Roll call was answered by the following Councilmembers: Bowling, Gray, Reeves, Wilkinson and Wilmarth. Absent: Councilmembers Kross and St. Croix. Staff Members Present: Arnold, Wood, Deagle, Kremoel, Rupel, Bingman, Mabry, Liley and Lewis. Ordinance Denied on Second Reading Creatinq a Street-Oversizinq Fund. Ordinance Denied on Second Reading Relating to the City's Participation In the Oversizinq of Certain Streets. Ordinance Denied on Second Reading Creating a Street Oversizina Fund. Following is the City Manager's memorandum on these items. Staff recommends denial of Ordinance No. 95, 96, and 97 on Second Reading. Councilman Wilkinson made a motion, seconded by Councilwoman Reeves to deny Ordinance No. 95, 1979, Ordinance No. 96, 1979 and Ordinance No. 97, 1979 on Second Reading. YEAS: Councilmembers. Bowling, Gray, Reeves, Wilkinson and Wilmarth. NAYS: None THE MOTION CARRIED. - 134 - September 11, 1979 Ordinance Adopted as Amended As An Emergency Ordinance Creating a Street Oversizinq Fund. City Attorney Liley recommended an amendment to the Ordinance to strike the phrase, "with the City of Fort Collins", in Section 95 - 86. Councilwoman Reeves made a motion, seconded by Councilwoman Gray, to amend the Ordinance as recommended by the City Attorney. YEAS: Councilmembers Bowling, Gray, Reeves, Wilkinson, Wilmarth. NAYS: None THE MOTION CARRIED. Councilman Wilkinson addressed what he felt were inequities in the Ordinances in the commercial areas. Public Works Director Roger Krempel, responded to Council inquiries and distributed the following Modified Computation, for Commercial Areas. Shopping Center _ 1,000 = Factor of 20.9 Residential 47.8 This calculation gives sore indication of 'relative traffic generation between the average acre of residential develclament compared to a shcppLng area. ' A conservative factor of 4 was used to develop the street oversizing fee, as the relative factor of residential traffic generation compared to com- me-rcial. We would not recorrznd using a factor any less than that. Fees for collector oversizing: Commercial = 1734,34 12 = $ 144.53/Acre Residential = 44,514.86 2400 = $ 18.55/Dwelling Unit III. Total Fee A. Residential = $205.67 + $18.55 . = $ 224.22 B. Commercial = $1,602.66 + $144.53 = $ 1,747.19 IV. Analysis Based Upon Trip Ends "Trip Ends" are a measure of traffic generation; a "trip end" is a one- way trip which either begins or ends at a point_ For example, the n=ber, of residential trip ends for the typical square mile is calculated as follows: Single-family dwelling averages 9.5 Trip Ends/D,,elling Unit Multi -family dwelling averages 5.9 Trip Ends/IIaelling Unit j - 136 - September 11, 1979 V. It is recommended that further analysis of the commercial fee be done over the next several months if the fee proposal is adopted. This additional analysis based upon experience with the fee could then be presented to the Council and might help to -ensure that the commercial portion of the fee is equitable. Councilman Wilkinson made a motion, seconded by Councilwoman Gray, to amend Ordinance No. 112, 1979, by deleting the figure $215.00 in Section 95-88 (A) and substituting the figure $221.00, and by deleting the figure $3,495.00 and substituting the figure $2,000.`00 in Section 95-88 (B). YEAS: Councilmembers Boyling, Gray, Reeves, Wilkinson. FLAYS: Councilman Wilmarth. THE MOTION CARRIED. Councilmembers requested that the staff review the fees and make a recommendation on adjustment of the fees within 30 to 90 days. Councilwoman Gray made a motion, seconded by Councilwoman Reeves, to adopt Ordinance No. 112, 1979, as amended as an Emergency Ordinance. YEAS: Councilmembers Bowling, Gray, Reeves, Wilkinson, Wilmarth NAYS: None. THE MOTION CARRIED. Ordinance Adopted as an Emergency Ordinance Amending the Code Relating to the City's Participation in the Oversizing of Certain Streets. Councilwoman Reeves made a motion, seconded by Councilman Wilkinson, to adopt Ordinance No. 113, 1979, as an Emergency Ordinance. YEAS: Councilmembers Bowling, Gray, Reeves, Wilkinson, Wilmarth. NAYS: None. THE MOTION CARRIED. 1 I - 137 - September 11, 1979 Ordinance Adopted as an Emergency Ordinance Amending the Code as it Relates to the Payment by -the City of Costs Associated with Oversizing of Streets: Councilwoman Reeves made a motion, seconded by Councilwoman Gray, to adopt Ordinance 114, 1979, as an Emergency Ordinance. YEAS: Councilmembers Bowling, Gray, Reeves, Wilkinson and Wilmarth. NAYS: None. THE MOTION CARRIED. Other Business a. Mr. Tim McCully of the New Age Energy Fair, reported that an Energy Symposium would be held on September 22, and 23, and requested that Mayor Bowling make opening remarks, and re- quested that Councilmembers attend. b. Attorney Daniel W. Dean, 300 South Howes, representing approx- imately 35% of the roofing firms in Fort Collins, called Council's attention to perceived hardship being imposed on the roofing contractors by the Building Inspection Department. After hearing the presentation Council referred this matter to Planning and Development Director, Charles Mabry and Chief Building Inspector Bill Waldo, with instruction to report on the meeting prior to 3:00 p.m. Adjournment The meeting adjourned at 2:00 p.m. - 138 -
