SUBJECT:
Items Relating to the Mulberry Street(SH14) Bicycle/Pedestrian Bridge Project.
RECOMMENDATION:
Staff recommends adoption of the Resolution and the Ordinance on First Reading.
FINANCIAL IMPACT:
Additional appropriations,totaling$385,730, are needed to complete construction of the bicycle/pedestrian bridge across
the Poudre River on the south side of Mulberry Street, and to complete the bicycle/pedestrian connection from Riverside
Avenue to Lemay Avenue. The Colorado Department of Transportation has approved a grant project of an additional
$210,000, including$173,859 in federal funds and a required local match of$36,141, for this project from its Congestion
Mitigation and Air Quality (CMAQ) program. The following is a summary of the federal and local portions for these
funds:

Transportation Services intends to use Transportation Reserves to cover the local match portion of this project. The total
funds available for this project, including this additional $385,730 is$998,007.
EXECUTIVE SUMMARY:
A. Resolution 2001-110 Authorizing the Mayor to Enter into a Contract with the Colorado
Department of Transportation for Partial Construction Funding of the Mulberry Street
Bicycle/Pedestrian Bridge Project.
B. First Reading of Ordinance No. 140, 2001, Appropriating Unanticipated Revenue and
Prior Year Reserves in the Transportation Services Fund to be Used to Complete
Construction of a Bicycle/Pedestrian Bridge Over the Poudre River, Completing the
Bicycle/Pedestrian Connection from Riverside to Lemay Along State Highway 14.
The City has received a funding letter from Colorado Department of Transportation (CDOT)
allowing for additional funding to be added to the State Highway 14 and Lemay Avenue
Intersection project. The bridge will be constructed over the Poudre River on the south side of
the Mulberry Street (SH14) vehicular bridge and the sidewalk will be extended from Lemay to
Riverside.
Design work has been completed and these funds would be added to the construction budget for
this project. In addition to the bridge, the City is also constructing sidewalk along the south side

of Mulberry Street in order to provide a safe and direct bicycle/pedestrian connection from
Riverside Avenue to Lemay Avenue.
BACKGROUND:
This bicycle/pedestrian bridge and sidewalk project was originally part of the Mulberry/Lemay
intersection project and was funded by CMAQ funds as well as a contribution from the
Mulberry-Lemay Crossing. This bicycle/pedestrian project was part of the development
approval process in order to provide connectivity from the neighborhoods on the west side of the
Poudre River to the new Wal-Mart shopping center as well as to other locations along the
Mulberry corridor. When the decision was made to proceed with the conventional, signalized
intersection design, the developer's contractor(s) took over the intersection improvement project.
City staff retained the bicycle/pedestrian improvement project along Mulberry and has completed
the design work for this project. The project is ready to proceed to construction and will be
completed by late 2001.
The Mulberry pedestrian/bicycle improvements will not impact the recent roadway and
intersection improvements that'are being constructed as part of the Mulberry-Lemay Crossing
project.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH
THE COLORADO DEPARTMENT OF TRANSPORTATION FOR
PARTIAL CONSTRUCTION FUNDING OF THE MULBERRY STREET
BICYCLE/PEDESTRIAN BRIDGE PROJECT
WHEREAS,pursuant to the Transportation Equity Act of the 21 st Century of 1998,certain
funds have been allocated for highway projects,under the Congestion Mitigation and Air Quality
(CMAQ)program,that have been proposed by the Colorado Department of Transportation(CDOT)
and approved by the Federal Highway Administration; and
WHEREAS, certain CMAQ Project funds are made available only for eligible "congestion
mitigation and air quality improvement" and those activities are defined in §23 U.S.C. 101(a);and
WHEREAS, the City has requested of CDOT that the Mulberry Street Bicycle/Pedestrian
Bridge Project across the Poudre River on the south side of Mulberry Street (State Highway 14)
completing the bicycle/pedestrian connection from Riverside Avenue to Lemay Avenue (the
"Project") be funded in part under the CMAQ program, as a congestion mitigation and air quality
activity; and
WHEREAS,the estimated cost to design and construct the Project is $998,007; and
WHEREAS,additional appropriations,totaling$385,730 are needed to complete the Project;
and
WHEREAS,CDOT has made available to the City,CMAQ funds in the amount of$173,859,
to be used for completion of the Project; and
WHEREAS, necessary local matching funds associated with the CDOT contract, totaling
$36,141, have been identified, and are available in the form of prior years reserves in the
Transportation Services Fund; and
WHEREAS,the remaining appropriations needed to construct the Project,totaling$175,730,
will also come from prior year reserves in the Transportation Services Fund; and
WHEREAS, CDOT has presented to the City for execution a congestion mitigation and air
quality contract for the purpose of providing additional funding for the Project in the amount of
$210,000 to be funded with federal participating funds in the amount of$173,859 and with City
participating funds in the amount of$36,141; and
WHEREAS, the Council has determined that it is in the best interests of the City that the
proposed congestion mitigation and air quality contract as above-described be entered into between
the City and CDOT.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and hereby is,authorized to execute a congestion mitigation and air
quality contract between the City and the Colorado Department of Transportation for the purpose
of providing additional funding for the construction of the Project, with said contract to provide
federal participating funds in the sum of ONE HUNDRED SEVENTY-THREE THOUSAND
EIGHT HUNDRED FIFTY-NINE DOLLARS ($173,859)and City participating funds in the sum
of THIRTY-SIX THOUSAND ONE HUNDRED FORTY-ONE DOLLARS ($36,141) for a total
amount of TWO HUNDRED TEN THOUSAND DOLLARS ($210,000).
Passed and adopted at a regular meeting of the City Council held this 18th day of September,

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE AND PRIOR YEAR RESERVES
IN THE TRANSPORTATION SERVICES FUND TO BE USED TO COMPLETE
CONSTRUCTION OF A BICYCLE/PEDESTRIAN BRIDGE OVER THE POUDRE RIVER
COMPLETING THE BICYCLE/PEDESTRIAN CONNECTION
FROM RIVERSIDE TO LEMAY ALONG STATE HIGHWAY 14
WHEREAS,in the fall of 1999,the City applied for and received a grant from the Colorado
Department ofTransportation("CDOT")for Congestion Mitigation&Air Quality("CMAQ")funds
for the purpose of providing an alternative analysis of intersection improvements and construction
of those improvements as determined at State Highway 14 and Lemay Avenue; and
WHEREAS, the scope of the improvements scheduled for the aforementioned project
included the design and construction of a bicycle/pedestrian bridge across the Poudre River,on the
south side of Mulberry Street (State Highway 14), completing the bicycle/pedestrian connection
from Riverside Avenue to Lemay Avenue; and
WHEREAS,the estimated cost to design and construct the bicycle/pedestrian bridge across
the Poudre River and complete the existing bicycle/pedestrian connection from Riverside Avenue
to Lemay Avenue is $998,007; and
WHEREAS, additional appropriations, totaling $385,730 are needed to complete the
aforementioned improvements; and
WHEREAS, the Colorado Department of Transportation("CDOT")has made available to
the City of Fort Collins, Congestion Mitigation& Air Quality funds in the amount of$173,859,to
be used for the completion of a bicycle/pedestrian bridge across the Poudre River and complete the
bicycle/pedestrian connection from Riverside Avenue to Lemay Avenue ; and
WHEREAS, local matching funds needed associated with the CDOT contract, totaling
$36,141, have been identified, and are available in the form of prior year reserves in the
Transportation Services Fund; and
WHEREAS, the remaining appropriations needed to construct the improvements, totaling
$175,730,will also come from prior year reserves in the Transportation Services Fund; and
WHEREAS, the City Council adopted Resolution 2001-110, on September 18, 2001,
authorizing the City to enter into an intergovernmental agreement with CDOT for the receipt of
Congestion Mitigation & Air Quality funds to be used to complete construction of the
bicycle/pedestrian bridge across the Poudre River on the south side of Mulberry Street and complete
the bicycle/pedestrian connection from Riverside Avenue to Lemay Avenue; and
WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins(the"Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS,Article V,Section 9,of the Charter also permits the City Council to appropriate
by ordinance at any time during the fiscal year such funds for expenditure as may be available from
reserves accumulated in prior years, notwithstanding that such reserves were not previously
appropriated; and
WHEREAS,it is the desire of the Council to appropriate the sum of$173,859 in Colorado
Department of Transportation Congestion Mitigation&Air Quality funds,and$211,871 from prior
year reserves in the Transportation Services Fund to be used to complete construction of the
bicycle/pedestrian bridge across the Poudre River on the south side of Mulberry Street and complete
the bicycle/pedestrian connection from Riverside Avenue to Lemay Avenue.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue
in the Transportation Services Fund,State Highway 14 and Lemay Avenue Intersection project,the
sum of ONE HUNDRED SEVENTY-THREE THOUSAND EIGHT HUNDRED FIFTY-NINE
DOLLARS($173,859)from Colorado Department ofTransportation Congestion Mitigation and Air
Quality funds,to be used to complete construction ofthe bicycle/pedestrian bridge across the Poudre
River on the south side of Mulberry Street and complete the bicycle/pedestrian connection from
Riverside Avenue to Lemay Avenue.
Section 2. That there is hereby appropriated from prior year reserves in the
Transportation Services Fund, State Highway 14 and Lemay Avenue Intersection project,the sum
of TWO HUNDRED ELEVEN THOUSAND EIGHT HUNDRED SEVENTY-ONE DOLLARS
($211,871) to be used to complete construction of the bicycle/pedestrian bridge across the Poudre
River on the south side of Mulberry Street and complete the bicycle/pedestrian connection from
Riverside Avenue to Lemay Avenue.
