Items Relating to the North College Improvement Project.
RECOMMENDATION:
Staff recommends adoption of the Resolution and the Ordinance on First Reading.
FINANCIAL IMPACT:
The North College Improvement Project, Phase 1, is funded by a combination of Building
Community Choices 1/4 cent sales tax funds and Congestion Mitigation & Air Quality (CMAQ)
funds from the Colorado Department of Transportation (CDOT).
The CMAQ grant funds are intended to assist with funding the bicycle and pedestrian improvements
associated with the Building Community Choices (BCC) project along North College Avenue/US
287 between Jefferson Street and Vine Drive. The CMAQ funds need to be appropriated into the
BCC project fund. The CDOT contract is for the first portion of the CMAQ funds in the amount of
$166,844.

The local matching funds will be provided from the Transportation Services Fund reserves. In mid-
2002, CDOT will make available to the City an additional$278,000 in CMAQ funding to cover the
remaining portion of the grant.The total CMAQ funding for the North College project is$455,000.
The Building Community Choices (BCC)funds have previously been appropriated into the project
40 budget. Available BCC funds include$335,000(2002)for final design and right-of-way acquisition
and $2,016,854 (2003) for construction. The total available budget for this project is $2,796,698.

EXECUTIVE SUMMARY:
A. Resolution 2002-023 Authorizing the Mayor to Enter into a Contract-with the Colorado
Department of Transportation for the Design and Construction of the North College
Bicycle/Pedestrian Improvements.
B. First Reading of Ordinance No. 038, 2002, Appropriating Unanticipated Revenue in the
Building Community Choices Capital Projects Fund,North College Corridor Project,Phase
1 Prior Year Reserves in the Transportation Services Fund and Authorizing the Transfer of
Appropriations to Be Used for Bicycle and Pedestrian Improvements along North College
Avenue Between Jefferson Street and Vine Drive.
The first phase of the North College Improvement project is funded by the City's Building
Community Choices 1/4 cent sales tax.The Ordinance that imposed the tax describes the project as
follows:
"This is a four phase project to improve the safety of pedestrians and vehicles on
North College Avenue. Phase I will focus on the 1/4 to 1/2 mile north of Jefferson
Street. Anticipated improvements may include: (1) drainage improvements; (2)
widening the roadway to provide better and safer facilities for bicycles and
pedestrians;(3)constructing medians for access control;and/or(4)improving to full
arterial street standards including curb,gutter,and sidewalk. Planning,design,right-
of-way acquisition and other project costs may also be included."
The City of Fort Collins and the Colorado Department of Transportation (CDOT) along with the
City's consulting team have been working to finalize the conceptual design plan for the first phase
of the North College Improvement Project. The first phase of this project includes the portion of
North College Avenue (US287) from the Jefferson Street(SH14)/Maple Street intersection on the
south to Vine Drive on the north. The conceptual design plan has been developed in accordance
with the North College Avenue/US 287 Access Management Plan.
Staff has revised the concept plan based upon input from the community gathered from public open
house events as well as individual meetings with local business/property owners over the last several
months.
The final conceptual design has also been revised due to financial constraints, given the project's
available budget. The "Fiscally Constrained Plan" represents the conceptual design plan that will
be moving forward for this BCC project and includes the following elements:
1. Single southbound left turn lane from North College to Jefferson;
2. Free flow right turn lane from westbound Jefferson to northbound College;
3. Raised, landscaped medians along the length of the corridor;
4. Future removal of the northbound left turn from College to Cherry street; however this
change can be phased in over time as traffic conditions warrant—it is not needed with the
first phase of this project;
5. Double left turn lanes eastbound at the Cherry Street/North College intersection;
6. Extensive bicycle and pedestrian improvements, including enhanced crosswalks,on &off-
street bikeways, 90' crossings of the Burlington Northern Santa Fe and Union Pacific
railroad tracks, direct access to the Poudre River Trail, and

7. Gateway enhancements along the corridor including hardscape and landscape features.
The conceptual design phase of this project is anticipated to take through February 2002. The
conceptual design will address interim and ultimate levels of improvements and include cost
estimates. Following this phase, the City will proceed with final design, right of way acquisition,
and construction of the "Fiscally Constrained Plan". The project will be constructed in 2003.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH
THE COLORADO DEPARTMENT OF TRANSPORTATION FOR THE DESIGN
AND CONSTRUCTION OF THE NORTH COLLEGE
BICYCLE/PEDESTRIAN IMPROVEMENTS
WHEREAS,the"Building Community Choices" 1/4 cent sales tax(BCC)approved by ballot
in the April 8, 1997 election provides funding for, among other things, the first phase of the North
College Avenue Improvement Project (the "Project"); and
WHEREAS,the first phase of the Project includes the portion of North College Avenue form
the Jefferson Street/Maple Street intersection to Vine Drive and has been developed in accordance
with the North College Avenue/US 287 Access Management Plan; and
WHEREAS,pursuant to the Transportation Equity Act of the 21st Century of 1998,certain
funds have been allocated for highway projects, under the Congestion Mitigation and Air Quality
(CMAQ)program,that have been proposed by the Colorado Department of Transportation(CDOT)
and approved by the Federal Highway Administration; and
WHEREAS, certain CMAQ Project funds are made available only for eligible "congestion
• mitigation and air quality improvement" and those activities are defined in §23 U.S.C. 101(a); and
WHEREAS, the City has requested of CDOT that the first phase of the Project be funded
as part of the CMAQ program, as a congestion mitigation and air quality activity; and
WHEREAS,federal funds have been made available for the first phase of the Project for the
design and construction of bicycle/pedestrian improvements within said phase; and
WHEREAS, CDOT has presented to the City for execution a congestion mitigation and air
quality contract for the purpose of providing funding for the bicycle/pedestrian improvements in the
first phase of the Project, the total cost of which project is estimated to be $177,000 to be funded
with federal participating funds in the amount of$142,270 and with City participating funds in the
amount of$34,730; and
WHEREAS, the Council has determined that it is in the best interests of the City that the
proposed congestion mitigation and air quality contract as above-described be entered into between
the City and CDOT.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and hereby is, authorized to execute a congestion mitigation and air
quality contract between the City and the Colorado Department of Transportation for the purpose
of providing funding for the pedestrian/bicycle improvements in the first phase of the North College
Avenue Improvement Project for the design and construction of the same, with said contract to
• provide federal participating funds in the sum of ONE HUNDRED FORTY TWO THOUSAND
TWO HUNDRED SEVENTY DOLLARS ($142,270) and City participating funds in the sum of
THIRTY FOUR THOUSAND SEVEN HUNDRED THIRTY DOLLARS ($34,730) for a total
amount of ONE HUNDRED SEVENTY SEVEN THOUSAND DOLLARS ($177,000).
Passed and adopted at a regular meeting of the City Council held this 19th day of February,

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE
IN THE BUILDING COMMUNITY CHOICES CAPITAL PROJECTS FUND,
NORTH COLLEGE CORRIDOR PROJECT, PHASE 1
PRIOR YEAR RESERVES IN THE TRANSPORTATION SERVICES FUND
AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS TO BE USED FOR
BICYCLE AND PEDESTRIAN IMPROVEMENTS ALONG NORTH COLLEGE AVENUE
BETWEEN JEFFERSON STREET AND VINE DRIVE
WHEREAS,on April 8, 1997,the voters of the City approved Ordinance No. 30, 1997 (the
"Ordinance"), authorizing the imposition of a quarter cent sales and use tax for the purpose of
generating revenues to construct certain transportation projects described in the `Building
Community Choices" ("BCC") capital improvement program; and
WHEREAS, one such project approved for funding by the voters was the North College
Corridor transportation project, phase 1 (the "Project"); and
WHEREAS,the scope of the Project as outlined in the Ordinance calls for the construction
of improvements,in four phases,to improve the safety of pedestrians and vehicles on North College
Avenue focussing on the 1/4 to 1/2 mile north of Jefferson Street; and
WHEREAS, the improvements may include: (1) drainage improvements; (2) widening the
roadway to provide better and safer facilities for bicycles and pedestrians; (3)constructing medians
for access control; and/or (4) improving to full arterial street standards including curb, gutter, and
sidewalk; and
WHEREAS,the Colorado Department of Transportation(CDOT)has made available to the
City of Fort Collins, Congestion Mitigation & Air Quality funds in the amount of$142,270 to be
used for design and construction of bicycle and pedestrian improvements along North College
Avenue, between Jefferson Street and Vine Avenue; and
WHEREAS,local matching funds needed,totaling$34,730,have been identified from prior
year reserves in the Transportation Services Fund; and
WHEREAS, the City Council adopted Resolution 2002-023, on February 19, 2002,
authorizing the City to enter into an intergovernmental agreement with CDOT for the receipt of
Congestion Mitigation & Air Quality funds to be used for design and construction of bicycle and
pedestrian improvements along North College Avenue,between Jefferson Street and Vine Avenue;
and
WHEREAS, the conceptual design for the proposed Project improvements has been
developed in accordance with the North College Avenue/US 287 Access Management Plan; and
WHEREAS, Article V, Section 9,of the Charter of the City of Fort Collins (the"Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS,Article V,Section 9,of the Charter also permits the City Council to appropriate
by ordinance at any time during the fiscal year such funds for expenditure as may be available from
reserves accumulated in prior years, notwithstanding that such reserves were not previously
appropriated; and
WHEREAS,Article V,Section 10,of the Charter authorizes the City Council to transfer by
ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital
project to another fund or capital project,provided that the purpose for which the transferred funds
are to be expended remains unchanged;the purpose for which the funds were initially appropriated
no longer exists; or the proposed transfer is from a fund or capital project account in which the
amount appropriated exceeds the amount needed to accomplish the purpose specified in the
appropriation ordinance; and
WHEREAS, the purpose for which the requested appropriations in the Transportation
Services Fund, will remain the same, upon transfer to the Capital Projects Fund - North College
Corridor project; and
WHEREAS, it is the desire of the Council to appropriate the sum of$138,130 in Colorado
Department of Transportation Congestion Mitigation&Air Quality funds, and the sum of $34,730
from Transportation Services Fund prior year reserves for transfer to the Building Community
Choices Capital Projects Fund - North College Corridor project to be used to for the design and
construction of bicycle and pedestrian improvements along North College Avenue, between
Jefferson Street and Vine Drive.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue
in the Building Community Choices Capital Projects Fund-North College Corridor project,the sum
of ONE HUNDRED FORTY-TWO THOUSAND TWO HUNDRED SEVENTY DOLLARS
($142,270) from Colorado Department of Transportation Congestion Mitigation & Air Quality
funds, to be used for design and construction of bicycle and pedestrian improvements along North
College Avenue, between Jefferson Street and Vine Drive.
Section2. That the sum of THIRTY-FOUR THOUSAND SEVEN HUNDRED THIRTY
DOLLARS ($34,730)is hereby appropriated from prior year reserves in the Transportation Services
Fund,and authorized for transfer to the Building Community Choices Capital Projects Fund-North
College Corridor project to be used for design and construction of bicycle and pedestrian
improvements along North College Avenue, between Jefferson Street and Vine Drive.
Introduced and considered favorably on first reading and ordered published this 19th day of
February, A.D. 2002, and to be presented for final passage on the 5th day of March, A.D. 2002.
