RECOMMENDATION: Staff recommends adoption of the Resolution. FINANCIAL IMPACT: This request is for an exception to the competitive process over $100,000 and requires Council approval. The City of Fort Collins Light and Power Utility has requested purchase of a switchgear power control center for the Dixon Creek Substation. lip EXECUTIVE SUMMARY: The switchgear will be purchased directly from the manufacturer,Powell Electrical Manufacturing Company, for a total price of$1,244,445. The money for this purchase is budgeted and available in the Dixon Creek Substation project of the Light and Power Department. The total project budget is $2.5 million. BACKGROUND: In conjunction with the move of Overland Substation to Dixon Creek Substation, the Utilities will be purchasing a new 15KV electrical switchgear power control center. All five existing switchgear power control centers in the Fort Collins system are manufactured by Powell Electrical Manufacturing of Houston, Texas. Powell is the only manufacturer that can currently meet the City's technical equipment and assembly specifications. Interchangeability of equipment throughout the electrical system benefits the City in reduced engineering, construction and start-up costs, training and long-term maintenance costs, uniformity in operations, safety and reduced spare parts inventory. DATE: November 7, 2000 2 ITEM NUMBER: 26 There are a total of 122 15KV circuit breakers in the power control centers that are located in the City of Fort Collins substations and Wastewater Reclamation Facility#2. The cost of a replacement 15KV circuit breaker is$6,500. Standardized equipment throughout the Fort Collins' system allows keeping spare breakers to a minimum since spares for a number of different manufacturers don't have to be stocked. All breakers and associated relays are interchangeable across the system. 1n March 1998,bids were solicited from manufacturers known to produce electrical switchgear. No other bids were received that met the engineering specifications. Powell has agreed to hold its previous 1998 pricing for the identical power control centers purchased for the Harmony substation expansion project. Current research indicates that no other manufacturers can meet the City's specifications and this equipment is being purchased at a competitive price. . RESOLUTION 2000-133 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING AN EXEMPTION TO THE USE OF A COMPETITIVE PROCESS FOR COMPLETION OF THE PURCHASE OF A 15 KV ELECTRICAL SWITCHGEAR POWER CONTROL CENTER WHEREAS, the City of Fort Collins Light and Power Utility requires purchase of a 15 KV electrical switchgear power control center for the Dixon Creek Substation site; and WHEREAS,Powell Electrical Manufacturing Company("Powell")is the only manufacturer that produces equipment in accordance with specifications; and WHEREAS,funds have been budgeted and approved in the Light and Power Utility budget for 2000; and WHEREAS, the interchangeability of equipment throughout the electrical system benefits the City in reduced engineering, construction and start-up costs, maintenance and inventory costs, and safety; and WHEREAS,Powell has agreed to hold to its pricing from 1998 in an economy and industry where pricing has increased; and WHEREAS, Article IV, Section 8-161(d)(1)a. of the Code of the City of Fort Collins authorizes the Purchasing Agent to contract for material without competition if there exists only one (1) responsible source; and WHEREAS, Article IV, Section 8-161(d)(1)c, of the Code of the City of Fort Collins authorizes the Purchasing Agent to contract for material without competition if,a particular material or service is required to maintain interchangeability or compatibility as a part of an existing integrated system; and WHEREAS, the Purchasing Agent has determined that only one responsible source exists for the 15KV electrical switch gear power control center manufactured by Powell, which is the particular equipment required to maintain interchangeable and compatible breakers and relays throughout the City's electrical system; and WHEREAS, the Purchasing Agent has submitted the requisite justification for said determination to the City Manager for approval; and WHEREAS, the City Manager has reviewed and approved the justification for this acquisition; and WHEREAS, Section 8-161(d)(3) requires approval of this purchasing method by City Council for items costing more than One Hundred Thousand Dollars($100,000)prior to acquisition. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Purchasing Agent is hereby authorized to contract with Powell Electrical, Manufacturing to purchase a 15 KV electrical switchgear power control center in an amount not to exceed$1,224,445.50.
