Resolution 2001-60 Authorizing the City Manager to Execute a Car Rental Concession
Agreement at the Fort Collins-Loveland Municipal Airport with Budget Rent-A-Car Systems,
Inc.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT:
This agreement will generate $2,116 in rents, plus ten-percent (10%) of gross receipts during its
one year term.
EXECUTIVE SUMMARY:
The Airport Manager has negotiated a one year rental agreement with Budget Rent-a-Car
Systems, Inc. for concession space in the Fort Collins-Loveland Municipal Airport terminal
building. Budget Rent-a-Car will provide rental cars to airport customers and the general public.
RESOLUTION 2001-60
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORVING THE CITY MANAGER TO EXECUTE A
CAR RENTAL CONCESSION AGREEMENT
AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT
WITH BUDGET RENT-A-CAR SYSTEMS, INC.
WHEREAS, the Cities of Fort Collins and Loveland (the "Cities") jointly own and
operate the Fort Collins-Loveland Municipal Airport (the "Airport"), including the Terminal
located on said Airport; and
WHEREAS, pursuant to Section 23-114(a) of the Code of the City of Fort Collins (the
"Code"), the Council is authorized to lease any and all interests in real property owned in the
name of the City, provided that Council first finds that the lease is in the best interests of the
City; and
WHEREAS, Section 23-114(b) of the Code defines a lease as a contract by which the
City grants to another the right to possess, use and enjoy any real property owned by the City for
ten (10) days or longer, in exchange for the payment of rent in a stipulated amount; and
WHEREAS, the Intergovernmental Agreement for the Joint Operation of the Fort
Collins-Loveland Municipal Airport between the Cities specifically recognizes the leasing of
Airport Property as a valid use of the jointly owned Airport Property; and
• WHEREAS, Budget Rent-A-Car Systems, Inc. has indicated a desire to enter into a
concession agreement that would allow it the use of a portion of the Terminal, consisting of a
sales counter of approximately 143 square feet and a portion of the Terminal parking lot, for a
period of one year, in order to conduct the business of renting motor vehicles at the Airport.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS, COLORADO as follows:
Section 1. That it is in the best interests of the City to execute a concession
agreement with Budget Rent-A-Car Systems, Inc., pursuant to the terms of that certain Car
Rental Concession Agreement dated this same date, a copy of which is on file in the Office of
the City Clerk, for that portion of the Airport premises described therein.
Section 2. That the City Manager is hereby authorized to execute said Car Rental
Concession Agreement, subject to such modifications in form or substance as the City Manager,
in consultation with the City Attorney, may deem necessary to effectuate the purposes of this
Resolution or to protect the interests of the City.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this
17th day of April, A.D. 2001.
