EXECUTIVE SUMMARY The purpose of this item is to appropriate in the General Fund $6,000 of unanticipated grant revenues from the Colorado Department of Agriculture Noxious Weed Management Program. This proposed project will provide contracted herbicide applications to private property owners affected by Hairy Willow Herb. Hairy Willow Herb is a List A aquatic species requiring mandatory eradication by local governing agencies. Additionally, two acres in City Natural Areas that are now bare due to efforts last year to treat Hairy Willow Herb will be reseeded. STAFF RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. BACKGROUND / DISCUSSION This is the first application from the City of Fort Collins to the Colorado Department of Agriculture Noxious Weed Management Program Division to address noxious weed control for Hairy Willow Herb. • The City was awarded full funding of $10,675; however, staff is only requesting $6,000 of appropriations due to timelines not being met prior to funding distribution. The $6,000 will be used for herbicide application by a private vendor and purchase of seeds for bare areas. • This has been a joint department collaboration between Natural Areas and Neighborhood Services • This is a matching, in-kind funds grant that benefits 23 private property owners that have been identified as being affected for approximately 10 acres. The City is fortunate to receive funding of this grant amount to address this invasive aquatic species. The community will benefit from the education provided by the Code Compliance staff, and the reseeding provided by Natural Areas staff. CITY FINANCIAL IMPACTS The City benefits by a $6,000 grant which supports this initiative with an additional amount of $15,322 (matching in-kind funds of labor, reseeding, herbicide, and educational materials). No additional funds beyond the $6,000 grant need to be appropriated. ATTACHMENTS 1. The Colorado Department of Agriculture (CDA) has selected your project, “2017 Hairy Willow Herb Affected Lands Management” for full funding in 2017 for an amount up to $10,675. There are several things for you to keep in mind when implementing your project: This notification letter does not constitute the start date of the grant. CDA will work with you to develop a Statement of Work (SOW) with a summary budget that shows how the funding will be allocated. The SOW will be attached to a Purchase Order (PO). Once you have received the PO, you can begin incurring expenses that are reimbursable. You may conduct project activities prior to this time as long as they will be calculated as a part of the matching requirement, and have been approved by CDA. As in the past, there are two funding sources for your grant – Fiscal Year (FY) 17 Weed Fund and FY 18 Weed Fund. If you expect to submit an invoice (interim or final) prior to June 30, 2017, it cannot exceed the FY 17 funding amount allocated for your project. FY 18 funds will not be available until after July 1, 2017, and are expected to be approved by the legislature as a part of this year’s Long Bill. All state funds are available on a reimbursable basis only. The funding received must be matched on a 1:1 basis. We require project managers to keep track of project related expenses including in‐kind donations of labor, materials, equipment use, travel, and educational materials, as well as any matching grant funds received for the project. All entities receiving Weed Fund and SPF funds must be in compliance with the Noxious Weed Act, and if using pesticides, the Pesticide Act and Pesticide Applicators’ Act. All conservation districts must be in good standing with CDA and the Department of Local Affairs. This year, state fiscal rules require quarterly reports from grantees. The SOW will identify the quarters and dates for submitting quarterly reports. The last quarterly report will be the final grant report. In the final grant report, CDA requires a description and analysis of the status of target noxious weed populations that were a part of your grant. The measurable objectives in this report will, in part, determine whether this project will continue to receive CDA funding in future years. Sincerely, Patty York EDRR & List A Noxious Weed Specialist patty.york@state.co.us (303) 869‐9035 -1- ORDINANCE NO. 141, 2017 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND FOR HAIRY WILLOW HERB-AFFECTED LANDS MANAGEMENT WHEREAS, the City has been awarded a grant from the Colorado Department of Agriculture Noxious Weed Management Program (“Noxious Weed”) to address noxious weed control for the Hairy Willow Herb; and WHEREAS, the Hairy Willow Herb is a List A aquatic species requiring mandatory eradication by local governing agencies; and WHEREAS, the Noxious Weed grant funds in the amount of $6,000 (the “Grant”) will be used to provide education, apply herbicide, purchase seeds and conduct re-seeding on approximately ten acres of privately owned property, which includes twenty-three separate property owners; and WHEREAS, the Grant will also be used to purchase seeds and conduct re-seeding on two acres within a City-held Natural Area that is currently bare due to prior Hairy Willow Herb weed control; and WHEREAS, the City’s match portion towards the Grant is $15,322, which funds were previously appropriated in the 2017-2018 City Budget and will provide public education by the Code Compliance staff and re-seeding by the Natural Areas staff; and WHEREAS, Article V, Section 9, of the City Charter permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the Grant funds as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby makes and adopts the determinations and findings contained in the recitals set forth above. Section 2.
