RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT The lease will generate $350 per month. The tenant will pay for all utilities. Maintenance will be handled by the Facility Attendant. EXECUTIVE SUMMARY Primrose Studio,consisting of a house and 21 acres of land,is now a part of Reservoir Ridge Natural Area. It was donated to the Natural Areas Program with the condition that it be used as a nature education classroom and as a low cost meeting space for non-profit groups. The studio has recently been remodeled and is now available for use. As part of this effort, a Facility Attendant was hired to manage the studio and as a condition of employment, is required to reside in and occupy the house located on site. The Facility Attendant will pay rent monthly at the rate of three hundred and fifty dollars($350)per month. This rental rate is a 50%reduction from the fair market value rental rate and is provided due to the requirement that the Facility Attendant must reside in and occupy the Premises. Also, the Facility Attendant will be required to perform job duties that may at times interrupt off-duty personal activities. In addition to rent, the Facility Attendant will be responsible for payment of all utilities, including but not limited to electricity, personal telephone, water, trash, and cable television. The Facility Attendant will be required to vacate the premises if he/she is no longer in this designated position. ATTACHMENTS 1. Location Map. ' 'ill • ir` ' ' � L L5S _ �J T ' phirR' rrr J Y ml � � t• YYY 4 3 jr.t M1k4 y IN RESERVOIR RIDGE NSA . t#1Irtr 5 {: 1 F._ ;—` no L O v Location of Residence at Reservoir Fridge f 1 ' a ORDINANCE NO. 152, 2007 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF A RESIDENCE ON CITY-OWNED PROPERTY AT RESERVOIR RIDGE NATURAL AREA TO THE FACILITY ATTENDANT FOR UP TO FIVE YEARS WHEREAS, the City of Fort Collins is the owner of the property known as the Reservoir Ridge Natural Area, located in Larimer County, Colorado (the"Natural Area"); and WHEREAS, the Natural Area includes the Primrose Studio,which was donated to the City on condition that it be used as a nature education classroom and low-cost meeting space, and a residence located at 4300 West County Road 50 (the"Residence"); and WHEREAS,on November 15,2005,the Council approved Resolution 2005-120 authorizing the lease of the Residence to the then-current tenant, Timothy L. LaBaw, for up to two years; and WHEREAS, Natural Areas staff has since hired Mr. LaBaw to serve as Facility Attendant for the Primrose Studio; and WHEREAS, as a condition of employment, the Facility Attendant is required to live on the property, in the Residence; and WHEREAS, the continued rental of the Residence by the Facility Attendant will generate income for the Natural Areas fund as well as provide an on-site overseer for the Primrose Studio, the Residence and the surrounding Natural Area; and WHEREAS, staff has negotiated an agreement for the employment of the Facility Attendant and the lease of the Residence to the current Facility Attendant, Timothy L. LaBaw, for a period of at least one year,beginning as of November 1,2007, at a monthly lease rate of$350,with the option to renew for up to four additional one-year periods; and WHEREAS, the Facility Attendant would also be responsible for the cost of all utilities for the Residence; and WHEREAS, under Section 23-111(a) of the Code of the City of Fort Collins, the City Council is authorized to sell, convey or otherwise dispose of any and all interests in real property owned in the name of the City provided that the Council first finds, by ordinance, that such disposition is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby finds that the lease of the Residence located at 4300 West County Road 50 to the Facility Attendant under the terms listed above is in the best interests of the City. Section 2. That the City Manager is hereby authorized to execute a lease agreement for the Residence on terms and conditions consistent with this Ordinance,together with such additional terms and conditions as the City Manager, in consultation with the City Attorney,determines to be necessary and appropriate to protect the interests of the City,including any necessary changes to the legal description of the Residence, as long as such changes do not materially increase the size or change the character of the leased premises.
