RECOMMENDATION: Staff recommends adoption of the Ordinances on First Reading. FINANCIAL IMPACT: The value of the donated property is $104,000. The Poudre Landmarks Foundation will be responsible for the cost of renovation/remodel. They will also be responsible for the maintenance of the interior of the building. The Foundation will pay the City$1.00 per year for rent. All utility costs to be paid by the City are budgeted in the General Fund in the Facilities Budget. EXECUTIVE SUMMARY: A. First Reading of Ordinance No.080,2002, Authorizing the Acceptance of a Donation of the Property Located at 425 loth Street, Fort Collins, Colorado, Known as the Romero House, from Fort Collins Partners I,LLC and Appropriating Unanticipated Revenue in the General Fund. B. First Reading of Ordinance No. 081, 2002, Authorizing the Lease of 425 loth Street, Fort Collins, Colorado, to Poudre Landmarks Foundation. BACKGROUND: The Romero House is located at 425 loth Street in the Andersonville neighborhood of Fort Collins and was designated as a local historical landmark in August 2001. Fort Collins Partners I, LLC is the current owner of the property and has offered to donate the site to the City of Fort Collins. Poudre Landmark Foundation has a committee known as Amigos de la Casa Romero/Friends of the Romero House that has been working to raise funds necessary to establish the only museum in the North Front Range dedicated to recognizing and remembering the contributions of Hispanics, Latinos, and Mexicans in Northern Colorado. Their goal is that this house will become a living history museum under the management of the Poudre Landmarks Foundation. The Foundation also DATE: May 21, 2002 2 1 ITEM NUMBER: 19 A-B envisions that when the renovation is completed the Romero House will not only be a museum available to the public, it will also serve as a neighborhood resource center and the a site for cultural events that represent the rich history of Hispanic Coloradoans. The City and the Poudre Landmarks Foundation have been working together since the mid 1970's on the historic restoration and renovation of the Avery House. This cooperative relationship continued with the Avery Carriage House and the City Water Works Building. This 15-year Lease Agreement to the Poudre Landmarks Foundation will expand the long and successful relationship. The Foundation will pay the City $1.00 per year to lease the Romero House. ORDINANCE NO. 080, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACCEPTANCE OF A DONATION OF THE PROPERTY LOCATED AT 425 LOTH STREET, FORT COLLINS, COLORADO, KNOWN AS THE ROMERO HOUSE, FROM FORT COLLINS PARTNERS I, LLC AND APPROPRIATING UNANTICIPATED REVENUE IN THE GENERAL FUND WHEREAS, Fort Collins Partners I, LLC wishes to donate certain property to the City that is legally described as Lot 1, Block 12, Anderson Place, Fort Collins, Colorado (the "Property"); and WHEREAS, in cooperation with Poudre Landmarks Foundation, the Property, after renovation, will become a living history museum, neighborhood resource center and a site for cultural events for the benefit of the citizens of Fort Collins; and WHEREAS, the value of the Property is estimated to be $104,000; and WHEREAS, City staff has determined that the donation of the Property from Fort Collins Partners I, LLC will be beneficial for the citizens of Fort Collins; and . WHEREAS, Article V,Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, Citv staff has determined that the appropriation of the Property, as described herein, will not cause the total amount appropriated in the relevant funds to exceed the current estimate of actual and anticipated revenues to be received in that fund during the fiscal year; and WHEREAS, it is the desire of the Council to authorize the acceptance of the donation of the Property from Fort Collins Partners I,LLC and to appropriate$104,000 of unanticipated revenue in the form of a donation of land in the General Fund. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby approves and authorizes the acceptance by the Mayor of a deed of conveyance of the Property. Section 2. That there is hereby appropriated for expenditure from unanticipated revenue in the General Fund the sum of ONE HUNDRED FOUR THOUSAND DOLLARS ($104,000) for General Fund purposes. OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF 425 IOTH STREET, FORT COLLINS, COLORADO TO POUDRE LANDMARKS FOUNDATION WHEREAS, concurrent with this Ordinance, the Council has considered and adopted Ordinance No. 080, 2002, authorizing the acceptance of the donation of 425 10th Street, in Fort Collins (the "Romero House"), and appropriating that donation; and WHEREAS, the Romero House was designated as a local landmark in August 2001, in the Andersonville neighborhood of Fort Collins; and WHEREAS, City staff, working with a citizen group known as Amigos de la Casa Romero/Friends of the Romero House (the "Amigos"), and the Poudre Landmarks Foundation (the "Foundation"), have developed a general plan pursuant to which the Romero House would be developed into the only museum in the North Front Range dedicated to recognizing and remembering the contributions of Hispanics, Latinos, and Mexicans in Northern Colorado (collectively "Hispanic Coloradans"); and WHEREAS, the Foundation has agreed to lease the Romero House from the City upon completion of the donation, and to work with the Amigos to raise funds and carry out the . development of the above-described museum, and then to manage and operate it as a living history museum available to the public, as well as using the Romero House as a neighborhood resource center and site for cultural events that represent the culture and history of Hispanic Coloradans; and WHEREAS, City staff has worked with the Foundation to negotiate a proposed fifteen- year lease agreement providing for the Foundation to proceed with and carry out the development and operation of the Romero House as described herein, at a nominal lease rate of one dollar per year, a copy of which lease agreement is on file in the Office of the City Clerk and available for public inspection (the "Lease Agreement"); and WHEREAS, the City has worked successfully with the Foundation on the historic restoration and renovation of both the Avery House and City Water Works Building projects, and currently leases those properties to the Foundation under terms generally consistent with those in the Lease Agreement; and WHEREAS, the proposed lease to the Foundation of the Romero House as provided hereunder would advance the preservation of an historic resource of significance to Fort Collins, would safeguard this remnant of the City's historical past against vandalism, neglect, and inappropriate redevelopment, and would enhance the quality of life in Fort Collins by the preservation of this historic resource and the inclusion of heritage of Hispanic Coloradans in the daily life and development of the City and the community; and • WHEREAS, because of the public policy objectives to be served through the lease of the Romero House and the responsibilities assigned to and accepted by the Foundation in the Lease Agreement for developing and operating the Romero House as described herein, City staff has recommended that nominal rent in the amount of one dollar per year is an appropriate and reasonable compensation amount for the Romero House, as set forth in the Lease Agreement; and WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is authorized to lease any and all interests in real property owned in the name of the City, provided that Council first finds that the lease is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the lease by the City of 425 loth Street to the Foundation, pursuant to the terms and conditions set forth herein and in the Lease Agreement, is in the best interests of the City of Fort Collins. Section 2. That the Mayor is hereby authorized to enter into the Lease Agreement leasing 425 loth Street in Fort Collins to the Foundation for an original term of fifteen years, at a lease rate of ONE DOLLAR ($1.00) per year, together with such other related provisions determined necessary to protect the interest of the City by the City Manager, in consultation with the City Attorney.
