Resolution 2001-156 Approving the Execution of an Agreement to Modify and Amend an
Intergovernmental Agreement Concerning the Implementation of an "E911" Emergency
Telephone Service.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The City of Fort Collins is a party to an Intergovernmental Agreement ("IGA") dated November
14, 1990 which established a separate legal entity called the Larimer Emergency Telephone
Authority ("LETA"). LETA is responsible for administering the operation of the emergency
telephone service program (911) and defining the manner in which each of the parties will
participate in the authority.
On July 16, 2001, the LETA Board of Directors approved an agreement to modify and amend
the original IGA. The proposed modification will add the towns of Windsor and Johnstown as
signatories to the IGA with regard to those portions of Larimer County now included within the
respective boundaries of those municipalities. It also provides for representation for Windsor
and Johnstown on the Larimer Emergency Telephone Authority (LETA) Board through the
members designated in the IGA as representatives of the small towns in Larimer County that are
signatories to the IGA. The Council approved similar changes in 1999, which added the
Windsor-Severence Fire Protection District and Colorado State University as signatories to the

RESOLUTION 2001-156
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE EXECUTION OF AN AGREEMENT TO MODIFY AND AMEND AN
INTERGOVERNMENTAL AGREEMENT CONCERNING THE IMPLEMENTATION OF
AN"E911"EMERGENCY TELEPHONE SERVICE
WHEREAS, the Larimer Emergency Telephone Authority ("LETA") was created
pursuant to § 29-11-101, et. Seq., C.R.S., by an Intergovernmental Agreement Concerning the
Implementation of an "E911" Emergency Telephone Service, dated November 14, 1990 between
certain governmental entities located in Larimer County, Colorado (the"E911 Agreement"); and
WHEREAS, the LETA Board of Directors has approved an Agreement to Modify and
Amend the E911 Agreement to:
1. add the towns of Windsor and Johnstown as signatories to the E911
Agreement with regard to those portions of Larimer County now included
within the respective boundaries of those municipalities;and
2. provide for representation for Windsor and Johnstown on the LETA Board
through the members designated in the E911 Agreement as the
representatives of the small towns in Larimer County that are signatories
to the IGA;
and;
WHEREAS, the E911 Agreement allows for amendment by the parties upon agreement
of all the parties, but any amendment shall be in writing and executed by all the parties; and
WHEREAS, the City Council believes that the foregoing changes are in the best interests
of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS that the Agreement to Modify and Amend Intergovernmental Agreement
Concerning the Implementation of an "E911" Emergency Telephone Service, a copy of which is
attached hereto as Exhibit "A" and incorporated herein by this reference, is hereby approved by
the Council, and the Mayor is hereby authorized to execute the Agreement, subject to such
changes in form or substance as the City Manager may, in consultation with the City Attorney,
consider to be necessary to effectuate the purposes of this Resolution.
Passed and adopted at a regular meeting of the City Council held this 20th day of
November, A.D. 2001.

AGREEMENT TO MODIFY AND AMEND
INTERGOVERNMENTAL AGREEMENT
CONCERNING THE IMPLEMENTATION OF AN
"E911" EMERGENCY TELEPHONE SERVICE
THIS AGREEMENT is made and entered into this day of
20_, by and between the signatories to that certain Intergovernmental Agreement Concerning
the Implementation of an "E911" Emergency Telephone Service.
WITNESSETH:
WHEREAS, with the exception of the Town of Johnstown, Colorado, hereinafter referred
to as "Johnstown," and the Town of Windsor, Colorado, hereinafter referred to as "Windsor,"
all of the parties hereto are signatories to that certain Intergovernmental Agreement dated
November 14, 1990, and the Agreement to Modify and Amend Intergovernmental Agreement
Concerning the Implementation of an "E911" Emergency Telephone Service dated July 7, 1999;
and
WHEREAS, since the date of the adoption of the Intergovernmental Agreement dated
November 14, 1990, and the aforesaid Agreement to Modify and Amend dated July 7, 1999,
Johnstown and Windsor have extended their boundaries by annexation into portions of
unincorporated Larimer County; and
WHEREAS, by their approval of this Agreement, Johnstown and Windsor desire to
become signatories to the Intergovernmental Agreement dated November 14, 1990, and the
Agreement to Modify and Amend dated July 7, 1999;
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
HEREINAFTER SET FORTH, THE PARTIES AGREE AS FOLLOWS:
1. Town of Johnstown. Colorado. Johnstown is a Colorado statutory municipality
principally located in Weld County, Colorado. Johnstown has extended its boundaries by
annexation into certain portions of unincorporated Latimer County. Johnstown has petitioned for
inclusion in the Latimer Emergency Telephone Authority for those areas of Larimer County that
are now part of the Town of Johnstown. By the terms hereof, Johnstown shall become a signatory
to the Intergovernmental Agreement dated November 14, 1990, and the Agreement to Modify and
Amend dated July 7, 1999, and shall be represented on the Latimer Emergency Telephone
Authority Board through the members designated to represent the towns in Larimer County.

2. Town of Windsor Colorado. Windsor is a Colorado statutory municipality
principally located in Weld County, Colorado. Windsor has extended its boundaries by
annexation into certain portions of unincorporated Latimer County. Windsor has petitioned for
inclusion in the Larimer Emergency Telephone Authority for those areas of Larimer County that
are now part of the Town of Windsor. By the terms hereof, Windsor shall become a signatory
to the Intergovernmental Agreement dated November 14, 1990,and the Agreement to Modify and
Amend dated July 7, 1999, and shall be represented on the Larimer Emergency Telephone
Authority Board through the members designated to represent the towns in Larimer County.
3. Emergency Service Authority Board. Paragraph III.A of the Intergovernmental
Agreement dated November 14, 1990, shall be amended to read as follows:
A. The governing board for the Authority consists of seven(7)members:two
representing the cities of Fort Collins and Loveland; two representing the towns of
Berthoud, Estes Park, Johnstown, Timnath, Wellington, and Windsor; one representing
the hospital districts; one representing the fire districts; and one representing Larimer
County.
Paragraph III.C.2 of the Intergovernmental Agreement dated November 14, 1990, shall
be amended to read as follows:
2. The towns of Berthoud, Estes Park, Johnstown, Timnath,
Wellington, and Windsor shall each nominate one person. The two members from the
towns shall be selected from among those nominees by a simple majority vote of the six
entities. The Board of County Commissioners shall make the appointments in accordance
with that majority vote.
4. Signatures in Counterparts. It is agreed that this Agreement to Modify and Amend
may be signed in counterparts, but it shall not become effective until all existing signatories to the
Intergovernmental Agreement dated November 14, 1990, and Johnstown and Windsor have
acknowledged approval.

to affix their respective signatures hereto.
