SUBJECT:
First Reading of Ordinance No. 029, 2002, Appropriating Unanticipated Revenue in the Capital
Projects Fund and the Capital Improvement Expansion Fund and Authorizing the Transfer of
Appropriations Between Funds for the Purpose of Constructing Improvements at Sheldon Lake in
City Park.
RECOMMENDATION:
Staff recommends the adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
The City will receive $175,000 in donated funds from the Wilkins Trust and anticipates receiving
$125,000 in donated materials from the Elks Lodge for this project. The City will use $125,000 in
Community Parkland Fees generated from new residential development in the service area of City
Park for the project.
EXECUTIVE SUMMARY:
The Wilkins Trust generously donated $100,000 in 2000 for improvements to the north shore of
Sheldon Lake. The new sidewalk,benches, and crushed fine gravel path have been installed and are
being enjoyed by park visitors.
Staff has determined that growth of population in the general service area of City Park has resulted
and will continue to result in increased use of City Park, including increased demand for footpaths
and pedestrian access around Sheldon Lake. In order to accommodate this increasing demand for
pedestrian walkways, and to absorb the increased pedestrian traffic around and in the vicinity of
Sheldon Lake in City Park, certain improvements around the perimeter of Sheldon Lake are
necessary. Consequently, staff is proposing that funds in the amount of$125,000 be appropriated
from current year revenues received in the Capital Improvement Expansion Fee Fund for Community
Park Improvements, to be used for boardwalk and shoreline improvements around Sheldon Lake.
The Trust would like to continue to help fund improvements at Sheldon Lake with this new donation
in the amount of$175,000. This funding will help pay for construction of a boardwalk around the
outdoor pool; irrigation and landscaping along the west and south shore; for a stone wall along City
Park Drive;for irrigation,landscaping and a storage shed for the Trolley Barn;and for improvements
to City Park Center.

The Elks Lodge#804 has donated$125,000 in services and materials for this project. The Elks will
be assisting City staff with the design and implementation of the project. The Elks will be donating
their time and labor to help construct the boardwalk. A portion of project funds will be allocated
toward the purchase of new paddleboats for the recreation boating program at Sheldon Lake.
The combined funding of$125,000 from Capital Improvement Expansion Fee Fund for Community
Park Improvements, $175,000 from the Wilkins Trust, and $125,000 in donated services and
materials from the Elks, adds up to a total project budget of$425,000.
By adopting this Ordinance,Council is accepting and appropriating the$175,000 donation from the
Wilkins Trust for this project and appropriating $125,000 from the Capital Expansion Community
Parkland Fund for the project. This project is scheduled to be constructed this summer and fall.
ORDINANCE NO. 029, 2002
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND
AND THE CAPITAL IMPROVEMENT EXPANSION FUND AND
AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN FUNDS FOR THE
PURPOSE OF CONSTRUCTING IMPROVEMENTS AT SHELDON LAKE IN CITY PARK
WHEREAS,Don and May Wilkins moved to Fort Collins in 1937, and Mr.Wilkins was the
editor of the Fort Collins Express Courier(now the Coloradoan) for over 30 years; and
WHEREAS, the Wilkins created a Charitable Trust to provide support for cultural,
charitable, literacy, historic, and educational purposes in and around the Fort Collins area; and
WHEREAS, the City received a donation of$235,000, in December of 2000, through the
generosity of the Don and May Wilkins Charitable Trust (the "Trust'), of which $100,000 was
earmarked and appropriated by the City Council for improvements to the north shore of Sheldon
Lake in City Park; and
WHEREAS, the aforementioned improvements have been completed and include new
sidewalk, benches, and the installation of a crushed fine gravel path; and
WHEREAS, staff has determined that growth of population in the general service area of

WHEREAS, staff has further determined that in order to accommodate this increasing

WHEREAS, staff is proposing that funds in the amount of$125,000 be appropriated from
current year revenues received in the Capital Improvement Expansion Fee Fund for Community Park
Improvements, to be used for boardwalk and shoreline improvements around Sheldon Lake; and
WHEREAS, City Code Section 7.5.28(a) requires that Community Parkland Capital
Improvement Expansion Fee funds be used only for capital improvements related to the provision
of community parks, as such improvements may be identified in the capital improvements plan for
community parkland; and
WHEREAS,the construction of the boardwalk and shoreline improvements at Sheldon Lake
are identified in, and are consistent with, the Parks and Recreation Policy Plan adopted by the
Council in Resolution 96-147 on December 3, 1996; and
WHEREAS, the Trust wishes to continue to help fund improvements at Sheldon Lake and
has generously donated $175,000 to the City for the purpose of constructing additional
improvements in City Park; and
WHEREAS, the donation from the Trust will be used to help construct the aforementioned
boardwalk around the outdoor pool and provide irrigation and landscaping along the west and south
shores; and will further be used to construct a stone wall along City Park Drive, a storage shed
adjacent to the Trolley Barn, improvements to City Park Center, and to purchase new paddleboats
for the recreation boating program at Sheldon Lake; and
WHEREAS, in addition to the donation from the Trust,the Elks B.P.O.E. #804 will donate
in-kind services, including labor, and materials, valued at $125,000; and
WHEREAS,the estimated cost of all of the aforementioned improvements is$425,000; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year, do not exceed the then current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS,under Article V,Section t0 of the Charter,the City Council may,by ordinance,
upon the request of the City Manager, transfer any unexpended and unencumbered appropriated
amount or portion thereof from one fund or capital project to another fund or capital project provided
that the purpose for which the transferred funds are to be expended remains unchanged; the purpose
for which the funds were initially appropriated no longer exists; or the proposed transfer is from a
fund or capital project account in which the amount appropriated exceeds the amount needed to
accomplish the purpose specified in the appropriation ordinance; and
WHEREAS, it is the desire of the Council to appropriate the total amount of $425,000,
representing a$175,000 donation from the Don and May Wilkins Charitable Trust, in-kind services
donated by the Elks B.P.O.E. #804 valued at $125,000, and current year revenues from the City's
capital improvement expansion fees for community park improvements, totaling $125,000 for
transfer to the City's Capital Projects Fund-Sheldon Lake Improvements project,to be used to fund
improvements to Sheldon Lake in City Park; and
WHEREAS, the purpose for which the revenues from capital improvement expansion fees
for community park improvements will remain the same upon transfer to the Capital Projects Fund-
Sheldon Lake Improvements project.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from unanticipated revenue
in the Capital Projects Fund-Sheldon Lake Improvements project the sum of THREE HUNDRED
THOUSAND DOLLARS ($300,000) from donations from the Don and May Wilkins Charitable
Trust ($175,000) and the Elks B.P.O.E. #804 ($125,000) to be used to fund improvements to
Sheldon Lake in City Park.
Section 2. That there is hereby appropriated from unanticipated revenue in the Capital
Improvement Expansion Fund, the sum of ONE HUNDRED TWENTY-FIVE THOUSAND
DOLLARS ($125,000) for transfer to the Capital Projects Fund - Sheldon Lake Improvements
project, and appropriated therein, to be used to fund improvements to Sheldon Lake in City Park,
consistent with this Ordinance.
Introduced and considered favorable on first reading and ordered published this 19th day of
