College Ave. PO Box 580 Fort Collins, CO 80522 970.416.2350 970.224.6134 FAX www.fcgov.com MEMORANDUM Date: March 3, 2023 To: Mayor Arndt and City Councilmembers Through: Kelly DiMartino, City Manager Tyler Marr, Deputy City Manager Caryn Champine, Director of Planning, Development, and Transportation From: Marcy Yoder, Neighborhood Services Manager Meaghan Overton, Housing Manager Re: February 28, 2023 Work Session Summary – Scaled Options for Rental Housing and Inspection Program At the February 28 Work Session, staff outlined potential scaled options for Council’s consideration of a Rental Housing Program. Staff presented three options. Option 1 proposed rental registration with an improved complaint-based inspection process. Option 2 proposed rental registration with delayed proactive inspections. Option 3 proposed rental registration with proactive inspections. The staff presentation was provided by Caryn Champine, Marcy Yoder, and Meaghan Overton. Mayor Arndt was absent; all other Councilmembers were in attendance. Summary of Feedback Council discussed the options proposed, with most Councilmembers expressing support for Option 2, rental registration with delayed proactive inspections. Common themes in the discussion included: Support for additional mediation of landlord-tenant disputes. A desire to work toward compliance and concern that landlords may need time to complete some required work. Staff clarified that if a property owner is in communication with staff and making progress toward compliance, extensions to the compliance timeline are regularly granted. Support for a “ramp up” period between registration and proactive inspections to collect data and conduct education and outreach activities. A concern about whether third party inspections would use the same habitability standards as proposed. Staff confirmed that this is the intent of requesting copies of third-party inspections. Continuing support for data collection, as well as software and database improvements. Emphasis on ensuring clear and predictable inspection of habitability standards, as well as emphasis on creating a clear, realistic mitigation and compliance process. In conjunction, staff will also advance a request for an appropriation of approximately 1,100,000 for first reading to cover start-up costs of the Rental Housing Program.
