HomeMy WebLinkAboutCOUNCIL - AGENDA ITEM - 05/07/2002 - RESOLUTION 2002-044 AUTHORIZING THE LEASE OF CITY- AGENDA ITEM SUMMARY ITEM NUMBER: 22 FORT COLLINS CITY COUNCIL DATE: May 7, 2002 STAFF: Helen Matson SUBJECT: Resolution 2002-044 Authorizing the Lease of City-owned Property at 304 North Howes Street. RECOMMENDATION: Staff recommends adoption of the Resolution. FINANCIAL IMPACT: Rent collected from this lease will result in at least $8,400 in unanticipated revenue to the General Fund - Real Property Lease Budget. The tenant will pay gas and electric expenses. EXECUTIVE SUMMARY: The City purchased this property as part of the Civic Center Master Plan on February 28,2000. The City's use of this block is still being planned; and, in the interim, the residence has continued as a rental. At the time of purchase, the lease for the existing tenant was continued and that lease was approved by Council. That tenant moved out at the end of her lease term. City crews have completed necessary repairs and staff is advertising for a replacement tenant. The new lease term will be for 12 months and will commence upon execution of the Lease. This lease will have the option to renew for an additional year. . RESOLUTION 2002-044 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 304 NORTH HOWES STREET WHEREAS,the City of Fort Collins is the owner of the property legally described as Lot 15, Block 33, Fort Collins, Colorado and also known as 304 and 304 �/2 North Howes Street (the "Property"); and WHEREAS, the residence at 304 North Howes Street is shown as "Residence" on Exhibit "A" attached hereto; and WHEREAS, the City purchased the Property for the implementation of the Civic Center Master Plan and has not yet finalized specific plans for the Property; and WHEREAS, the City desires to lease this residence for a term of one year at a monthly rate of at least $700, with the option to renew for an additional year; and WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is authorized to lease any and all interests in real property owned in the name of the City,provided that Council first finds that the lease is in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council herebyfinds that leasing the Residence under the terms listed above is in the best interests for the City of Fort Collins. Section 2. That the City Manager, in consultation with the City Attorney, is hereby authorized to negotiate and execute a lease agreement consistent with the terms of this Resolution for the lease of the Residence.
