terminate the same. Nays: None. 345 m Y to Vacate a Portion of Alpine Street to City Attorney for Ordinance Prep tion Through our City Attorney, we received a petition to vacate a portion of Alpine Street, located in the north part of the city and west of College Avenue. The majority of Alpine Street was vacated some time ago. The only portion of Alpine Street west of College is a 190-foot section on the south side of Alpine Street. There exists a residence which encroaches on the public right-of-way by 3-' feet. The existing fenced yard encroaches an additional 19 feet. The petitioners request the City to vacate the south 22 feet of Alpine. This vacation is needed in connection with the pending. sale of the property. Councilman Wilkinson made a motion, seconded by Councilwoman Reeves to approve the vacation and authorize the City Attorney to prepare the vacation ordinance. Other Business 1. City Manager Brunton stated that he would like to address a possible exemption for the payment of sales tax on manufacturing equipment. Mayor Russell requested this item be placed on the November 11, 1975 Work Session. 2. City Attorney March advised the Council that Municipal Judge, John Tobin has disqualified himself from hearing the two cases now pending against various members of the Council. The attorneys have met and agreed on a list of local attorneys that would be acceptable to both as well as two judges from other communities that would be acceptable. The desirability of having a local person was twofold, f#st_ it allows_ the Council to appoint the person as an -assistant municipal judge, the Charter provides that one must be a resident of the City to be a judge; if an out -of -city judge would have to be appointed as a referee he would make recommendations to Judge Tobin who would make a ruling -on that recommendation making the process cumbersome. The second item would be the time element if this were heard locally. Judge Tobin had contacted one of the attorneys on the list, Mayo Sommermeyer and he has agreed'to serve if appointed. City Attorney March, therefore, requested that the Council, by potion, appoint Attorney Mayo Sommermeyer as the Assistant Municipal Judge. 348 fl 1 1 349 Councilman Wilkinson made a motion, seconded by Councilwoman Gray to appoint ' Mayo Sommermeyer as -Assistant Municipal Judge. Mr. Richard Shikir, 2908 Eagle Drive, presented the following petition: We, the undersigned effected residents of South Meadowlark Heights sub- division, hereby protest the recent roadwork done on our streets (Bluejay, Eagle, Flicker, Redwing, and Ringneck). We feel the gravelly substance placed on these streets form a nuisance on at least one of the following several accounts: 1) It creates a lot of dust, making it a nuisance to clean and causing a potential health hazard; == 2) It makes biking on the streets a treacherous endeavor, for both children and adults, therefore posing a potential safety hazard; 3) .The gravel gets kicked up onto our sidewalks and driveways, causing a nuisance in terms of maintenance of our property. .We hereby request that the present gravelly surface be replaced with a smooth asphalt road, as was found on these streets before the road "improvements" were put in, City Manager Brunton and Director of Engineering Services, Roy Bingman ' responded to the road reconstruction in the area. They indicated they would investigate the situation and report back. 2. Bill Hanson, 1401 West Mulberry spoke to a bus stop bench which had been designed and installed by the Sertoma Club. The Sertoma Club has offered its service for building additional benches. Ordinance Adopted as Amended Relating to Meeting of the City Council Mayor Russell read the following proposed amendment to the ordinance relating to informal conferences: 'T. Official Meetings. The provisions and requirements of this article shall apply only to•regular or special meetings called pursuant to this article. No other gathering of the Council shall be considered a meeting and no official action of the Council shall be taken except at a regular or special meeting called and held in accordance with the provisions of this article." Councilmembers expressed opinions on the need for. the ordinance or lack of need, ranging from regret to the feeling that the above section might be deleted. Mr. Gerald Sharpnack, of the Fort Collins Coloradoan stated "I think the three exemptions (personnel, attorney -client, and land acquisition) are too broad." ' Further Mr. Sharpnack stated he did not agree with the City Attorney's opinion and contends that this matter should go before the voters. 349 Mr. Andy Anderson, 1421 Skyline Drive, inquired if Council considered appoint- ments to boards and commissions an item for Executive Session. Planning Director, Les Kaplan, stated an agreement had been agreed to by the various owners. Planner I, Paul Deibel stated the specifics provided for adequate access to the site, as well as a provision which would limit the curb cuts to 13 with curb cuts no closer than 120 feet from any other curb cutand the exact location of the curb cuts to be approved by the City Engineer. Councilwoman Reeves made a motion, seconded by Councilman Bloom to approve the Riverside Subdivision, 7th filing with the provision that all owners sign the plat that the curb cut regulation be fixed on the plat and that the landscaping covenants extend over the entire plat. Request from Downtown Merchants Association Regarding Christmas Lighting Approved At the September 15, 1975, meeting, the City Council discussed the request from the Downtown Merchants Association with regard to the City financially ' assisting with the Christmas lighting. After considerable discussion, the City Council voted to authorize the City's installing and removing of the lights. However, the acquisition costs, energy costs, and storage costs, were to be borne by the IVA. 350 351 Subsequently, the DMA has attempted to get volunteers to assist in the ' installation and removal of the Christmas decorations. They have also pur- chased or have tentatively purchased Christmas lighting that is lighter and has less wattage of illumination. Therefore, with the volunteers to assist in the installation, the City's involvement in this process will be less than anticipated. The original kilowatt hour estimate for the cost of power estimated on a 37-day, 15 per hour, was 9,202 kilowatt hours. The new kilowatt hour estimate is 3,330 kilowatts. The energy costs should be less than $150. Recommendation: The Administration recommends that the City provide the aerial l�orm or bucket to assist the DMA in installing and removing the decorations and to energize and connect them into the electrical system, and �^ also pay the cost of electrical energy. (Councilmen Russell and Wilkinson out of room.) Storm Drainage Detention Pond Maintenance ' Policy Approved This item had been tabled on April 1, 1975. Councilman Wilkinson made a motion, seconded by Councilwoman Gray to remove this item from the table for consideration. Yeas: Councilmembers Bloom, Bowling, Gray, Reeves, Russell, Suinn and Wilkinson. Nays: None. Director of Engineering Services, Roy A. Bingman spoke to the problem and the proposed policy. There is a problem at the present time as to the responsibility for the main- tenance of detention ponds in areas where there is no home owners association responsible for this type of maintenance or where the detention pond counts as a portion of the total open space requirement within a P.U.D. The mainten- ance problems include cutting weeds or grass and maintenance of the storm drainage related facilities such as inlet pipes, outlets, channels through the drainage pond, and so forth. Since these facilities are part of the overall drainage system of the City of Fort Collins which the City normally maintains through the Street Department, we are recommending that the Street Department be responsible for maintenance of these detention ponds under the following conditions: 1. That the pond be properly constructed as approved by the Engineering Depart- ment. 351 2 2. That there be certain minimum landscaping requirements such as seeding with wild grasses to control weeds and some tree and shrub installation exclusive of sprinkler systems. 3. That the terms under which the City would maintain the ponds would include several cuttings per year to keep the grass and weeds to a controlled condition, little or, no landscape maintenance as such, and no sprinkling activities. :. The above measures should insure that detention pond areas are maintained in a reasonable condition where there is no other satisfactory arrangement for such maintenance by the home owners and limit the City's liability for such maintenance to the absolute minimum. I recommend that this matter be presented to Council for policy adoption. Note: This item was considered prior to the break and voted on at the proper. time on the agenda. Prohibit bikes on College Avenue proper. ' Prohibition ends at Foothills Drive. The problem is more difficult on the west side of College Avenue because of the few side streets. We recommend the following: Laurel to Prospect. Prohibit bikes on College proper; side streets provide access to University; wide sidewalks provide room for bicyclists along University; University Square development incorporates bike lanes near railroad when built; from.Pitkin to Prospect there are presently few destinations, and side streets c! provide access. r Pros ect to Rut ers. Prohibit bikes on College proper; modify sidewalks and _ cur s at intersections for bike use off the street. Rutgers to Drake. There is sufficient width for bike lanes on College proper; we recommend painting of lanes in this area; no other work needed. Drake south to Foothills Drive. Easements are necessary at Ghent Motors and MAirray's Furniture and installation of sidewalks to provide access to Frontage road; Frontage Road is available from there south. We have estimated the cost of the improvements at approximately $10,000 including ' bike route signs, bike lanes, and concrete and asphalt work. Because of the easements or right-of-way necessary in some locations, and the .time of year, we are recommending implementation of these proposals early in 1976, as soon as construction and painting are possible.
