Councilwoman Gray made a motion, seconded by Councilman Wilkinson to adopt Ordinance No. 136, 1977 on second reading. Yeas: Councilmembers Bloom, Gray, Russell and Wilkinson. Nays: None. THE MOTION CARRIED ORDINANCE NO. 136, 1977 BEING AN ORDINANCE PROVIDING FOR AGENDAS FOR MEETINGS OF THE CITY COUNCIL, PROVIDING FOR A CONSENT CALENDAR IN CITY COUNCIL AGENDAS AND THE MANNER OF ACTING UPON MATTERS ON THE CONSENT CALENDAR BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. Council Agendas. The City Administration. shall prepare the agenda for all meetings of the City Council. The agenda shall include all items requiring Council action. Whenever possible, there shall be submitted with the agenda all facts necessary for the Council to properly study the item and make a decision thereon. To this end, the City Manager may include his recommendation on items to be considered. Section 2. Consent Calendar. The agenda for Council meetings may include a consent calendar. Matters of a noncontroversial nature requiring Council action may be placed on the consent calendar portion of the agenda. No ordinance scheduled for first reading shall be placed on the consent calendar for passage. Ordinances scheduled for second reading may be placed on the consent calendar for passage,.but in this event the title of each such ordinance shall be read prior to action by the Council on the consent calendar. Any Council member, the City Administration, any citizen or any interested party may request at any time prior to action by the Council on the consent calendar that an item be removed therefrom and considered as a separate item by the City Council. Prior to action by the Council on the consent calendar, the presiding officer of the Council shall identify the items on the consent calendar and advise 375 1 December 20, 1977 t persons present of the right to request removal of any item for separate consideration.; If request is made to remove an itemsfrom the consent-calendar,•the -items shal•l,be removed and .the presiding officer shall place such item on the agenda for that meeting at an appropriate place for separate adtion.. ORDINANCE NO. 137, 1977 BEING AN ORDINANCE AMENDING CHAPTER 104 OF THE CODE OF THE CITY OF FORT COLLINS RELATING TO RETAIL SALES AND USE TAXATION. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That Section 104-14A of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows: "A. There is hereby imposed a tax upon all sales of commodities and services specified in S 104-11 and not exempt therefrom as specified in S 104-12, at the rate of two percent (2%) of the amount of the sale to be computed.in accordance with schedules or systems approved by the Director of Finance. Said schedules or systems shall be designed so that no such tax shall be charged on any sale of seventeen cents ($.17) or less." Section 2. That Section 104-25C of the Code of the City of Fort Collins be, and the same hereby is, amended to read as follows: "C. Notwithstanding the rate of tax imposed by § 104-23 of this Article, and in order to avoid fractions of pennies, the tax payable shall be computed in accord- ance with schedules or systems approved by the Director of Finance. The hearing for this Ordinance was held on Novenber 15, 1977, and no objections were raised. However, Ed Carroll discussed with the staff a problem relating to the water line installation in Mason Street. Mr. Carroll has already paid for his share of the cost of.a water line on the frontage road and in Swallow Road adjacent to this property. He considers the benefit of a third water .line minimal and requests Council consider relief on his assessment. ORDINANCE No. 138 , 1977 BEING AN ORDINANCE RELATING TO THE CREATION AND ORGANIZATION OF STREET IMPROVEMENT DISTRICT NO. 73, AND PROVIDING FOR THE CONSTRUCTION OF IMPROVE- MENTS THEREIN WHEREAS, heretofore the necessary proceedings were instituted to create a special improvement district for the purpose of installing the improvements described on Exhibit "A" attached hereto (hereinafter sometimes referred to as "the improvements") for the benefit of the property described on Exhibit "A"; and . WHEREAS, the City Council has received the necessary reports, given the required notice and held a hearing as required by the Ordinances of the City; and WHEREAS, the City Council is of the opinion that it is in the best interests of the City of Fort Collins to form said special improvement district. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That there is hereby created and organized an improvement district under and by virtue of the provisions of Chapter 16 of the Code of the City of Fort Collins, to be known as Street Improvement District No. 73 (hereinafter sometimes referred to as "the district") comprised of the property described on Exhibit "A" attached hereto. Section 2. That the improvements to be constructed shall consist of the improvements described on Exhibit"A" attached hereto, all as more fully set forth in the map, plans and specifications heretofore submitted by the City Engineer and accepted by the City Council by resolution. Section 3. That the total cost of such improvements shall not exceed by more than five per cent (58) the City Engineer's estimate heretofore accepted of $207,803.00 for 379 M December 20, 1977 street improvements to be installed and $20,528.00 for water main improvements, both exclusive of the expense'.of collection, legal, advertising, engineering, financing, interest during construction and other incidentals, and that said total cost together with such expense of collection, legal, advertising, engineering, financing, interest during ccnstr"uction and other incidentals (25% of the cost 'of such improvements) shall be assessed against the property in said district in the manner .set forth on Exhibit "A" attached hereto in accordance with the provisions of Chapter 16 of the Code of the City of Fort Collins. Section 4. That the City Council has, pursuant to notice duly mailed and published, all as provided in Chapter 16 of the Code of the City of Fort Collins, considered all complaints and objections made and filed in writing. by the owners of any real estate to be assessed or any persons interested; and the City Council further finds that all requirements of the ordinances of the City of Fort Collins respecting the organization of the district have been observed and compiled with in all respects; and it is hereby ordered that the improvements in the district as provided for in the map, plans And specifications heretofore adopted by the City Council be and they hereby are ordered to be constructed. Section 5. Upon the taking effect of this ordinance, the''Mayor is hereby authorized and empowered to advertise for bids for the construction of the improvements in accord-,' ance with the map, plans and specifications heretofore adopted,,which advertisement shall be twice published in an official newspaper published in the City. Said publications are to be at least a week apart, and the date for opening of bids shall not be less than ten (10) days after first publica- tion, and bids received under said advertisement shall be submitted to the Council for approval or rejection. Adver- tisements forbids shall comply with the requirements and be in "accordance with the provisions of Chapter 16 of the Code of the City of Fort Collins. 11 Section 6. When the improvements herein authorized have been completed and the same approved and acepted by the City of Fort Collins, the costs as set forth above shall be" assessed upon the real property in said improvement district, all as hereinbefore set forth. Section 7. Description of property specially benefited by the improvements to be installed in the district and to be assessed for the costs incurred in making said improvements: For the street improvements to be installed, all lots and lands abutting that portion of South Mason Street to be improved (between West Drake Road and West Horse - tooth Road) on the east side of said street. Council has had much material explaining what it is and what it will do. That material is attached again. The Authority would be created as a tool for the downtovm to redevelop itself. Tax increment financing would be allowed through the Authority, and it now is not allowed. Council has had a good deal of discussion about whether to call the election now for January 17th or to delay it until t1) the present downtown project is canpleted, and (2) more meetings can be held to allow downtown people to give us their thoughts. ! In conversations with Council it's clear there is strong feeling for the Development Authority and strong feeling that the downtown people should have time to ask questions, study the concept, and decide. (buntil also feels it would be desirable to wait on the election until after the present ongoing work is complete. City Attorney March spoke to his concern, primarily, that the City get this issue going in order to get it into the courts. Councilwoman Gray made a motion, seconded by Councilman Russell to table Ordinance No. 134, 1977 on first reading until January 17, 1978. Yeas: Councilmembers Bloom, Gray, Russell and Wilkinson. THE MOTION CARRIED Ordinance Denied on First Reading Rezoning the Fischer -West Prospect Property This ordinance was tabled at the November 15, 1977, City Council meeting, pending acceptance of an offer by the city to purchase the property in question. The City's offer has since been accepted, and we are recommending that the ordinance.be denied. Councilwoman Gray made a motion, seconded by Councilman Russell to deny Ordinance No. 119, 1977. Northside Community Center Project from the General Fled Contingency The attached emergency'appropriation ordinance appropriates funds for expendi- tures on these projects which will occur in 1977• The tom to be appropriated in 1977 is S907,991. , City Manager Arnold spoke --to the bids which have been received on the "solar portion (for new City Hall) which have probllemDA for The administration is recommending that the City apply a waiver of the starting time (December 26, 1977). City Attorney March also informed the Council that ;this ordinance had been presented as an emergency ordinance, however, -since there are not.five members present it could riot be passed as an emergency and would require two readings. Housing Rehabilitation Director Jim Woods responded that the jail remodeling was included in the phasing possibilities of the project. 384. Nays: Ordinance Adopted as Amended on First Reading Amending the Flood Plain Ordinance Relating to Nonconforming Use Following is the City Manager's memorandum on this item: The Housing Rehabilitation Program has been hampered because of the restrictions of the flood plain ordinance relating to nonconforming uses. Under the terms of the current ordinance, alterations cannot be made to a building in the flood plain which is nonconforming if the cost of the alterations is more than 25% of the assessed value. Assessed values for structures in the area in question are relatively low, and this restriction has prevented renovation work in several cases. The federal requirements pertaining to flood insurance are not this stringent and would allow repairs, reconstruction and improvement costing up to 50% of the market value of the structure. A letter from Robert E. Shaw, Flood Plain Manage- ment Specialist for HUD, addressing this subject is attached to this memo. In order to permit the renovation of existing structures which are currently inhabited, it appears desirable to relax the requirements of the flood plain ordinance. This would not allow construction of new structures but would only allow renovation of existing structures. City Attorney March recommended the following amendment: That after the word "chapter" in Section 2(C) that the following be added: ",provided that alterations, additions or repairs made solely to assure safe living conditions in a dwelling may be made without regard to this limitation." City Attorney March and Housing Rehabilitation Director Jim Woods r stated this area could be brought into compliance with federal regulations. Councilwoman Gray made a motion, seconded by Councilman Wilkinson to adopt Ordinance No. 149, 1977 as amended on first reading. Yeas: Councilmembers Bloom, Gray, Russell and Wilkinson. Nays: None. THE MOTION CARRIED Resolution Adopted Adopting the 1978 Pay Plan This,item was tabled on December 13, 1977; due to technical problems converting pay ranges from the present bi-monthly to a bi-weekly pay system. The problems have been corrected, and the 1978 Pay Plan provides for a 6.5% cost -of -living increase to all City.employees. Councilman Wilkinson made a motion, seconded by Councilwoman Gray to adopt the resolution. Yeas: Councilmembers Bloom, Gray, Russell and Wilkinson. Nays: None. THE MOTION -CARRIED 386 December 20, 1977 RESOLUTION 77-75 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING A REVISED EMPLOYEE PAY PLAN FOR THE CITY WHEREAS, heretofore by resolution the City Council approved a manual of class specifications and compensation plan for the municipal service of the City of Fort Collins; and WHEREAS, the Administration has reviewed the City's compensation plan and has proposed revisions to such plan to be effective January 1, 1978; and WHEREAS, such plan has been submitted by the City Manager and recom- mended by him to the City Council; and WHEREAS, the City Council has considered the same and desires to approve the revised pay plan. NOW, THEREFORE,. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the employee pay plan submitted to the City Council by the City Manager, a copy of which is attached hereto, be, and the same hereby is, approved effective January 1, 1978. Following is the City..Manager's memorandum and recommendation on this item: Original costs for increasing the capacity of the Soldier Canyon Outlet were estimated at $2,000,000,with the City's share being spread over three years as follows: 1977 - $200,000; 1978 - $850,000, and 1979 - $750,000. Bids for the work, however, were received in amounts above the original con- struction estimate. For reasons outlined in the attached menu from Roger Krempel, the bid will probably be awarded to the second law bidder resulting in the following cost breakdown: Second Iva Bid $2,338,000 Non-const. Cost 550,000 Project Cost 2,888,000 Paid to Date 200,000 Due 1978, 1979 2,688,000 his will increase the City's share of the costs to $1,103,000 in 1978 and $939,000 in 1979. The Water Board reoommends that we proceed with the project inspite of the increased cost. Council should decide whether or not the City will proceed with the project, recognizing that if we do proceed, a year end 1978 ad:ustment may be needed to increase the appropriation for this project from the present $850,000 for 1978 to $1,103,000. Sufficient surplus operating funds were transferred int the caoital accounts to cover this increased cost. PecoTanendation: The Administration recomrends that Council direct us to proceed with with the City's share estimated at $1,103,000 in 1978 and $939,000 in 1979. THE MOTION CARRIED 1 C41V December 20,. 1977 Larimer County Humane Society Contract This contract allows for the continuation of the Humane Society's ' services to the Police Department for 1978 at a cost of $25,000. Councilwoman Gray made a motion, seconded by Councilman Wilkinson to authorize the City Manager to enter into a contract with the Larimer County Humane Society for the calendar year 1978 at a cost of $25,000.00. Yeas: Councilmembers Bloom, Gray, Russell and Wilkinson. Nays: None. THE MOTION CARRIED Resolution Adopted as Amended Approving Amendments to Electric Service Rules and Regulations Following is the City Manager's memorandum and recommendation on this item: During the review of the Light and Power budget for 1978, Council requested a revision to our present policy for the extension of service to new customers. Specifically, it was requested that we initiate a cost -recovery program whereby line extension costs will be born totally by the customer requesting new or augmented electric service. The attached rules and regulations address this issue in the following way: ' 1. Starting in 1978, a contribution in aid of construction (at a 50% cost rate) will be charged for line extensions on all new or augmented, electric service. 2. Starting in 1979, a contribution in aid of construction equal to 100% of cost for line extensions will be charged. The Light and Power Department has also amended some other minor regulations to ensure clarity of interpretation as noted in the attachment. Nays: None._ THE MOTION CARRIED RESOLUTION 77-76 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING AMENDMENTS TO THE ELECTRIC SERVICE RULES AND REGULAtIONS OF THE DEPARTMENT OF MUNICIPAL UTILITIES AND AMENDMENTS TO THE ELECTRIC CONSTRUCTION POLICIES, PRACTICES AND PROCEDURES FOR THE DEPARTMENT OF MUNICIPAL PUBLIC UTILITIES WHEREAS, the ordinances of the City of Fort Collins provide for the adoption of rules and regulations applicable to electric service by the Department of Municipal Utilities upon -approval by the Council of the City of Fort Collins; and WHEREAS, heretofore the Department of Municipal Utilities submitted to the City Council certain rules and regulations for electric service and certain construction policies, practices and procedures, and the Council by resolution approved the same; and WHEREAS, the Department of Municipal Utilities has recommended certain amendments and changes in the Electric Service Rules and Regulations and Electric Construction Policies, Practices and Procedures and has submitted the same to the City Council for its approval, and in the opinion of the City Council it is in the best interests of the City of Fort Collins that such amendments be approved and adopted. December 20, 1977 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the proposed amendments to the Electric Service Rules and Regulations and the proposed amendments to the Electric Construction Policies, Practices and Procedures recom- mended by the Department of Municipal Utilities be, and the same hereby are, approved and adopted. BE IT FURTHER RESOLVED that said amendments shall from this date be in full force and effect except that the increases in consumer payments required in the amendment to the subsection entitled, "Line Extension Policy", of said Rules and Regulations be imposed at the rate of fifty percent (50%) of such increase for the calendar year beginning January 1, 1978, and one hundred percent (100) thereafter. The consideration for this Easement is $1.00. THE MOTION CARRIED Revised Replat of Fahrenbruch Leisure Village Fourth Filing P.U.D., Final Plans and Plat Approved Following is the City Manager's memorandum on this item: This is a replat of a proposal which Council reviewed in August for thirteen multi -family dwelling units in .three buildings. The original proposal called for twenty-two units in five buildings. As discussed in the next Council item, the City has negotiated for a portion of the original site for a neighborhood park, thus requiring this replat. Other than some minor revisions which are noted in the Planning mem, the replated project is acceptable. Planner 'II Paul Deibel stated there was a problem because at the present time the City doesnot have a bikeway access from Del Clair to -the park site. Councilman Wilkinson made a motion, seconded by Councilwoman Gray to approve the revision of the Replat of Fahrenbruch Leisure Village Fourth Filing P.U.D., Final Plans and Plat subject to acquisition of an easement to the park area. Approved Following is the City Manager's memorandum on this item: 410 December 20, 1977 The attached agreement provides for the purchase of approximately :9.acnes: in the area known as Fahrenbruch Leisure Village for purposes as a neighbor- hood park. This agreement stems from Council's direction to purchase the site as a result of reviewing in August a preliminary plan for a 5-building, 22-unit project on the site. The terms of the contract provide for a purchase price of $27,000 and a $500 payment for architectural redesign of the existing site plan. The 1977 revised parkland budget contains $27,500 for purchase of this site. Councilwoman Gray made a motion, seconded by Councilman Russell that Council approve the agreement authorizing the purchase of the Park subject to obtaining a bikeway access and authorize the administration to close. THE MOTION CARRIED Wildwood Subdivision, First Filing Final Plat, Approved This final plat covers the first phase of a 64 single-family subdivision located on West Lake Street east of Overland Trail. Also included in this plat are 18 single-family units. Councilman Wilkinson made a motion, seconded by Councilwoman Gray to approve the final plat for Wildwood Subdivision, First Filing subject to the signature of the developer on the utility agreement. THE MOTION CARRIED Overland Trail Farm Subdivision Final Plat Approved Thissubdivision consists of 67 single-family lots on 31.9 acres and includes a 10-acre park. The site is zoned R-L, Low Density Residential District, and is located on Overland Trail north of West Prospect Street. Councilman Russell inquired into the sewer service to the area. Water and Sewer Utilities Director Roger Krempel responded to the specific question on participation for extending relief sewer. 411 December 20, 1977 Councilman Wilkinson made a motion, seconded by. THE MOTION CARRIED Other Business A. Purchase of Additional Shares of Water Supply and Storage Company Approved Following is the City Manager's memorandum and recommendation on this item: The City entered into an agreement with Water Supply and Storage Company several years ago, anticipating City ownership of some Water Supply stock and providing the means for utilizing the water represented by that stock in the City water utility. Under that agreement, Water Supply will release the water represented by the City's stock to the City through Chambers Lake or similar facilities which can deliver to the Poudre River above the City's No. l.plant. This is particularly valuable to the City because it provides a source of water for times when the river is too low to meet the demands of the City. Also some.waters developed by Water Supply and Storage Company are foreign waters which open up reuse possibilities. This agreement with Water Supply is limited to 15 shares of stock. This does not mean that the City cannot acquire more shares but Water Supply would not be obligated to work with the City for more than that amount of water. 412 I December 20, 1977 The City has received an offer to sell four shares of Water -Supply stock.- Under this offer the City would issue water certificates similar to the Josh Ames certificates.in exchange for the Water Supply stock. Each certificate would be .accepted by the City in satisfaction of the City's water requirements for one-third of an acre of land. Water Supply and Storage Company stock yields 107 acre-feet of water annually on the average and, therefore, 107 such certificates would be issued for.each share of Water Supply stock (present City water requirement is three acre-feet to the acre). This proposal appears advantageous to the City since the City would not need to invest any cash at this time. In effects the City would pay for the Water Supply stock as the certificates were turned in in satisfaction of the City's water requirement. Council will recall that nine shares of'the 15 have already been purchased and that each share is worth something in the neighborhood of $80,000. (Another one -plus share is in the works.) So this proposal is very sound in terms of value. This proposal has been presented to the Water Board and the Water Board has unanimously recommended that the City accept the proposal. The attached agreement would.accomplish this and has been approved by the City Attorney. Recommendation: Administration recommends that the City Council approve the proposed agreement for the acquisition of four shares of the common stock of the Water Supply and Storage Company, authorize the City Manager and City Clerk to execute the agreement on behalf of the City, and further authorize the City Administration to issue. the water certifi- cates provided for in the agreement and to complete and close the purchase. Water Quality Report City Attorney March stated for the record that the City has a law suit in progress which involves the Water Quality Control Commission and the Enforcement Division under that Commission. Negotiations have been made and a proposal has been prepared; it is his understanding that Council has authorized him to proceed with the proposed settlement. C. Bids Awarded for 32 Benches at Planter Walls - Central Area Beautification Following is a memorandum from the Downtown Project Director on this item: "EDAW designed the above captioned benches and recommended we budget $17,600 for construction. The subsequent bid process produced a bid of $36,000,00. When we questioned the contractor why his bid was so high, he cited what he considered unreasonable EDAW specifications. First, the wall bench timbers had to be manufactured here and then shipped away for impregnation; second, he said the freestanding benches were too intricately detailed. Subsequently Mr. Ferluga and Mr. Roesser contacted a local carpentry firm who designed and built a prototype of each bench. It is this revised part of designs that came in for $24,500.50. Attached herewith is a map depicting location of the freestanding benches. The Council has the option of eliminating all or some of the freestanding benches. On the .other hand, slots have already been placed in the concrete planter walls for the wall benches, therefore, there would be no option on the latter." Councilman Russell inquired into the proposed bench locations and what was happening to the benches which have been offered to merchants which would provide for advertising. City Manager Arnold stated he would investigate the questions and recommended the City perhaps purchase two additional benches to provide for bus pickup. Councilman Wilkinson made a motion, seconded by Councilwoman Gray Ell to approve the purchases and award the bid to is Manufacturing Company. Yeas: Councilmembers Bloom, Gray, Russell and Wilkinson. City Attorney Authorized to Enter an Appearance on Behalf of Citv City Attorney March requested authority to enter an appearance on behalf of the City in a case brought by Frontier Tractor and Equipment Inc. against the City, Western Paving Concrete and Balboa Insurance Company. Councilwoman Gray made a motion, seconded by Councilman Russell to authorize the City Attorney to enter an appearance on behalf of the City in the above named suit.
