SUBJECT: First Reading of Ordinance No. 201, 2001, Appropriating Prior Year Reserves Designated
for Community Park Improvements in the Capital Improvement Expansion Fund and Neighborhood
Parkland Fund Prior Year Reserves for Transfer to the Building Community Choices Capital Projects
Fund Fossil Creek Community Park Capital Project for Use With Existing Appropriations to Construct a
Maintenance Facility.
RECOMMENDATION:
Staff recommends the adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
This Ordinance appropriates and transfers $75,000 from prior year reserves in the Neighborhood
Parkland Fund and $105,000 from prior year reserves designated for community park
improvements in the Capital Improvement Expansion Fund to the Fossil Creek Community Park
110 capital project. Funding for operation and maintenance of this facility has been included in the
General Fund budget for 2003.
EXECUTIVE SUMMARY:
Neighborhood and community park impact fees are assessed on new residential dwellings and
these fees are used to build new neighborhood and community park improvements described in
the current approved plan. The current Parks and Recreation Policy Plan identifies the need for
central maintenance facilities for these neighborhood and community parks. Fossil Creek
Community Park will have a maintenance facility that will be used to maintain that park, and
will also be used to maintain a future 50-acre community park and seven neighborhood parks in
the southeast area of the city. Funding for Fossil Creek Community Park cannot be use to pay
for the maintenance facilities for the other parks because this funding was approved by the voters
for Fossil Creek Park. The neighborhood and community park impact fees for maintenance
facilities will be used to enlarge the maintenance facility at Fossil Creek Park. The larger facility
will provide adequate space to store equipment and materials for the other southeast parks and to
accommodate the needs of the crews that will maintain those parks. Enlarging the Fossil Creek
maintenance facility is the most efficient, cost-effective way to provide maintenance facilities
for these southeast parks.
Adoption of this Ordinance appropriates a total of$180,000 from neighborhood and community
park impact fee revenues to enlarge the maintenance facility at Fossil Creek Park so it can be
used to maintain other parks in the southeast area of the city.
ORDINANCE NO. 201, 2001
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES
DESIGNATED FOR COMMUNITY PARK IMPROVEMENTS IN THE CAPITAL
IMPROVEMENT EXPANSION FUND AND NEIGHBORHOOD PARKLAND FUND PRIOR
YEAR RESERVES FOR TRANSFER TO THE BUILDING COMMUNITY CHOICES
CAPITAL PROJECTS FUND FOSSIL CREEK COMMUNITY PARK CAPITAL PROJECT
FOR USE WITH EXISTING APPROPRIATIONS TO CONSTRUCT A MAINTENANCE
FACILITY
WHEREAS,the current Parks and Recreation Policy Plan,which was approved by the City
Council with the adoption of Resolution 96-146 in December 1996, recommends that community
parks be developed at a standard of 4.5 acres per 1,000 population; and
WHEREAS, the Parks and Recreation Policy Plan identifies the need for centralized
maintenance facilities for the future 50-acre community park and seven neighborhood parks planned
for the southeast area of the City; and
WHEREAS, included in the Building Community Choices Capital Improvement Plan for
Natural Areas and Parks, approved by voters at a Municipal Election on April 8, 1997, is
development and construction of Fossil Creek Community Park; and
WHEREAS,improvements at the 99-acre Fossil Creek Community Park,located on Lemay
Avenue south of Harmony Road across the street west of Southridge Golf Course will include
lighted ballfields, shelters, playgrounds, multi-use turf areas, restrooms, sidewalks, water features,
basketball and tennis courts,multi-use courts,parking lots,a maintenance facility,and landscaping;
and
WHEREAS, staff recommends constructing a maintenance facility at Fossil Creek
Community Park that is larger than originally planned for that Park, in order to serve a future 50-
acre community park and seven neighborhood parks planned for the southeast area of the City; and
WHEREAS, a larger maintenance facility at Fossil Creek Community Park is an efficient,
cost-effective way to provide maintenance facilities for existing and future park sites in southeast
Fort Collins; and
WHEREAS,neighborhood and community park impact fees are assessed on new residential
dwellings and are used to build new neighborhood and community parks, including maintenance
facilities needed to care for those parks; and
WHEREAS, additional funds are available for appropriation from prior year reserves
designated for community park improvements in the Capital Improvement Expansion Fund
($105,000) and Neighborhood Parkland Fund prior year reserves ($75,000); and
WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins(the"Charter")
permits the City Council to appropriate by ordinance at any time during the fiscal year such funds
for expenditure as may be available from reserves accumulated in prior years,notwithstanding that
such reserves were not previously appropriated; and
WHEREAS, it is the desire of the Council to appropriate the sum of$180,000 from prior
year reserves designated for community park improvements in the Capital Improvement Expansion
Fund($105,000)and Neighborhood Parkland Fund prior year reserves($75,000)for transfer to the
Building Community Choices Capital Projects Fund for Natural Areas and Parks to be used to
construct a larger maintenance facility at Fossil Creek Community Park.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from prior year reserves designated for
community park improvements in the Capital Improvement Expansion Fund, the sum of ONE
HUNDRED FIVE THOUSAND DOLLARS($105,000)for transfer to the Fossil Creek Community
Park project,within the Building Community Choices Capital Projects Fund for Natural Areas and
Parks, to be used to construct a larger maintenance facility at Fossil Creek Community Park.
Section 2. That there is hereby appropriated from prior year reserves in the Neighborhood
Parkland Fund,the sum of SEVENTY-FIVE THOUSAND DOLLARS($75,000)for transfer to the
Fossil Creek Community Park project, within the Building Community Choices Capital Projects
Fund for Natural Areas and Parks, to be used to construct a larger maintenance facility at Fossil
Creek Community Park.
Introduced and considered favorably on first reading and ordered published this 20th day of
