AsherHaun,ownerofHandHProperties,thesubjectpropertyownerandappellantprovidedinformationabouthisacquisitionandownershipoftheproperty.Aspartoftheinformationprovided,heincludeddetailsonthelossestherestaurantsustainedunderhisownershipevenwhileheundertooksubstantialupdatingofthefacilitywiththeintentiontocontinueoperations.JeffCullers,attorneyforHandHProperties,presentedassetforthinhisslidedeckinsupportoftheappeal.HispresentationincludeddetailsonHandHProperties,LLC’sownershipofthesite,renovationsdone,andobjectionstothesignificancefindingsoftheHistoricPreservationCommission.MarkKroneberger,ownerofNorthCollegeMotors,spokeinsupportoftheappeal.HenotedFrankPerez,asthepriorownerofthebusiness,hadattemptedtosellthepropertyformorethan15yearsandwouldnothavesupportedthisactionbecauseofitsimpactonhisabilitytomarketandselltheproperty.PRESENTATIONBYPARTIESININTERESTOPPOSEDTOTHEAPPEALMayorArndtinvitedthoseopposedtotheappealtomaketheirpresentationagainsttheappeal.MonicaBirdcameforwardandrequestedtoprovidetheCouncilwithwrittenmaterialsthatincludesupportinginformationforherremarks.CityAttorneyDaggettnotedthematerialshadbeenreviewedbyherofficeandadeterminationwasmadenewevidencewasincluded.Becauseofthis,sheindicatedtheCouncilwouldneedtomakeadeterminationregardingallowingnewevidenceoutsideofthenormalparametersallowedundertheappealprocess.MayorArndtrulednewevidencewouldnotbepermitted.MonicaBird,daughterofFrankPerez,spokeagainsttheappealandinsupportofthedeterminationofeligibilityforthisproperty,providinginformationaboutthelifestoryofFrankPerezandhisjourneyasaMexicanimmigranttoFortCollins,aspartofthelargercontextforMexicanimmigrationtothecommunityandresultingstrugglesinestablishinglivelihoods,includingstartingbusinesses.MaryPerezspokeagainsttheappealandinsupportofthedeterminationofeligibilityforthisproperty.Sheprovidedinformationaboutherhusband,FrankPerez,andhislifehistoryandworkestablishingthebusinessatthesubjectproperty.AmeliaPerez,daughterofFrankPerez,spokeagainsttheappealandinsupportofthedeterminationofeligibilityforthisproperty,notingherniecestillowns5%ofthebusinessandnonoticewasprovidedtoheroranyotherfamilymembersabouttheintentiontoclosedownthebusinessandsellthesite.APPELLANTREBUTTALJeffCullersrequestedallnewevidencepresentedorallybestruck.CityAttorneyDaggettnotedtheobjectionwouldbenotedfortherecord,includingspecificallythefollowinginformationprovidedduringcommentsfromthoseopposedtotheappeal:•FrankPerez’sinvolvementwithHolyFamilyChurchgenerally,•FrankPerez’sinvolvementinChurchfundraisersatHolyFamilyChurch.and•OwnershipinformationaboutElBurritorestaurantinFortCollins.Hisrebuttalcontinued,notinghistoriclandmarkingcanbeagreatthingbutcanalsobeabused.Heindicatedabeliefthereisapersonalconflictinvolvedinthissituation,referencingquotesattributedtoMonicaBirdregardingtheclosureinnewscoverageintheColoradoan.Inresponsetosomeoftheassertionsmadebythoseopposedtotheappeal,heindicatedtherewasevidencepresentedCityofFortCollinsPage305CityCouncilProceedings
