An adjourned meeting of the Council of the City of Fort Collins was held on
Tuesday, November 10, 1992, at 5:30 p:m. in the Council Chambers in the City of
Fort Collins City Hall. Roll call was answered by the following Councilmembers:
Azari, Edwards, Horak, Kirkpatrick, Maxey and Winokur.
Councilmembers Absent: Councilmember Fromme.
Staff Members Present: Krajicek
Councilmember Azari made a motion, seconded by Councilmember Edwards, to adjourn
into Executive Session for the purpose of conducting the annual performance
review of the Municipal Judge.
Councilmember Horak questioned why the meeting was not being televised and noted
he believed staff should follow the process used for regular meetings and
worksessions unless directed otherwise. He questioned why the City Manager and
City Attorney were not present and why the evaluation of the Municipal Judge
could not be conducted in public since the materials supplied by the Judge were
not marked "Confidential".
Mayor Kirkpatrick replied that materials and information received from outside
sources relating to the evaluations of the City Manager, City Attorney, and the
Municipal Judge should be kept confidential.
Councilmember Horak asked to go on record as objecting to the Executive Session
since most citizens do not know who the Judge is or what the Judge does and this
would be an opportunity for the public, to learn about the person and the
position.
Municipal Judge Kathleen Allin noted she believed her evaluation should not be
held in public and commented that most employees would prefer that their
performance appraisals not be held in public and televised.
Councilmember Horak stated he would like the City Attorney's opinion on 'the
confidentiality of the materials received from outside sources.
The vote on Councilmember Azari's motion was as follows: Yeas: Councilmembers
Azari, Edwards, Kirkpatrick, Maxey and Winokur.' Nays: Councilmember Horak.
