SUBJECT:
First Reading of Ordinance No. 16, 2001, Appropriating Prior Year Reserves in the Street
Oversizing Fund and Unanticipated Revenue in the Capital Projects Fund and Authorizing the
Transfer of Appropriations from the Street Oversizing Fund to the Capital Projects Fund for the
Harmony and Timberline Roadway Project.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.

FINANCIAL IMPACT:
This Ordinance appropriates$360,000 in prior year reserves from Contributions
in Aid of Construction received last year from Dial Properties, and transfers that amount, together with an additional
$2,514,531 (totaling $3,414,276) from the Street Oversizing Fund, into the Capital Projects Fund, and appropriates
unanticipated revenue in the form of Contributions in Aid received from Poudre Valley Hospital in the Capital
Projects Fund, all to be used to construct arterial roadway improvements for the Timberline and Harmony Roadway
110 Improvements.This project will go to bid as soon as funds are available. Funds will be appropriated as follows:
Dial Properties $360,000.00 Contribution In Aid
Poudre Valley Hospital $539,745.00 Contribution In Aid
Street Oversizing Fund $2,514,531.00 Street Oversizing Fund
EXECUTIVE SUMMARY:
Arterial street improvements are planned for the Harmony Road-Timberline Road intersection.
These intersection improvements will construct additional auxiliary turn lanes on all legs of the
intersection. These improvements are needed to mitigate the traffic impacts of the commercial
and hospital developments. Harmony Road will also be improved from the Union Pacific
Railroad tracks on the west end of the project, east to the Poudre Valley Hospital (PVH) entrance
on Harmony Road (Approximately 4000 linear feet). This project is funded entirely by
contributing developments, through the Street Oversizing Program.
BACKGROUND:
Over the past two years staff has completed the design of the Harmony and Timberline Roadway
Project. The Colorado Department of Transportation has worked with City staff to coordinate
improvements on Harmony Road (State Highway 68) to meet the State's highway standards.
The improvements will widen the Harmony-Timberline intersection to include double left turn
lanes and dedicated right turn lanes on all legs of the intersection. Landscaped medians will be
installed to provide access control, and a new signal will be installed at the Timberline-
] Timberwood intersection. The improvements will also widen Harmony Road from the Union
Pacific Railroad tracks east to the PVH entrance on Harmony Road. The project is planned to

begin construction in the spring of 2001, with final completion and landscaping to be completed
in the fall of 2001.
ORDINANCE NO. 16, 2001
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE STREET OVERSIZING FUND
AND UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND
AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE STREET
OVERSIZING FUND TO THE CAPITAL PROJECTS FUND FOR THE HARMONY AND
TIMBERLINE ROADWAY PROJECT
WHEREAS,improvements are needed at the intersection of Timberline Road and Harmony
Road in order to mitigate the traffic impacts resulting from the increased development in this area,
including recent commercial and hospital developments, and to comply with standards required by
the Colorado Department of Transportation; and
WHEREAS, City staff has been working on the design plans for improvements to the
aforementioned intersection of Timberline Road and Harmony Road, including construction of
double left turn lanes on all legs of the intersection, installation of landscaped medians to provide
access control, installation of a new traffic signal at the intersection of Timberline Road and
Timberwood Drive, and widening Harmony Road from the Union Pacific Railroad tracks, east to
the Poudre Valley Hospital entrance on Harmony Road (the "Project'); and
WHEREAS, the estimated cost of the Project is $3,414,276, and funds are available in the
form of existing appropriations ($2,514,531) in the Street Oversizing Fund, prior year reserves
previously received in the Street Oversizing Fund,contributions from a developer in the vicinity of
the Project($360,000),and unanticipated revenue in the Capital Projects Fund received from Poudre
Valley Hospital for its share of the proposed improvements ($539,745); and
WHEREAS, upon completion of the bid process, the Project is expected to begin in the
spring of 2001, with final completion and landscaping scheduled for fall of 2001; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter")
permits the Council to appropriate by ordinance at any time during the fiscal year such funds for
expenditure as may be available from reserves accumulated in prior years,notwithstanding that such
reserves were not previously appropriated; and
WHEREAS, Article V, Section 9, of the Charter also permits the Council to make
supplemental appropriations by ordinance at any time during the fiscal year, provided that the total
amount of such supplemental appropriations,in conjunction with all previous appropriations for that
fiscal year, do not exceed the current estimate of actual and anticipated revenues to be received
during the fiscal year; and
WHEREAS, Article V, Section 10, of the Charter authorizes the Council to transfer by
ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital
project to another fund or capital project,provided that the purpose for which the transferred funds
• are to be expended remains unchanged; and
WHEREAS,it is the desire of the Council to appropriate$360,000 from prior year reserves
in the Street Oversizing Fund and authorize the transfer of said amount, along with existing
appropriations totaling $2,514,531 from the Street Oversizing Fund to the Capital Projects Fund,
and to appropriate $539,745 in unanticipated revenue in the Capital Projects Fund, representing a
contribution from Poudre Valley Hospital,to be used to construct improvements at the intersection
of Timberline Road and Harmony Road.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from prior year reserves in the Street Oversizing
Fund for transfer to the Capital Projects Fund, Timberline and Harmony Roadway Project and
appropriated therein the sum of THREE HUNDRED SIXTY THOUSAND DOLLARS ($360,000)
to be used to construct improvements at the intersection of Timberline Road and Harmony Road.
Section 2. That the unexpended appropriated amount of TWO MILLION FIVE HUNDRED
FOURTEEN THOUSAND FIVE HUNDRED THIRTY-ONE DOLLARS ($2,514,531) is hereby
authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund,Timberline and
Harmony Roadway Project and appropriated therein to be used to construct improvements at the
intersection of Timberline Road and Harmony Road.
Section 3. That there is hereby appropriated for expenditure from unanticipated revenue in
.the Capital Project Fund,Timberline and Harmony Roadway Project,the sum of FIVE HUNDRED
THIRTY-NINE THOUSAND SEVEN HUNDRED FORTY-FIVE DOLLARS ($539,745)
representing a contribution from Poudre Valley Hospital, to be used to construct improvements at
the intersection of Timberline Road and Harmony Road.
Introduced and considered favorably on first reading and ordered published this 6th day of
February, A.D. 2001,and to be presented for final passage on the 20th day of February, A.D. 2001.
