Second Reading of Ordinance No. 79, 2001, Authorizing Amendments to the Intergovernmental
Agreements Between the City and Poudre School District and Thompson Valley School District
Pertaining to the Land Dedication and In-Lieu Fee Requirements Contained in Such Agreements.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY:
In April, 1998, the City of Fort Collins and Thompson and Poudre School Districts entered into
Intergovernmental Agreements regarding land dedication for new developments, including a
provision for fees in lieu of land dedication. This system of land dedication and fees-in-lieu of
dedication has been in place for 2.5 years, and is now in need of review. The school districts have
asked that the amount of the fees be increased to reflect both the increasing cost of land and revised
school site standards. This Ordinance was unanimously adopted on First Reading on April 17,2001.

FINANCIAL IMPACT:
The proposed ordinance will not have a financial impact on the City of Fort Collins because the fees
will be collected on behalf of Poudre and Thompson School Districts. Revenues from the fees will
pass through City accounts and will not affect City revenue limits under Article X,Section 20 of the
Colorado Constitution.
EXECUTIVE SUMMARY:

The effect of the proposed change in per dwelling unit costs would be as follows:
Poudre School District:
Previous Fee per dwelling unit $484.26

These significant changes in Poudre School District's fees reflect two factors. A significant increase
in the amount of land required for both Junior High and High School facilities has led to a much

higher land dedication requirement. Also, the cost of land acquisition and infrastructure
development has increased as general land values in the area have risen. The school district has
experienced these increased costs through recent school site acquisitions and experience with bids
for infrastructure development.

The change in Thompson School District's fees result solely from the increase in land values within
the district. An increase in developed land costs from $31,000 per acre to,$47,800 reflect both the
district's experience in purchasing school sites and the cost of land currently for sale within the
district. The school district has met with both its Construction Review Board14'and, Planning
Commission to review the proposed changes and gather public input. r
The City's Intergovernmental Agreements with .Poudre School District and Thompson School
District allow for periodic updates to the fees and land dedication requirements. The agreements also
require that the City conduct a public hearing prior to any changes in the fee or land requirement.
Each of the school districts has reviewed its methodology for this program and requested that the
City Council approve these revisions.
