HomeMy WebLinkAboutMINUTES-12/13/1983-AdjournediADJOURNED MEETING OF THE COUNCIL OF THE CITY OF FORT COLLINS, COLORADO December 13, 1983 3:00 p.m. An adjourned meeting of the Council of the City of Fort Collins was held on Tuesday, December 13, 1983, at 3:00 p.m. in the Council Chambers in the City of Fort Collins City Hall. Roll call was answered by the following Council members: Horak, Knezovich, Ohlson, Rutstein, and Stoner. Secretary's Note: Councilmember Clarke arrived at 3:10 p.m. and Council - member Elliott arrived at 5:45 p.m. Staff Members Present: Arnold, Huisjen Krajicek, Lewis Executive Session Authorized ' Councilmember Ohlson made a motion, seconded by Councilmember Rutstein, to adjourn into Executive Session for the purpose of discussing personnel matters pertaining to the salaries of the City Attorney, City Manager, and Municipal Judge. Yeas: Councilmembers Horak, Knezovich, Ohlson, Rutstein, and Stoner. Nays: None. THE MOTION CARRIED. At the conclusion of the Executive Session, Councilmember Ohlson made a motion, seconded by Councilmember Rutstein, to further adjourn the meeting to 7:30 p.m. this same date. Mayor Knezovich reconvened the adjourned meeting at 7:30 p.m. Public Hearing on Anheuser-Busch Air Quality Permit Application EQUATAC spokesperson Dr. Tom McKee introduced the other members of the Committee and gave a summary of their findings. He reviewed the technical findings and presented the Committee's recommendations to Council. Bill Bernardo, EPA representative, noted his agency was charged with enforcing the Prevention of Significant Deterioration (psd) rules and ' regulations. He noted statements on visibility or other associated impacts -191- 1 Adjourned Meeting December 13, 1983 were not required for the permit at this time. The issue was addressed in the permit application. He added that the visibility impact from this facility appeared to be extremely limited. He stated the opacity limita- tions from the stack will be, at the most, 10% which is quite small. He explained that EPA required a visibility analysis by performing a screening analysis to determine the impact. The procedure is a simple equation and if the impact is not very large, the process is over and the facility passes. He added that is what had happened in this case. Tom Testanek, Public Health Engineer for the State of Colorado, spoke about how the projected A-B emissions compared with other sources in Colorado. He stated more information would be available soon. Dave Stewart, EQUATAC Committee member, spoke about the proposed Colorado standards for psd. He noted the difference between actual emissions and the permitted amounts on an application. The following persons spoke at this hearing: 1. Lyle Rodd, 901 Remington, asked about the evolution of emission , standards in past years and the fairness of their enforcement. 2. Hal Feltey, 1112 West Oak, asked about odors associated with the plant. 3. Tim Johnson, 2939 Brookwood Place, bio-chemist at CSU, Chairman of the Sierra Club, asked questions about plant emissions with regard to the worst case scenario. 4. Dean Push, Radion Corporation, spoke of the accuracy of the modeling information done by his firm. 5. Chris Johnson, 1850 Laporte Avenue, spoke of the visibility studies done and questioned whether there would be regional visibility degradation due to sulfur dioxide emitted by the plant. 6. Dan Gould, 623 West Mountain, asked about the concentration levels Of S02 at which there are detectable effects in humans after 10-60 minutes of exposure and after periods of longer exposure. 7. Dave Erickson, 924 West Oak, asked about the predominant wind direction at the plant site, noting the pollutants would travel in that direction. , -192- Adjourned Meeting December 13, 1983 8. Karen Denbraven, 924 West Oak, asked about the ambient emission concentrations and if the figures included the background concen- trations. 9. Tom Clark, Chamber of Commerce, expressed appreciation to the EQUATAC Committee for their efforts in preparing their report. 10. Steve Zary, 618 Remington, asked about the experimental design plans and also the type of equipment used for the ambient monitor- ing. 11. Jim Kaner, 420 Remington, asked about the inversion problem experienced in Fort Collins on a daily basis. 12. Rayland Rutman, 1516 Wagontongue, expressed concern about the particulates emitted and asked how they might be measured. Mayor Knezovich declared the hearing to be closed at 10:10 p.m. Ordinances Relating to the Salaries of the City Attorney, City Manager, and Municipal Judge Following is the staff's memorandum on this item: A. Hearing and First Reading of Ordinance No. 163, 1983, Fixing the Salary of the City Attorney. B. Hearing and First Reading of Ordinance No. 164, 1983, Fixing the Salary of the City Manager. C. Hearing and First Reading of Ordinance No. 165, 1983, Fixing the Salary of the Municipal Judge. City Council has met in Executive Session to perform the annual evaluations of the City Attorney;_ City Manager., and Municipal Judge. These three ordinances will establish the 1984 salaries for these three individuals. Council needs to determine the dollar amount to be inserted in the blanks in each ordinance." Councilmember Clarke made a motion, seconded by Councilmember Stoner, to adopt Ordinance No. 163, 1983 on First Reading inserting the words and figures $45,500 as the 1984 salary of the City Attorney. Yeas: Council - members Clarke, Elliott, Knezovich, Ohlson, Rutstein, and Stoner. Nays: None. Abstain: Councilmember Horak. --193- Adjourned Meeting December 13, 1983 THE MOTION CARRIED. Councilmember Ohlson made a motion, seconded by Councilmember Stoner, to adopt Ordinance No. 164, 1983 on First Reading inserting the words and figures $67,500 as the 1984 salary of the City Manager and adding a new Section 2 stating "that the contractual arrangements between the City Manager and the City of Fort Collins be updated and that it include a statement providing for a period of sabbatical training during 1984" and renumbering the current Section 2 and Section 3. Yeas: Councilmembers Clarke, Elliott, Horak, Knezovich, Ohlson, Rutstein, and Stoner. Nays: None. THE MOTION CARRIED. Councilmember Clarke made a motion, seconded by Councilmember Stoner, to adopt Ordinance No. 165, 1983 on First Reading inserting the words and figures $43,900 as the 1984 salary of the Municipal Judge. Yeas: Council - members Clarke, Elliott, Horak, Knezovich, Ohlson, Rutstein, and Stoner. Nays: None. , THE MOTION CARRIED. Adjournment Councilmember Clarke made a motion, seconded by Councilmember Rutstein, to adjourn the meeting. Yeas: Councilmembers Clarke, Elliott, Horak, Knezo- vich, Ohlson, Rutstein, and Stoner.
