SUBJECT
Second Reading of Ordinance No. 127, 2016, Appropriating Prior Year Reserves in the General Fund for the
Purpose of Equipment Upgrades for FCTV.
EXECUTIVE SUMMARY
This Ordinance, unanimously adopted on First Reading on November 15, 2016, transfers $30,000 in restricted
PEG funds from FCTV (Cable 14) reserves to 2016 Budget to cover needed equipment upgrades.
STAFF RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.

First Reading of Ordinance No. 127, 2016, Appropriating Prior Year Reserves in the General Fund for the
Purpose of Equipment Upgrades for FCTV.
EXECUTIVE SUMMARY
The purpose of this item is to transfer $30,000 in restricted PEG funds from FCTV (Cable 14) reserves to 2016
Budget to cover needed equipment upgrades.
STAFF RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
BACKGROUND / DISCUSSION
The primary source of equipment and capital funding for the FCTV (Cable 14) operation is with PEG (public,
education and governmental) funds. This is a federally restricted fee paid by Comcast to the City that can only
be used by PEG channels on the Comcast system. In Fort Collins, this is CSU, the City, Poudre School District
and FC Public Media.
Unspent PEG funds go in to a restricted reserve fund. FCTV is requesting transfer of $30,000 of its current
reserve to fund the replacement of video cameras used in its operation. FCTV is in the process of upgrading
the remainder of its cameras to HD and will use these funds, along with its 2016 PEG budget, to accomplish
this.
CITY FINANCIAL IMPACTS
Since this is a restricted fund that can only be used for this purpose, there is no impact to the City budget.

ORDINANCE NO. 127, 2016
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE GENERAL FUND
FOR THE PURPOSE OF EQUIPMENT UPGRADES FOR FCTV
WHEREAS, pursuant to the cable television franchise agreement between Comcast and
the City of Fort Collins, Comcast collects a monthly fee from subscribers that, under federal law,
must be spent for capital equipment and infrastructure used to provide public, educational and
governmental (PEG) television programming; and
WHEREAS, the City receives the PEG funds from Comcast and designates a portion of
the funds to be used for providing public access television; and
WHEREAS, the City identifies capital needs and spends the PEG funds on appropriate
equipment to be owned by the City to provide public access television programming; and
WHEREAS, any funds not spent go back into the City’s PEG reserve account and are
available for future expenditures; and
WHEREAS, funds are needed for video camera equipment upgrades; and
WHEREAS, restricted PEG reserves are available in the General Fund to pay for the
equipment; and
WHEREAS, City staff recommends appropriating from prior year reserves in the General
Fund $30,000 to be used for equipment upgrades; and
WHEREAS, Article V, Section 9 of the City Charter permits the City Council to
appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be
available from reserves accumulated in prior years, notwithstanding that such reserves were not
previously appropriated.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That the City Council hereby makes and adopts the determinations
and findings contained in the recitals set forth above.
Section 2. That there is hereby appropriated for expenditure from prior year reserves
in the General Fund the sum of THIRTY THOUSAND DOLLARS ($30,000) to be used for
video camera equipment upgrades.
