HomeMy WebLinkAboutCOUNCIL - AGENDA ITEM - 11/07/2000 - RESOLUTION 2000-134 AUTHORIZING THE MAYOR TO EXECU AGENDA ITEM SUMMARY ITEM NUMBER: 27 November 7, 2000 FORT COLLINS CITY COUNCIL DATE:STAFF: Tom Frazier/ Ron Phillips SUBJECT: Resolution 2000-134 Authorizing the Mayor to Execute an Intergovernmental Agreement with Colorado State University to Develop a Transit Center Adjacent to the Lory Student Center. RECOMMENDATION: Staff recommends adoption of the Resolution. FINANCIAL IMPACT: The projected cost for the design, construction, and equipment of the campus transit center is $10,000,000. The funding sources are projected to be$8,000,000 federal and$2,000,000 primarily from Colorado State University from its contribution of approximately 8.21 acres of land. The City has received federal grants to date of$1,794,589 to begin final design, site preparation, and some site development. Future federal funds will be sought to complete the Transit Center. EXECUTIVE SUMMARY: The City and Colorado State University have been working together since 1996 to develop a campus transit center. Work is expected to begin on final drawings this fall. This Intergovernmental Agreement (IGA) represents the respective rights and obligations of the City and the University concerning the development, maintenance, operation, use and ultimate retirement of the Transit Center. This IGA includes terms for the City to lease the property,upon which the Transit Center is to be located, from the University for a period of thirty-three years and four months. BACKGROUND: The City and University staffs completed the conceptual design of this transit center in 1998 and presented the proposed project to City Council and the Colorado State Board of Agriculture. Both legislative bodies provided direction to continue with the development of the project. The project was initially divided into four phases: Phase 1 — complete construction documents; Phase 2 — construction of utilities,paving, and landscaping;Phase 3—construction of Transit Center building and bus canopies; and Phase 4—final construction including connections to the student center and Engineering buildings. The phasing of this project was necessary because the federal funds were expected to be received over 4- 5 years. The City applied for federal funds in 1998 and 1999, and DATE: November 7, 2000 2 ITEM NUMBER: 27 the Congress approved partial funding. These funds will permit the staffs to begin design and some construction work. The IGA basically states the University will lease the land to the City for thirty-three years and four months with an extension clause, upon mutual agreement of both the City and University, for two additional terms of thirty-three years and four months.The project will be designed and constructed in accordance with University and City construction standards,with both parties needing to mutually agree on the design and construction. The University will be solely responsible for construction management of the project to ensure that the facility is built in accordance with the University's construction standards and the University's Facility Master Plan. When complete,the City will be responsible for the operation and maintenance expenses of the Transit Center. The City will retain all revenues generated from this facility. Since there is no guarantee of future federal funds, the IGA contains language which permits the reduction of the Transit Center's scope of work. This reduced scope provides for the completion of a viable transit center whereby buses can conveniently pick up and drop off passengers. Under this reduced scope the transit building and associated structures would not be built. The plan is to complete the final design by next May,bid the project, and start construction late in 2001. The City will submit another federal grant request in December 2000, 2001, and 2002 to complete the project. If all grants are approved, the project could be completed in 2005. . RESOLUTION 2000-134 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT WITH COLORADO STATE UNIVERSITY TO DEVELOP A TRANSIT CENTER ADJACENT TO THE LORY STUDENT CENTER WHEREAS,the City and Colorado State University have been working together since 1996 to develop a campus transit center north of and adjacent to the Lory Student Center for the purpose of enhancing the operation of the City's Transfort bus system and for the purpose of providing more comfortable and efficient service to the students, faculty, staff and visitors of the University and citizens of the City; and WHEREAS, the staffs of the City and University have prepared an intergovernmental agreement, a copy of which is on file in the office of the City Clerk, for the development of the transit center which sets forth the respective rights and obligations of the parties concerning the development, maintenance, operation, use and ultimate retirement of the transit center; and WHEREAS, the City and the University are authorized to enter into an intergovernmental agreement to provide any function, service or facility lawfully authorized to each such entity, as provided in Colorado Revised Statutes Section 29-1-203; and • WHEREAS, the Council of the City of Fort Collins has determined that it is in the best interests of the City that the intergovernmental agreement for the transit center be entered into between the City and the University. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be and hereby is authorized to execute an intergovernmental agreement with the Colorado State Board of Agriculture for the use and benefit of Colorado State University for the development of a transit center adjacent to the Lory Student Center, which agreement is on file in the office of the City Clerk, subject to such modifications in form or substance as the City Manager,in consultation with the City Attorney, may deem necessary to effectuate the purposes of this Resolution or to protect the interests of the City.
