RECOMMENDATION: Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY: City Council adopted Ordinance No. 56,2001,on Second Reading on May 6,2001,authorizing the long-term lease of property to Cole Smith for the construction of two aircraft hangars. Since that lease agreement was entered into, the parties discovered that the legal description of the leased premises as described in Exhibit A of the agreement is in error. Ordinance No. 129, 2001, which was unanimously adopted on First Reading on August 21,2001,amends the original lease to include the correct legal description. Because the plan used in developing the legal descriptions did not have existing buildings accurately located, it resulted in an incorrect legal description. This amendment rectifies that situation with a corrected Exhibit A.
