EXECUTIVE SUMMARY The purpose of this item is to adopt the 2015 update to the Three-Mile Plan for the City of Fort Collins (the Plan). The Plan is a policy document for coordinating future annexations and provision of services and describes the general location, character, utilities, and infrastructure for areas within three-miles of the municipal boundary. Colorado Revised Statues requires municipalities to update their Three-Mile Plans annually. STAFF RECOMMENDATION Staff recommends adoption of the Resolution. BACKGROUND / DISCUSSION State laws limit municipal annexations to no more than three miles beyond their current boundaries in any given year and require municipalities to prepare and adopt a “Three-Mile Plan” prior to annexing land into their municipal boundaries. The first Three-Mile Plan for the City of Fort Collins was adopted by Council in 1998 and has been updated annually to comply with State Statutes. Although the City of Fort Collins employs a fixed Growth Management Area (GMA) and associated policies, a Three-Mile Plan is still required by Colorado law. Section 31-12-105 of the Colorado Revised Statues requires the City to complete a plan as follows: Prior to completion of any annexation within the three-mile area, the municipality shall have in place a plan for that area that generally describes the proposed location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the municipality and the proposed land uses for the area. Such plan shall be updated at least once annually. City Plan and related elements provide sufficient guidance for managing growth within the GMA, and to some extent outside the GMA for contextual purposes. Although the Three-Mile Plan for the City of Fort Collins is similar to City Plan, it takes a broader approach to the annexation and the development of land by referencing the plans, policies, maps, and other documents adopted by the City of Fort Collins pertaining to the location, character, and extent of future utilities, land uses, and infrastructure as listed in the State Statutes. This annual update represents a routine and recurring action to ensure the City complies with the State Statutes. Section II of the Plan highlights in bold text newly-adopted or revised plans, policies, and maps since the 2014 update. The Plan also includes four maps displaying the general resources, land-uses, and infrastructure for significant waterways and airports within the three-mile area of the City boundary. Agenda Item 18 Item # 18 Page 2 BOARD / COMMISSION RECOMMENDATION On November 12, 2015, the Planning and Zoning Board voted unanimously to recommend City Council approve the 2015 update to the Three-Mile Plan for the City of Fort Collins on the Board’s Consent Agenda. PUBLIC OUTREACH The 2015 update to the Three-Mile Plan for the City of Fort Collins did not include any public outreach. The individual plans listed and referenced by the Plan included their own separate public outreach. RESOLUTION 2015-113 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING THE 2015 UPDATE TO THE THREE-MILE PLAN FOR THE CITY OF FORT COLLINS WHEREAS, Colorado law provides at Section 31-12-105, C.R.S., that each municipality in the State must prepare and annually update a plan for the geographic area within three miles in any direction from the municipality’s boundaries (a “Three-Mile Plan”); and WHEREAS, a Three-Mile Plan must generally describe the proposed location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities and terminals for water, light, sanitation, transportation and power to be provided by the municipality, and the proposed land uses for the area; and WHEREAS, the City’s original Three-Mile Plan was adopted in 1998, and has been annually updated since that time; and WHEREAS, City staff has prepared and presented to the City Council a proposed 2015 update of the Three-Mile Plan for the City, which the City Council has determined should be approved. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the updated Three-Mile Plan for the City, attached hereto as Exhibit “A” and incorporated herein by this reference, is hereby approved and adopted. Introduction What is the Purpose of the Three-Mile Plan? The Three-Mile Plan for the City of Fort Collins is a policy document for coordinating future annexation and provision of services, required to be updated annually per Colorado Revised Statutes. The Three-Mile Plan describes the general location, character, utilities, and infrastructure for areas of potential annexation within three miles in any direction of the municipal boundary. In comparison to a specific annexation impact report, a Three-Mile Plan takes a broader approach to the annexation and development of land. A proposed annexation should be consistent with the municipality’s Comprehensive Plan and Three-Mile Plan, in addition to other policies. Section 31-12-105 of the Colorado Revised Statutes requires Cities to complete a plan within three miles in any direction from any point of their municipal boundary as follows: Prior to the completion of any annexation within the three-mile area, the municipality shall have in place a plan for that area that generally describes the proposed location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the municipality and the proposed land uses for the area. Updates to the Three-Mile Plan for the City of Fort Collins are routine and occur on an annual basis. The 2015 update highlights the changes to approved plans and documents applicable to areas within three-miles of the municipal boundary as defined in the State Statutes. What Does the Three-Mile Plan Describe? In addition, there are some plans and policies that have been adopted by other jurisdictions such as Larimer County, Colorado State University, or adjoining municipalities that are also located within the boundaries of the Three-Mile Plan for the City of Fort Collins. There have been relatively few changes to existing plans or newly-adopted plans within the three-mile study area since the 2014 update.
