EXECUTIVE SUMMARY This Ordinance, unanimously adopted on Second Reading on July 21, 2020, appropriates $75,200 in philanthropic revenue in the General Fund for transfer to Park Planning & Development. The funds represent cumulative giving from multiple donors and the gifts are designated by the donors for the stated support of the 9/11 Memorial Park. EXECUTIVE SUMMARY The purpose of this item is to appropriate $75,200 in philanthropic revenue in the General Fund for transfer to Park Planning & Development. The funds represent cumulative giving from multiple donors and the gifts are designated by the donors for the stated support of the 9/11 Memorial Park. STAFF RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. BACKGROUND / DISCUSSION The 9/11 Memorial Park will be an open-air, community park to honor the events of September 11, 2001. Symbolism and history will serve as a backdrop for a World Trade Center artifact to create a living memorial and to provide visitors ample opportunity for reflection. A collaboration between Poudre Fire Authority and the City, the 9/11 Memorial will be located adjacent to PFA’s Station 3 at Spring Creek Park in Midtown Fort Collins. The community park is a garden destination and will have three entrances: one from the north parking lot, one from the Spring Creek Trail, and one from the sidewalk south of the fire station. As the centerpiece of the park, a 5-foot-long, 3,059-pound steel I-beam from the World Trade Center site will rest above three pools of cascading water surrounded with angular seating blocks, reminiscent of “the pile” from which the steel was recovered. Displays will educate visitors on the events of 9/11, challenges faced by first responders and the story of how the beam travelled from New York to Fort Collins. The 9/11 Memorial Park will be the only site of a World Trade Center artifact in Northern Colorado. CITY FINANCIAL IMPACTS This Ordinance will appropriate $75,200 of unanticipated philanthropic revenue which will be used to fully develop construction plans, determine a final capital budget, and a capital campaign for the 9/11 Memorial Park which will be fully funded by charitable support. The revenue is being appropriated into the General Fund for transfer to 9/11 Memorial Park, Park Planning & Development. The funds have been received and accepted per City Give Administrative and Financial Policy. ATTACHMENT 1 -1- ORDINANCE NO. 087, 2020 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED PHILANTHROPIC REVENUE RECEIVED BY CITY GIVE FOR THE POUDRE FIRE AUTHORITY AND CITY JOINT PROJECT TO CONSTRUCT THE 9/11 MEMORIAL PARK WHEREAS, the City and Poudre Fire Authority (“PFA”) are collaborating to develop the 9/11 Memorial Park next to PFA’s Station 3 at Spring Creek Park; and WHEREAS, the proposed park would feature a steel I-beam from the World Trade Center site, three pools of cascading water, angular seating blocks and displays to educate visitors about the events of September 11, 2001, the challenges faced by first responders, and the story of how the beam got from New York to Fort Collins; and WHEREAS, multiple donors have provided a total of $75,200 to support the 9/11 Memorial Park, and this Ordinance would appropriate those funds for use by Park Planning and Development to fully develop construction plans and determine a final capital budget for the project, and to support a capital campaign for the Park, which will be funded entirely by charitable support; and WHEREAS, this appropriation benefits public health, safety and welfare of the residents of Fort Collins and serves the public purpose of developing a public memorial park for reflection and education of residents and visitors; and WHEREAS, Article V, Section 9, of the City Charter permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, the City Manager has recommended the appropriation described herein and determined that these appropriations are available and previously unappropriated from the General Fund and will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in these funds during the fiscal year; and WHEREAS, Article V, Section 10, of the City Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered appropriated amount or portion thereof from one fund or capital project account to another fund or capital project account, provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, the City Manager has recommended the transfer described herein and determined that the purpose for which the transferred funds are to be expended remains unchanged. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: -2- Section 1. That the City Council hereby makes and adopts the determinations and findings contained in the recitals set forth above. Section 2. That there is hereby appropriated from unanticipated philanthropic revenue in the General Fund the sum of SEVENTY-FIVE THOUSAND TWO HUNDRED DOLLARS ($75,200) for transfer to the Capital Projects Fund and appropriated therein for the 9/11 Memorial Park Project.
