Second Reading of Ordinance No. 25, 2001, Authorizing the Mayor to Quit Claim a Parcel
Originally Acquired for Poudre River Drive to General Care Health Services, Inc.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY:
Ordinance No. 25, 2001, which was unanimously adopted on First Reading on February 6, 2001,
authorizes the conveyance of property to GeneralCare Health Services,Inc. ("GHS") to conform to
the alignments of Poudre River Drive and Hoffman Mill Road.

EXECUTIVE SUMMARY:
In 1979,the City purchased bVwarrant deed,right-of way for the extension of Lemay Avenue from
Riverside Avenue to Lincoln me e e r se right-of-way for the connection
of Hoffman Mill Road to LeIn the late 1980's, Hoffmaad was rea tgned into two distinct roadways with the
development of the Poudre River Business Park, 1st Filing. The 1st Filing realigned a portion of
Hoffman Mill Road (the "Road") to intersect Lemay Avenue at a right angle. This portion of the
Road was also renamed Poudre River Drive (the "Drive"). At the termination of the Drive,
approximately 260'east of Lemay, Hoffman Mill Road was realigned to intersect the Drive at a right
angle.

adjusted to reflect the approved changes shown on the 1st Filing Plat. In order to accommodate the
1 st Filing alignments for the Drive and the Road, staff is recommending that City Council approve
the conveyance by Quit Claim Deed a portion of the right-of-way acquired by the City in 1979 to
the owner of Poudre River Business Park. As part of the planning process, the owner has agreed to
dedicate by plat the additional right-of-way needed for the continuation of Hoffman Mill Road, and
the Ordinance makes the conveyance to the owner contingent upon completion of that dedication.
Staff is recommending that no further consideration be requested for the property to be deeded to the
owner, because the voluntary dedication by the owner of the additional right-of-way results in a
reasonable exchange.
