SUBJECT:
First Reading of Ordinance No. 117, 2001, Vacating a Portion of the Right-of-Way for Richards
Lake Road Adjacent to the Richards Lake P.U.D. First Filing.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY:
This Ordinance vacates the north 15 feet of street right-of-way for Richards Lake Road which
was dedicated by document recorded in Book 2273, Page 218 of the Larimer County Clerk and
Recorder. The right-of-way for this street is not needed as the street has been classified a local
residential street. A portion of Richards Lake Road has been built to County street standards and
will be improved to meet City local street standards. The vacation of this street was prompted
by the submittal of the Richards Lake P.U.D First Filing development in this area. Since there
are currently utilities and drainage facilities within the street right-of-way, a utility and drainage
easement will be retained.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE RIGHT-OF-WAY
FOR RICHARDS LAKE ROAD ADJACENT TO THE RICHARDS
LAKE P.U.D. FIRST FILING
WHEREAS, Larimer County has established, and received dedication of, certain right-
of-way widths for Richards Lake Road; and
WHEREAS, the Planning and Zoning Board has approved a final plan for a project
entitled"Richards Lake P.U.D. First Filing"; and
WHEREAS, the approval of the Richards Lake P.U.D. First Filing requires the vacation
of 15 feet of right-of-way for Richards Lake Road, as established by Larimer County, which
right-of-way to be vacated is more particularly described on Exhibit "A," attached hereto and
incorporated herein by this reference; and
WHEREAS, said 15 feet of the Richards Lake Road right-of-way is no longer necessary
or desirable to retain for access purposes, because the roadway has been classified as a City
residential street; and
• WHEREAS,pertinent City agencies have been contacted and reported no objection to the
proposed vacation, provided that the vacated portion of the right-of-way be maintained as a
dedicated drainage and utility easement; and
WHEREAS, the right of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said street right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS that the portion of street right-of-way for Richards Lake Road, more
particularly described on Exhibit "A," is hereby vacated, abated and abolished reserving to the
City of Fort Collins such vacated right-of-way as a drainage and utility easement.
Introduced, considered favorably on first reading, and ordered published this 17th day of
July, A.D.2001, and to be presented for final passage on the 21st day of August, A.D. 2001.
