Items Relating to Conveyance of Various Easements Relating to the Provincetowne P.U.D.,
Second Filing.
RECOMMENDATION:
Staff recommends adoption of the Ordinances on First Reading. The Natural Resources
Advisory Board chose not to make a formal recommendation in support of or against the
proposed easements (see attached memo).
FINANCIAL IMPACT:
The developer of the Provincetowne P.U.D., Second Filing, KB HOME COLORADO, will be
responsible for all costs associated with the construction of the water line and drainage
improvements and restoration of disturbed areas. The developer has agreed to pay a total of
$201,747 as compensation to the City for the temporary construction easements and the
permanent easements. The values for the easements are based upon the fee value of the land
established in the Purchase Agreement with KB HOME and using typical land use factors for the
specific type of easements.

Planned as Future Natural Area Property.

B. First Reading of Ordinance No. 83, 2001, Authorizing the Conveyance of Non-exclusive
Easement Interests for the Construction of Storm Drainage Improvements and a Sixteen-
Inch Water Line in Connection with Provincetowne P.U.D. Second Filing on a Portion of
the C'ity's Provincetowne Property.
The City of Fort Collins became the owner of approximately 341 acres of property located south
of Trilby Road, west of Lemay Avenue, north of Carpenter Road, and east of College Avenue
after the property was sold at tax sale in 1990 (the "Provincetowne Property"). Pursuant to
Ordinance No. 41, 1996, the City entered into an agreement to convey approximately 181 acres
of the Provincetowne Property to Pridemark Homes (the "Development Property"). Pridemark

has since been purchased by KB HOME COLORADO, Inc. ("KB HOME"), and various
addenda to the original contract have been executed. The southern 160 acres of the
Provincetowne Property, which includes Benson Reservoir, is planned to become part of the
City's Natural Areas program for use as a natural area, after an appropriate compensation
amount for the property is determined and a transfer of appropriations for that purpose
authorized. In connection with the planning and development of Provincetowne P.U.D., Second
Filing, on the Development Property, certain drainage and water line easements have been
identified. The proposed drainage easements will allow the construction of two drainage swales,
a new storm sewer line, and a detention pond on the future natural area to connect to existing
culverts under Lemay Avenue which ultimately drain to Stanton Creek. The proposed water line
easement is intended to allow the construction of a 16-inch water line to connect to an existing
Fort Collins-Loveland Water District water line in College Avenue. The water line will provide
water service for a portion of the development.
BACKGROUND:
KB HOME COLORADO, Inc. is the contract purchaser from the City of a 181-acre tract of land
located in southeast Fort Collins, north of Carpenter Road and west of Lemay Avenue. KB
HOME has received final approval on Provincetowne P.U.D., Second Filing, pending the
approval of these easements. (See attached Site Plan).
As a condition of its approval for the Provincetowne P.U.D. Second Filing, KB HOME, is
required to obtain easements for the installation of the offsite drainage improvements and a
water line. The drainage improvements consist of two drainage swales, a storm sewer pipeline
and a detention pond. These improvements will allow the stormwater collected on the
Provincetowne P.U.D. to cross future City natural area property and be detained in a detention
pond on that property. The water will then drain through existing culverts under Lemay Avenue
and ultimately to Stanton Creek. The 16-inch water line will connect to an existing Fort Collins-
Loveland Water District water line in College Avenue to provide water service to a portion of
the development. KB HOME is requesting the permanent and temporary construction easements
necessary to construct and maintain the improvements.
The costs for the Provincetowne P.U.D. offsite easements across City-owned property are shown
below. There is a section of one of the drainage swales and the water line that crosses land that
is on property KB HOME has under contract to acquire from the City in the future. For those
easements, KB HOME will pay to the City 50% of fee value for the easements and then will pay
the remaining 50% of fee value in the future when fee title to that land is conveyed. The value
of the easements on the future natural area property will be reduced from the total amount
transferred from the Natural Areas program when that property becomes a part of the Natural
Areas program.
The cost per acre, $10,588.24 @ 7.5% simple interest per annum, that KB HOME agreed to in
December 1998, brought to present dollars is $13,235 per acre ($10,588.24 + [$10,588.24 x .075
x 3.333 years] = $13,235).
KB HOME needs temporary and permanent easements for drainage swales, a detention pond, a
storm sewer pipe, and a water line. Based upon the valuation of easements, KB HOME will pay

100% of the fee value for the detention pond area, and 50% of the fee value for the areas used
for swales and pipelines. For the temporary construction easements, KB HOME will pay 10% of
fee value per year prorated for 6 months of construction, or 5% of the land value.
Under the terms of the easement agreement negotiated with KB HOME, the Natural Resources
Department will be responsible for the ongoing maintenance and management of the vegetation
on the future natural area property after KB HOME has completed the final grading and initial
seeding, in exchange for the payment by KB HOME of $2,450 per acre. This cost is based on
the Department's estimate of the potential costs of weed control and reseeding as necessary over
the anticipated ten years that it will take to fully restore the vegetation. KB HOME will maintain
and warranty the trees and shrubs for two years.
The total compensation for easements on the future natural area property is as follows:
Permanent Drainage Swales Easement 10.501 ac @ $13,235/ac X 50% = $69,490
Permanent Storm Sewerline Easement 1.676 ac @ $13,235/ac X 50% = $11,091
Permanent Detention Pond Easement 3.053 ac @ $13,235/ac X 100% = $40,406
Temporary Construction Easements 4.506 ac @ $13,235/ac X 5% = $ 2,981
Vegetation Management 19.736 ac @ $ 2,450/ac = $48,353
Sub-total Compensation $172,321
The total compensation for easements on the parcel to be acquired by KB HOME is as
follows:
Permanent Water line Easement 1.626 ac @ $13,235/ac 50% =$10,760
Permanent Drainage Swales Easement 2.585 ac @ $13,235/ac X 50% = $17,106
Temporary Construction Easements 2.357 ac @ $13,235/ac X 5% = $ 1,560
Sub-total Compensation $29,426
Total Compensation $201,747
The placement of the drainage swales and detention pond for Provincetowne P.U.D. Second
Filing on the future natural area property has saved KB HOME over $70,000 in land costs alone.
Construction of the detention pond onsite, would have required more land for the development
and would have resulted in much higher construction costs. By approving these easements, the
City assists KB HOME in lowering the costs of the affordable housing portion of the
Provincetowne P.U.D.
KB HOME has worked with Natural Resources staff to design the swales and detention pond to
be an amenity to the future natural area property. The drainage swales and detention pond will be
planted with native grasses, trees and shrubs and graded to provide small wetlands. The storm
sewer pipeline will be constructed adjacent to L.emay Avenue to minimize disturbance to the
future natural area property. The future natural area property in the area of the improvements is
approximately an 80-acre bromme grass (non-native grass) field, which will eventually be
restored to native grasses and shrubs. A total of 20 acres of land will be disturbed and restored
to native grasses and shrubs during the construction activity. Natural Resources is planning to
restore the remaining 60 acres to native grasses and shrubs shortly after the drainage

improvements have been completed to take advantage of the restoration work to be completed
by KB HOME.
KB HOME has also agreed to all recommendations made by Natural Resources staff regarding
resource protection during construction and restoration of the future natural area property
following construction. According to these resource protection measures, KB HOME will:
• coordinate all construction and restoration activities with the Natural Resources Department;
• provide and implement an erosion control plan;
• time construction to avoid periods of time when sensitive wintering birds of prey, nesting
burrowing owls, and denning foxes, coyotes or badgers are present;
• survey prairie dog burrows to determine occupancy and then relocate or fumigate prairie
dogs in accordance with the City's policy for management of prairie dogs in City natural
areas;
• maintain a buffer of a minimum of 600' between construction activities and an existing
Swainson's hawk nest site during nesting;
• post signs explaining the purpose for the drainage improvements;
• strip and stockpile 8"of topsoil for replacement on the disturbed areas;
• reseed disturbed areas in accordance with Natural Resources specifications;
• plant native trees and shrubs along the swales and guaranty them for two years;
• create pocket wetlands along the swales below each drop structure; and
• construct drop structures using gray or tan colored boulders.
Based upon the final plans and the easement agreements, which provide for adequate resource
protection measures, ongoing swale maintenance requirements, and fair compensation for the
easements, staff recommends approval of the proposed easements. The construction of these
improvements will not disturb sensitive vegetation and will not occur during periods of the year
when especially sensitive wildlife species are present on the site. The construction will create
only a short-term disturbance to the future natural area property, and will restore the land to
native vegetation. The landscaping of the drainage swales and detention pond will provide
wetlands, trees, and shrubs, which will increase the diversity of the wildlife habitat on this future
natural area.

At its meeting of April 18, 2001 the Natural Resources Advisory Board reviewed the proposed
drainage and water line easements for the Provincetown development. The board chose not to make
a formal recommendation to Council, either in support of or opposition to the easements. However,
the board did want to share several observations with Council with respect to similar situations that
may arise in the future.
NRAB members are aware of the long history of the Provincetown property and the intent for a
collaborative project between the developer and the City to demonstrate how affordable housing can
be integrated into new development. Given this unique history, we saw no reasonable alternative at
this time to the proposals for drainage easements across the future natural area property.
We do not believe, however, that this project should be used as a precedent in the future. We do
not believe that the city's natural area system should be used to facilitate new development, as these
easements do by allowing a detention pond to be located on the future natural area, and by allowing
the use of a lower cost solution compared to installing a subsurface storm sewer, or increasing the
culvert capacity at LeMay Avenue. These practices depart from the recommendations of both board
and staff in the draft policy regarding easements on natural areas. We continue to recommend that a
clear policy be adopted by Council as soon as possible to guide the placement and design of
easements on natural areas.
The Board also wanted to acknowledge the successful efforts by staff to work with the developer on
several aspects of the proposal. Staff identified a more appropriate location for the water line
easement that will enable the new fine to serve several future development areas, rather than locating
on the natural area property. The compensation amounts negotiated for the easements appear to be
fair and reasonable. Finally, the design of the drainage channels will make them appear relatively
"natural" and will integrate the channels into the future natural area as well as possible.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CONVEYANCE OF NON-EXCLUSIVE EASEMENT INTERESTS
FOR THE CONSTRUCTION OF STORM DRAINAGE IMPROVEMENTS
FOR PROVINCETOWNE P.U.D. SECOND FILING
ON A PORTION OF THE CITY'S PROVINCETOWNE PROPERTY
PLANNED AS FUTURE NATURAL AREA PROPERTY
WHEREAS, the City of Fort Collins acquired approximately 341 acres of property located
south of Trilby Road,west of Lemay Avenue,north of Carpenter Road,and east of College Avenue,
after the property was sold at tax sale in 1990 (the"Provincetowne Property"); and
WHEREAS,pursuant to Ordinance No.41, 1996,the City has agreed to sell approximately
181 acres of the Provincetowne Property, subject to certain terms and conditions, including the
development of Provincetowne P.U.D., Second Filing; and
WHEREAS, approximately 160 acres of the Provincetowne Property are planned to be
retained by the City and in the future made a part of the City's Natural Areas program, and that
property has been designated in the Natural Areas program as parcel #01FC1 (the "Natural Area
Property"); and
WHEREAS, in order to complete the planning process for Provincetowne P.U.D. Second
Filing, the Developer, KB HOME COLORADO,Inc. will be required to construct offsite drainage
improvements including a detention pond, storm sewer line, storm drainage swales, on the Natural
Area Property; and
WHEREAS, the Developer has requested that the City grant a non-exclusive temporary
construction easement to the Developer for the construction of offsite storm drainage improvements
on certain portions of the Natural Area Property, as described in Exhibits"A-2","A-3", `B-2", and
"C-2", attached hereto and incorporated herein by this reference (the "Temporary Construction
Easements"); and
WHEREAS, the Developer has requested that the City grant a non-exclusive permanent
easement to the Developer for the maintenance of offsite storm drainage improvements on certain
portions of the Natural Area Property, as described in Exhibits "A-1", `B-1", "C-l" and "D-1",
attached hereto and incorporated herein by this reference (the "Permanent Easements"); and
WHEREAS,City staff has negotiated easement agreements for the foregoing easements, and
a draft of each of the same, dated April 27, 2001, is on file in the office of the City Clerk and
available for public inspection (the "Easement Agreements"); and
WHEREAS,in exchange for the grant of the foregoing easements,the Developer has agreed
to pay to the City the fair market value of the same, in the total amount of$123,968, which amount
will be deducted from the total amount to be paid from the Natural Areas program for the Natural
Area Property; and
WHEREAS,the Developer has worked with City staff to minimize disturbance to the Natural
Area Property; and
WHEREAS, the Developer has agreed to regrade and reseed the areas impacted by
construction in accordance with City specifications,to comply with specified standards for time and
manner of construction activities and to pay to the City its costs for long-term revegetation
management of impacted areas, which have been determined to be $48,353; and
WHEREAS,staff recommends approval of the Easement Agreements in view of the resource
protection measures to which the Developer has agreed; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell,convey, or otherwise dispose of real property owned by the City,provided the Council first
finds by ordinance that any sale or other disposition of real property owned by the City is in the best
interest of the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the conveyance of the Temporary Construction Easements and the
Permanent Easements, as set forth herein, is in the best interest of the City of Fort Collins.
Section 2. That the Mayor is hereby authorized to execute the Easement Agreements,
together with such additional terms and conditions as the City Manager,in consultation with the City
Attorney, determines to be necessary or appropriate to protect the interests of the City.

ORDINANCE NO. 83, 2001
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CONVEYANCE OF NON-EXCLUSIVE EASEMENT INTERESTS
FOR THE CONSTRUCTION OF STORM DRAINAGE IMPROVEMENTS
AND A SIXTEEN-INCH WATER LINE
IN CONNECTION WITH PROVINCETOWNE P.U.D. SECOND FILING
ON A PORTION OF THE CITY'S PROVINCETOWNE PROPERTY
WHEREAS, the City of Fort Collins acquired approximately 341 acres of property located
south of Trilby Road,west of Lemay Avenue,north of Carpenter Road,and east of College Avenue,
after the property was sold at tax sale in 1990 (the "Provincetowne Property"); and
WHEREAS,pursuant to Ordinance No.41, 1996,the City has agreed to sell approximately
181 acres of the Provincetowne Property, subject to certain terms and conditions, including the
development of Provincetowne P.U.D., Second Filing; and
WHEREAS, in order to complete the planning process for Provincetowne P.U.D. Second
Filing,the Developer, KB HOME COLORADO,Inc. will be required to construct offsite drainage
improvements and a 16-inch water line,to beused by the Fort Collins-Loveland Water District(the
"District") to provide water service to that development; and
WHEREAS, the Developer has requested that the City grant a non-exclusive temporary
construction easement and a non-exclusive permanent easement to the Developer for the
construction and maintenance of offsite storm drainage improvements, as described respectively in
Exhibits "A-2", "A-3" and "A-1", attached hereto and incorporated herein by this reference (the
"Temporary Storm Drainage Construction Easement" and the "Permanent Storm Drainage
Easement"); and
WHEREAS, in order to install the water pipeline, the Developer has requested that the City
grant a non-exclusive 50-foot wide temporary construction easement to the Developer and a non-
exclusive 30-foot wide permanent easement to the District for the construction and maintenance of
the 16-inch water line, as described respectively in Exhibits `B-2" and `B-1", attached hereto and
incorporated herein by this reference(the"Temporary Water Line Construction Easement" and the
"Permanent Water Line Easement") respectively; and
WHEREAS,City staff has negotiated easement agreements for the foregoing easements, and
a draft of each of the same, dated April 27, 2001, is on file in the office of the City Clerk and
available for public inspection (the "Easement Agreements"); and
WHEREAS,in exchange for the grant of the foregoing easements,the Developer has agreed
to pay to the City the fair market value of the same, in the total amount of$29,426; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell, convey, or otherwise dispose of real property owned by the City, provided the Council first
finds by ordinance that any sale or other disposition of real property owned by the City is in the best
interest of the City of Fort Collins.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the conveyance of the Temporary Storm Drainage Construction Easement,
the Permanent Storm Drainage Easement, the Temporary Water Line Construction Easement and
the Permanent Water Line Easement, as set forth herein, is in the best interest of the City of Fort
Collins.
Section 2. That the Mayor is hereby authorized to execute the Easement Agreements,
together with such additional terms and conditions as the City Manager,in consultation with the City
Attorney, determines to be necessary or appropriate to protect the interests of the City.
