OF THE
COUNCIL OF THE CITY OF FORT COLLINS
February 23, 1988
6:00 P.M.
An adjourned meeting of the Council of the City of Fort Collins was held on
Tuesday, February 23, 1988 at 6:00 p.m. in the Council Information Center
in the City of Fort Collins City Hall. Roll call was answered by the
following Councilmembers: Estrada, Horak, Kirkpatrick, Mabry, Maxey,
Stoner, and Winokur.
Staff Members Present: Burkett, Huisjen, Krajicek
Executive Session Authorized
Councilmember Stoner made a motion, seconded by Councilmember Mabry, to
adjourn into Executive Session for the purpose of discussing water -related
legal matters.
Councilmember Stoner indicated he is the listing agent for one of
Excalibur's principals for property unrelated to this water issue, and
stated he did not believe that association constituted a conflict of
interest.
Councilmember Horak stated he did not feel the issue was framed well enough
to adjourn into Executive Session. He expressed concern that the
information presented be new information rather than continued discussion
of information Council received at an earlier date.
City Manager Burkett stated staff did not believe the details of this
particular legal matter should be put in writing or discussed in open
session. He stated staff's intent was to apprise Council of the issues,
how much money may be at stake, what the risks are, and the legal strategy
involved, including the potential for settlement of the lawsuit.
The vote on Councilmember Stoner's motion to adjourn into Executive Session
was as follows: Yeas: Councilmembers Estrada, Kirkpatrick, Mabry, Maxey,
Stoner, and Winokur. Nays: Councilmember Horak.
THE MOTION CARRIED.
Adjournment
At the conclusion of the Executive Session, Councilmember Stoner made a
motion, seconded by Councilmember Kirkpatrick, to adjourn the meeting.

Winokur. Nays: None.
The meeting adjourned at 7:35 p.m.
