First Reading of Ordinance No. 25, 2001, Authorizing the Mayor to Quit Claim a Parcel Originally
Acquired For Poudre River Drive to General Care Health Services, Inc.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY:
In 1979,the City purchased by warranty deed,right-of way for the extension of Lemay Avenue from
Riverside Avenue to Lincoln Avenue. This included the purchase of right-of-way for the connection
of Hoffman Mill Road to Lemay Avenue.
In the late 1980's, Hoffman Mill Road was realigned into two distinct roadways with the
development of the Poudre River Business Park, 1st Filing. The 1st Filing realigned a portion of
Hoffman Mill Road (the "Road") to intersect Lemay Avenue at a right angle. This portion of the
Road was also renamed Poudre River Drive (the "Drive"). At the termination of the Drive,
approximately 260'east of Lemay,Hoffman Mill Road was realigned to intersect the Drive at a right
angle.
Although the realignments mentioned above were accomplished by the Poudre River Business Park,
1st Filing, it was discovered during the planning process for the development of Poudre River
Business Park, Third Filing, that the portion of Hoffman Mill Road obtained in 1979 was never
adjusted to reflect the approved changes shown on the 1st Filing Plat. In order to accommodate the
1 st Filing alignments for the Drive and the Road, staff is recommending that City Council approve
the conveyance by Quit Claim Deed a portion of the right-of-way acquired by the City in 1979 to
the owner of Poudre River Business Park. As part of the planning process, the owner has agreed to
dedicate by plat the additional right-of-way needed for the continuation of Hoffman Mill Road, and
the Ordinance makes the conveyance to the owner contingent upon completion of that dedication.
Staff is recommending that no further consideration be requested for the property to be deeded to the
owner, because the voluntary dedication by the owner of the additional right-of-way results in a
s reasonable exchange.
ORDINANCE NO. 25 , 2001
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO QUIT CLAIM A PARCEL ORIGINALLY
ACQUIRED FOR POUDRE RIVER DRIVE
TO GENERAL CARE HEALTH SERVICES, INC.
WHEREAS, the City of Fort Collins is the owner of that certain parcel of real property
located in Fort Collins, Larimer County, Colorado, consisting of 5,009 square feet, and more
particularly described on Exhibit "A", attached hereto and incorporated herein by this reference,
which property was previously acquired by the City for use as the planned location of Poudre River
Drive (the "Property"); and
WHEREAS, GeneralCare Health Services, Inc. ("GHS") is the owner of a parcel of real
property needed for.Hoffman Mill Road described on the Plat of Poudre River Business Park, 3rd
Filing, which plat is on file in office of the City Clerk and available for review (the "Plat'); and
WHEREAS, in order to conform to the alignments of Poudre River Drive and Hoffman Mill
Road as shown on Poudre River Business Park, 1st and 3rd Filings, and allow for development to
proceed as platted, GHS has requested that the City convey to GHS the Property; and
WHEREAS, as part of the planning process, GHS has agreed to dedicate on the Plat
alternative right-of-way for the planned realigned location of Hoffman Mill Road that will better
. accommodate traffic circulation in the area,and will better enable the City to construct that road in
accordance with current design standards; and
WHEREAS, the new right-of-way to be dedicated by GHS, as shown on the Plat, is being
dedicated voluntarily, and City staff has advised the Council that said new right-of-way constitutes
reasonable consideration for the conveyance of the Property to GHS; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell, convey or otherwise dispose of real property owned by the City, provided the Council first
finds by ordinance that any sale or other disposition of real property owned by the City is in the best
interest of the City of Fort Collins.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the conveyance of the Property to GHS in exchange for the dedication
by GHS of new right-of-way needed to realign Hoffman Mill Road is in the best interest of the City
of Fort Collins.
Section 2. That the Mayor is hereby authorized to execute a quit claim deed as is
necessary for the City to sell and convey the Property on the terms and conditions described above,
contingent upon the recordation of the Plat, or the conveyance to the City of the property required
• for the realignment of Hoffman Mill Road.
Introduced, considered favorably on first reading, and ordered published this 6th day of
February,A.D. 2001, and to be presented for final passage on the 20th day of February,A.D. 2001.

described as considering the West line of the said Northwest 1/4 as bearing S00°22'55"W and with
all bearings contained herein relative thereto is contained within the boundary lines which begin at
