EXECUTIVE SUMMARY The purpose of this item is to appropriate $15,588 in grant funding received from the State Historical Fund, awarded by History Colorado. This grant requires a City match of $6,000 which was appropriated and unexpended in the 2020 budget. The grant funds a historic context report of local architect William “Bill” Robb and the projects he and his firm, now known as RB+B, designed in Fort Collins. Notable projects of Robb’s include the 1957 Municipal Building (Operations Services building), Key Bank at Drake and College, several churches, local residences and many schools for the Poudre R-1 School District. STAFF RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. BACKGROUND / DISCUSSION This project will result in the preparation of a historic context on the life and work of significant local architect William B. “Bill” Robb. A native Coloradan, Robb came to Fort Collins as a graduate of the prestigious Massachusetts Institute of Technology’s School of Architecture. He established his firm in 1953 and along with his partners, created a large body of work in Fort Collins. Robb’s best-known work was in designing schools, churches and commercial buildings, often using architectural styles popular during the Modern Movement in the 1950s - 1970s. This context will also identify historic resources that warrant future intensive-level surveys to determine their relative importance to Fort Collins' history, and will form the basis for tours and other educational opportunities around Robb's work. The identification, protection and enhancement of historic resources is a principle of City Plan, as well as a strategy to promote neighborhood livability and social health in the City’s Strategic Plan. CITY FINANCIAL IMPACTS The Ordinance appropriates $21,588 in the General Fund to prepare a historic contextual report on Fort Collins architect William "Bill" Robb. These funds include $15,588 received as a State Historical Fund grant from History Colorado, and $6,000 of funding from the Historic Preservation Division's 2020 Budget. ATTACHMENTS 1. PARTIES This Amendment (the “Amendment”) to the Original Agreement shown on the Cover Page for this Amendment is entered into by and between the Grantee, and the State. 2. TERMINOLOGY Except as specifically modified by this Amendment, all terms used in this Amendment that are defined in the Agreement shall be construed and interpreted in accordance with the Agreement. 3. AMENDMENT EFFECTIVE DATE AND TERM A. Amendment Effective Date This Amendment shall not be valid or enforceable until the Amendment Effective Date shown on the Cover Page. The State shall not be bound by any provision of this Amendment before that Amendment Effective Date, and shall have no obligation to pay Grantee for any Work performed or expense incurred under this Amendment either before or after of the Amendment term shown in §3.B of this Amendment. B. Amendment Term The Parties’ respective performances under this Amendment and the changes to the Agreement contained herein shall commence on the Amendment Effective Date shown on the Cover Page for this Amendment and shall terminate on the termination of the Amended Grant Expiration Date. 4. PURPOSE The purpose of this project is to complete a historic context of architect, William Robb, his firm, and the historic resources that he designed during his career, between 1952-1986, in Fort Collins, Colorado. This context will also identify significant historic resources that warrant future intensive-level surveys, which is anticipated to be the subsequent phase of this project. The Project Budget is revised as adjustments of budget expenditure amounts exceeded 25% on multiple task line budgets 5. MODIFICATIONS The Agreement and all prior amendments thereto, if any, are modified as follows: A. The Agreement Budget in the provisions of Exhibit B is hereby modified as shown in Exhibit B1 attached. 6. LIMITS OF EFFECT AND ORDER OF PRECEDENCE This Amendment is incorporated by reference into the Agreement, and the Agreement and all prior amendments or other modifications to the Agreement, if any, remain in full force and effect except as specifically modified in this Amendment. Except for the Special Provisions contained in the Agreement, in the event of any conflict, inconsistency, variance, or contradiction between the provisions of this Amendment and any of the provisions of the Agreement or any prior modification to the Agreement, the provisions of this Amendment shall in all respects supersede, govern, and control. The provisions of this Amendment shall only supersede, govern, and control over the Special Provisions contained in the Agreement to the extent that this Amendment specifically modifies those Special Provisions. Reimbursable Expenses* $0 PROJECT TOTAL $21,588 Grant Award (72.21%) $15,588 Cash Match (27.79%) 6,000 * Travel must be within SHF/State allowable rates: Mileage - $.52/mile (2WD), $.55/mile (4WD); Lodging – at cost/night; Meal allowance - $55/day O:\Contracting\Contracts\2021\M1\21 M1 008 (Robb Buildings survey)\21 M1 008 ex B1.doc DocuSign Envelope ID: 279E36CF-C5CE3902-D46F-EE3C-4DD4-40EB-9543-84C8-AC02CDC357A3 E318D1F90CF2 -1- ORDINANCE NO. 088, 2020 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND AND AUTHORIZING A TRANSFER OF EXISTING APPROPRIATIONS FOR A CONTEXTUAL REPORT ON THE WORK OF ARCHITECT WILLIAM ROBB WHEREAS, the City recently was awarded a grant in the amount of $15,588 (the “Grant”) by the State Historical Fund; and WHEREAS, the Grant requires $6,000 in matching funds from the City, which have been appropriated and are available in the General Fund for this purpose; and WHEREAS, the Grant will fund a historic context report on local architect William “Bill” Robb and the many projects he and his firm, now known as RB+B, designed in Fort Collins; and WHEREAS, the Grant will pay for professional historic preservation services to identify and research Robb-designed buildings, to highlight the work of this mid-century designer and to proactively identify which of these may be eligible for historic designation; and WHEREAS, the results of this historic context report will be used to promote awareness and pride within the neighborhood, and will provide the City with the tools to make informed planning decisions; and WHEREAS, Article V, Section 9 of the City Charter permits the City Council, upon recommendation of the City Manager, to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, the City Manager has recommended the appropriation described herein and determined that this appropriation is available and previously unappropriated from the General Fund and will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that Fund during this fiscal year; and WHEREAS, Article V, Section 10 of the City Charter authorizes the City Council, upon recommendation by the City Manager, to transfer by ordinance any unexpended and unencumbered appropriated amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended remains unchanged, the purpose for which the funds were initially appropriated no longer exists, or the proposed transfer is from a fund or capital project in which the amount appropriated exceeds the amount needed to accomplish the purpose specified in the appropriation ordinance; and -2- WHEREAS, the City Manager has recommended the transfer described herein and determined that the purpose for which the transferred funds are to be expended remains unchanged. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby makes and adopts the determinations and findings contained in the recitals set forth above. Section 2. That there is hereby appropriated from unanticipated grant revenue in the General Fund the sum of FIFTEEN THOUSAND FIVE HUNDRED EIGHTY-EIGHT DOLLARS ($15,588) for expenditure in the General Fund for the William Robb historic context report. Section 3. That the unexpended appropriated amount of SIX THOUSAND DOLLARS ($6,000) is authorized for transfer from the Historic Preservation Division's operating budget in the General Fund for expenditure in the General Fund for the William Robb historic context report.
