SUBJECT
First Reading of Ordinance No. 106, 2020, Authorizing the Acquisition by Eminent Domain Proceedings of
Certain Lands Necessary to Construct Public Improvements for the Timberline Capital Improvement Project -
Stetson Creek Road to Trilby Road.
EXECUTIVE SUMMARY
The purpose of this item is to request Council to authorize the use of eminent domain, if deemed necessary, to
acquire property interests needed for construction improvements for the Project.
STAFF RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
BACKGROUND / DISCUSSION
Timberline Road is a major thoroughfare for Fort Collins residents, and serves as a significant regional
connection for Northern Colorado communities. This area has undergone significant development in the last
decade and the existing two-lane road infrastructure in the area has reached capacity and experiences
significant congestion that needs to be addressed to enhance vehicular safety along the corridor. Timberline
Road is identified as a 4-lane arterial road on the Master Street Plan. Completing this project will enhance
safety by completing bike and pedestrian connections through the corridor while improving overall safety,
capacity, and mobility.
Design of the roadway and sidewalks is currently underway. Roadway improvements are anticipated to include
widening the roadway to a four-lane complete street section with median, sidewalks, and bicycle facilities and
is tentatively scheduled for construction in the spring of 2021.
To construct the improvements, the City will need to acquire certain property interests. The acquisitions include
right-of-way, permanent easements, and temporary easements from eighteen property owners. Since the
Project is partially funded by federal grants, aspects of the Project, including property acquisitions, must
comply with procedures for federally-funded projects. The acquisitions for this Project will conform to the
provisions of the Uniform Relocation Assistance and Real Property Acquisitions Policies Act of 1970 as
Amended (Public Law 91-646). In accordance with these regulations, the City must inform property owners
about the possible use of eminent domain and their rights pursuant to Colorado statute in an official Notice of
Intent Letter. The authorization from Council is needed prior to sending this information to property owners.
The Notice of Intent Letter is the first official step in the acquisition phase and happens prior to the appraisals.
Staff intends to negotiate in good faith with the affected owners and is optimistic that all property negotiations

can be completed prior to the start of the Project. Staff is requesting authorization to use eminent domain for all
property acquisitions for the Project, to be used only if such action is deemed necessary.
Staff has begun meeting with the affected property owners to discuss the Project and the impacts to their
property. At those meetings, the property owners were notified that staff would be requesting authorization to
use eminent domain to acquire necessary property interests, if needed. Staff received no objections from
property owners to this proposed request. Affected property owners were notified by certified mail of this
request to Council for authorization to use eminent domain prior to the First Reading of this Ordinance.
How and When City Staff Uses Eminent Domain
When staff is planning a project, they consider the amount of land required and whether they will need to
acquire private property even if an agreement with the property owner to purchase the land is not reached. If
an acquisition is necessary, staff requests Council to authorize the use eminent domain (condemnation) if
necessary. Once an ordinance is adopted the team continues to coordinate with impacted property owners to
finalize the project plans. Once plans are finalized, the City sends the property owner a Notice of Intent to
Acquire letter by certified mail. The letter explains what the City needs for the project. Then the City, and
sometimes the property owner, get appraisal of the property to determine its fair market value. The City then
makes the owner an offer for the property needed based on fair market value. The City and the property owner
negotiate to reach an agreement to buy the needed property interests. If an agreement cannot be reached, the
City may file an eminent domain case in court, if necessary. The court then decides what the City must pay for
the property it needs. In most cases, the City and the property owner reach agreement before a case gets to
that point.
Staff recommends that Council authorize the use of eminent domain for this project to provide a fair and
equitable process that will allow the City to meet project design and construction deadlines while still ensuring
all property owners are fairly compensated for the property rights acquired by the City. Condemnation will only
be used as necessary if the City is unable to reach an agreement with a property owner through good-faith
negotiations.
Obtaining eminent domain authority early in the project will:
• Allow staff to develop the project timeline with more certainty.
• Help keep a planned property acquisition schedule, reducing the risk and cost of unexpected future delays.
• Ensure consistent messaging to affected property owners.
CITY FINANCIAL IMPACTS
This action will not authorize any new funding for the project but will only authorize acquisition of the identified
parcels. Additional Colorado Department of Transportation (CDOT) grant funding is anticipated, and staff will
bring this grant funding before Council for approval and appropriation upon receipt of an award letter. As
development continues to move forward along the corridor, additional Transportation Capital Expansion Fee
dollars are anticipated to be brought before Council for appropriation.
BOARD / COMMISSION RECOMMENDATION
City staff has presented the project to the Transportation Board and Bicycle Advisory Committee during
proceedings in June. (Attachment 2 and 3)
PUBLIC OUTREACH
City staff has developed a comprehensive Communication Plan to reach residents, property owners, business
owners, and other stakeholders. Current outreach efforts have included meetings with impacted property
owners, neighborhood meetings, and a detailed project website. Future efforts will include additional property
owner meetings and public open house meetings.

7. NEW BUSINESS
a. Timberline Widening Project Update – Nicole Hahn
Nicole Hahn, Engineering Department Manager for the Timberline Widening Project,
outlined the project area, current conditions, and project goals. She noted there are
higher than expected crashes in the area due to existing congestion.
Hahn stated the project is currently in the preliminary design phase and initial
meetings with property owners have occurred. She noted there has been a need for
a great deal of right-of-way acquisition and stated construction is slated for spring of
2021.
Hahn outlined the design alternative process and discussed the planned grade-
separated crossing and trail connection. Members discussed certain options for
signalization. Rachline encouraged the consideration of pedestrian and bicyclist
safety. Hahn discussed the proposed design for sidewalks and bike lanes.
Hahn discussed the necessary tree removal and mitigation plan and detailed
proposed cross section designs.
Gavaldon requested information regarding project cost. Hahn replied the project
budget is about $5.3 million as is, or $6.2 million including the Hansen Farms portion.
She stated she would send more detailed information regarding the budget to
Boardmembers.
York asked if any of the funding is at risk given COVID. Hahn replied the City's
budget has yet to be passed; however, this is a federally funded project so it is likely
to continue as is.
York asked about the cost of a grade-separated crossing at the Mail Creek Ditch.
Hahn replied that cost would be about $900,000.
Chair Hart commended the project.

4. CITIZEN PARTICIPATION
Kenny Bearden, Overland Mountain Bike Association Executive Director, discussed the
Parks and Recreation Board Master Plan stating he appreciates the outreach efforts to
stakeholders. He expressed support for the holistic approach in assessing public lands
collectively but remained concerned that bike parks and mountain bike courses have
been separated into two distinct categories as they are essentially the same topic. He
expressed concern with the absence of addressing natural surface trails in the Plan. He
stated the Association does not believe the majority of community members are looking
for more paved surfaces in parks and open spaces.
5. APPROVAL OF MINUTES – JANUARY 2020
Gavaldon made a motion, seconded by Patton-Mallory, to adopt the January 2020
minutes as written. The motion was adopted unanimously.

7. NEW BUSINESS
a. Timberline Widening Project Update – Nicole Hahn
Nicole Hahn, Engineering Department Capital Projects Group, stated this project
involves the widening of a section of South Timberline Road between Trilby Road to
Stetson Creek to its 4-lane cross-section. She discussed the area noting there is a
great deal of school traffic and congestion-related crashes. She stated the goals of
the project are to reduce congestion and improve safety. She noted there will be a
raised separated bike lane on new segments; however, the existing bike lane
infrastructure will remain to aid in the budget of the project. She stated a great deal
of right-of-way will need to be purchased.
Hahn outlined the timeline of the project stating it is currently in the design phase
moving into right-of-way acquisition. The initial rounds of Boards and Commissions
meetings is currently occurring and final design will occur following public outreach
over the next few months. She stated construction is set to begin in the spring of
2021.
Hahn outlined the design alternative process and key design elements including
dual left-turn lanes from Trilby to Timberline.
Dickson?? asked about the forecasted increase in vehicle trips. Hahn replied she

does not know the exact projections, but stated the roadway has become somewhat
regional; therefore, the project has been funded by a CDOT grant.
Gavaldon asked about the length of the section to be widened. Hahn replied it is
about 1.25 miles.
Gavaldon asked about the projected cost of the project. Hahn replied it is $5.3
million. She noted the project has had some cost savings through the use of
existing infrastructure.
Gavaldon asked how much money was received from the state grant. Hahn replied
that was $2.9 million, which will be used toward construction. She noted a fair
amount of the City's share will be funded through the Transportation Capital
Expansion Fees.
Gavaldon asked if there have been any unwilling right-of-way sellers. Hahn replied
there have been some unenthusiastic parties and staff has worked through some
design solutions to decrease the needed right-of way in some areas.
Hahn discussed the longer left-turn stacking lane for Bacon Elementary.
Weschler asked where this ties into the Power Line Trail. Hahn replied the City
received some grant funding for a grade-separated crossing for the railroad and to
build a trial that connects to Timberline.
Stephen Beckley asked if there is a plan for protected bike lanes similar to those on
Mulberry. Hahn replied the goal of the design is to fit protected bike lanes in as
many sections as possible. She noted the maintenance of those bike lanes is a
primary consideration.
Gavaldon stated a protected bike lane should not be utilized unless there is a better-
defined maintenance plan. He expressed disappointment in the maintenance of
existing protected bike lanes. Hahn discussed the difficulties in maintaining the
separated bike lane on Mulberry but noted the curb-protected bike lane near Tavelli
Elementary seems to be working well.
Gavaldon asked if there is an operations and maintenance budget for the bike lane
maintenance. Hahn replied data has been collected from the Mulberry project for
necessary costs.
???? asked if more protected crossings were considered at Zephyr. Hahn replied
those were considered; however, safety concerns were raised from some team
members about using a protected intersection because of traffic volumes. She
noted there is a sidewalk and a crossing option.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN PROCEEDINGS
OF CERTAIN LANDS NECESSARY TO CONSTRUCT PUBLIC IMPROVEMENTS
FOR THE TIMBERLINE CAPITAL IMPROVEMENT PROJECT –
STETSON CREEK ROAD TO TRILBY ROAD
WHEREAS, the City is in the process of planning improvements to Timberline Road
from Stetson Creek Road to Trilby Road including roadway improvements and bicycle and
pedestrian connections (the “Project”); and
WHEREAS, the Project is necessary to address increased use of the existing two-lane
roadway on Timberline Road, which has resulted in the infrastructure reaching capacity, leading
to significant congestion and increased vehicular crash rates; and
WHEREAS, the Project is anticipated to include widening of the roadway to a four-lane
complete street section with median, sidewalks, and bicycle facilities; and
WHEREAS, to construct the Project, the City will need to acquire certain property rights,
from eighteen property owners, including right-of-way, permanent easements, and temporary
easements as described on Exhibits “A” through “Y”, attached hereto and incorporated herein by
this reference (the “Property Rights”); and
WHEREAS, the City will negotiate in good faith for the acquisition of the Property
Rights from the owners thereof; and
WHEREAS, the acquisition of the Property Rights is desirable and necessary for the
construction of the Project, is in the City’s best interest, and enhances public health, safety, and
welfare because it will allow for the construction of needed public infrastructure within the City;
and
WHEREAS, the acquisition of the Property Rights may, by law, be accomplished
through eminent domain.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That the City Council hereby makes and adopts the determinations and
findings contained in the recitals set forth above.
Section 3. That the City Council hereby authorizes the City Attorney and other
appropriate officials of the City to acquire the Property Rights for the City by eminent domain
proceedings.

Section 4. The City Council further finds that, in the event acquisition by eminent
domain of the Property Rights or any of them is commenced, immediate possession is necessary
for the public health, safety and welfare.
