RECOMMENDATION Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY Timberline Star Properties, LLC has requested a revocable permit for the installation of a City sanitary sewer line 8 inches in diameter on City Light and Power property. City staff has reviewed the plans and specifications for this improvement and has concluded that the improvement will not result in adverse impact to the City owned property. Timberline Star Properties, LLC will be responsible for acquiring all required easements from any affected adjacent property owner(s) . Said sanitary sewer line shall, upon the completion of installation and acceptance by the City, be dedicated to the City for public use. At such time that Timberline Road is widened, the 8" sanitary sewer line will be within the Timberline Road right-of-way. RESOLUTION 2005-015 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING A REVOCABLE PERMIT ON PROPERTY OWNED BY THE CITY FOR INSTALLATION OF AN 8" SANITARY SEWER LINE WHEREAS, Timberline Star Properties, LLC has requested that the City authorize the installation of an 8" sanitary sewer line on property owned by the City located West of the existing Timberline Road right-of-way and South of Prospect Road more specifically described in Exhibit "A", attached hereto and incorporated herein by this reference (hereinafter referred to as the"Permit Area"); and WHEREAS, Timberline Star Properties' use of the Permit Area will allow Timberline Star Properties, LLC to install an 8" sanitary sewer line which, upon completion and acceptance by the City, shall be dedicated to the City for public use; and WHEREAS, City staff has reviewed the request to install the above-described improvements in the Permit Area, and believes that said installation will not interfere with or adversely affect the City owned property, based on current expectations; and WHEREAS, the detailed plans for construction, including backfill and restoration of the Permit Area upon completion of work by Timberline Star Properties, LLC and the work itself, shall be subject to review and approval by City staff in order to ensure that no adverse impacts to the affected City owned property will result; and WHEREAS, as a condition of granting the revocable permit, Timberline Star Properties, LLC will be required to secure any additional easements required from adjacent property owners for permanent operation and maintenance by the City of the sanitary sewer line; and WHEREAS, Article XI, Section 10, of the Charter of the City of Fort Collins authorizes the Council to permit the use of occupation of any street, alley, or public place, provided that such permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is expressly reserved in such permit. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to execute such documents as are necessary to grant a revocable permit to Timberline Star Properties, LLC consistent with the terms of this Resolution and including such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary or appropriate to protect the interests of the City or effectuate the purposes of this Resolution. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 15th day of February, A.D. 2005.
