EXECUTIVE SUMMARY The purpose of this item is to appropriate unanticipated revenue in the General Fund and authorize the transfer of appropriated amounts between accounts and projects for the multi-jurisdictional Northern Colorado Drug Task Force (NCDTF). Fort Collins Police Services applied to the Office of National Drug Control Policy and the Department of Justice on behalf of the NCDTF for federal grant monies to help fund the investigation of illegal narcotics activities in Larimer County. These grant awards will be used to offset joint task force operations. In addition, because of the significant decrease in federal funds available for drug enforcement, the drug task force is transferring $288,853 from its forfeiture reserve account to its 2017 operating budget to cover unfunded expenses. The majority of the forfeiture reserve account is made up of assets seized from people engaged in illegal drug activities. STAFF RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. BACKGROUND / DISCUSSION This appropriation is not a request to identify new dollars for the Police Services’ 2017 budget. This action is taken every year when federal awards are granted and the NCDTF budget is set. This action will appropriate $102,607 and $51,561 in new federal grant money and will authorize the transfer of $288,853 from the forfeiture reserve account for unfunded operating expenses in 2017. The NCDTF currently includes Fort Collins Police Services, the Loveland Police Department, and Colorado Adult Parole. The federal grant money is spent by the City to carry on daily drug enforcement efforts. CITY FINANCIAL IMPACTS The City has received two grant awards for the operation of the NCDTF. These grants will be used for task force operating expenses.  Office of National Drug Control Policy (2017-HIDTA) in the amount of $102,607  Edward Byrne Memorial Justice Assistance Grant (2016-2017 JAG) in the amount of $51,561 Agenda Item 4 Item # 4 Page 2 In addition, $288,853 will be transferred from the NCDTF forfeiture reserve account to the City of Fort Collins General Fund to establish the 2017 annual operating budget for expenses that are not grant funded. There is no financial impact to the City of Fort Collins as there are no matching funds required. BOARD / COMMISSION RECOMMENDATION The Northern Colorado Drug Task Force Executive Board approved this budget on April 24, 2017. -1- ORDINANCE NO. 064, 2017 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND AND AUTHORIZING THE APPROPRATION OF RESTRICTED NORTHERN COLORADO DRUG TASK FORCE GENERAL FUND RESERVES FOR FORT COLLINS POLICE SERVICES 2017 TASK FORCE PROGRAMS AND SERVICES WHEREAS, the Office of National Drug Control Policy and Department of Justice has awarded Fort Collins Police Services (“FCPS”) two grant awards of federal money in the amounts of $102,607 (Office of National Drug Control Policy (2017-HIDTA)) and $51,561 (Edward Byrne Memorial Justice Assistance Grant (2016-2017 JAG)) for a total of $154,168 (collectively, the “Grants”); and WHEREAS, no matching funds are required for the Grants and the City and FCPS shall administer the Grants for the Task Force; and WHEREAS, there is $288,853 in prior forfeiture reserve funds in the restricted Northern Colorado Drug Task Force (the “Task Force”) Reserve in the General Fund; and WHEREAS, the Grants and prior reserve funds will be used by the Task Force to help fund the investigation of illegal narcotics activities and the 2017 annual operating budget of the Task Force; and WHEREAS, the Task Force consists of representatives from FCPS, Loveland Police Department, and Colorado Adult Parole; and WHEREAS, Article V, Section 9, of the City Charter permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, Article V, Section 9, of the City Charter permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years, notwithstanding that such reserves were not previously appropriated; and WHEREAS, City staff has determined that the appropriation of the Grants as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year; and WHEREAS, it is the desire of the City Council to appropriate unanticipated grant revenue in the General Fund and prior reserves in the Northern Colorado Drug Task Force General Fund Reserve for expenditure therein for the FCPS Task Force. -2- NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby makes and adopts the determinations and findings contained in the recitals set forth above. Section 2. That there is hereby appropriated from unanticipated grant revenue in the General Fund the sum of ONE HUNDRED FIFTY-FOUR THOUSAND ONE HUNDRED SIXTY-EIGHT DOLLARS ($154,168) for expenditure, upon receipt, in the General Fund for Police Services for the Northern Colorado Drug Task Force. Section 3. That there is hereby appropriated from prior year reserves in the Northern Colorado Drug Task Force Reserve the sum of TWO HUNDRED EIGHTY-EIGHT THOUSAND EIGHT HUNDRED FIFTY-THREE DOLLARS ($288,853) for transfer to the General Fund and appropriated therein, for Police Services for the Northern Colorado Drug Task Force.
