RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: This action will allow the City to accept $633,320 in unanticipated revenue from Great Outdoors Colorado in support of natural area acquisitions. This Ordinance appropriates a total of$633,120 in unanticipated revenue from Great Outdoors Colorado for two projects. 110 EXECUTIVE: SUMMARY: "Ute Farm"and"One Putt,"portions of the Long View Farm Open Space,were purchased in 1997 by Larimer County, City of Loveland, and City of Fort Collins. The three owners recently completed documentation required to receive grant funds from Great Outdoors Colorado Trust Fund (GOCO) to assist in the purchase of the property. The City of Fort Collins' portion of the grant is $133,320. Sauer Open Space was purchased in 2000 by the City of Loveland, Larimer County, and the City of Fort Collins. The three owners recently completed documentation required to receive grant funds from (GOCO) in the amount of$500,000. The entire grant amount will come to the City of Fort Collins. Then: grants were received into the Open Lands Great Outdoors Colorado Revenue Fund and are to go into the Open Lands Acquisition Fund. ORDINANCE NO. 007, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE OPEN LANDS FUND FOR REIMBURSEMENT TOWARD THE PURCHASE PRICE OF THE SAUER PROPERTY OPEN SPACE AND THE UTE FARM AND ONE PUTT PORTIONS OF THE LONG VIEW FARM OPEN SPACE WHEREAS, the City of Fort Collins has been working with Larimer County since 1994 to preserve significant areas of open land between Fort Collins and Loveland; and WHEREAS, in 1997, the City of Fort Collins, together with Latimer County and the City of Loveland, purchased approximately 478.5 acres of land located west of College Avenue and south of County Road 32. referred to as the Ute Farm and One Putt portions of the Long View Farm Open Space; and WHEREAS, in 2000, the City of Fort Collins, together with Latimer County and the City of Loveland, purchased approximately 785 acres of land located south of Fort Collins and west of Taft Hill Road, abutting the southern portion of the Coyote Ridge Natural Area, referred to as the Sauer Property Open Space; and WHEREAS, Latimer County, on behalf of the City of Fort Collins and the City of • Loveland, was awarded a $400,000 grant from the Board of the Great Outdoors Colorado Trust Fund (GOCO) to assist with the acquisition of the Long View Farm Open Space parcels; and WHEREAS, the City of Fort Collins share of the aforementioned GOCO grant, based on its percentage of ownership of the property, was $133,320; and WHEREAS, the City of Fort Collins was awarded a $500,000 grant from the Board of the Great Outdoors Colorado Trust Fund to assist with the acquisition of the Sauer Property Open Space; and WHEREAS, the City of Fort Collins used proceeds representing its share of the county- wide 0.25 cent sales and use tax dedicated towards open space, natural areas, wildlife habitat, and parks and trails for its share of the Long View Farm Open Space acquisitions in 1997 and the Sauer Property Open Space in 1998; and WHEREAS, the City received, in 2001, $133,320 for the Long View Farm Open Space acquisition, and $500,000 for the Sauer Property Open Space acquisition, representing reimbursement for the City's share of the proceeds from the aforementioned GOCO grants; and WHEREAS, the funds received from the Great Outdoors Colorado grants will be appropriated in the City's Open Lands Fund where said appropriations will be available for the acquisition and development of open space, trails, and natural areas as identified in the Natural Areas Policy Plan and City Plan; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of GOCO grant receipts in the amount of$633,320 will not cause the total amount appropriated from the relevant fund to exceed the current estimate of actual and anticipated revenues to be received in that fund during any fiscal year. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Open Lands Fund, the sum of SIX HUNDRED THIRTY-THREE THOUSAND THREE HUNDRED TWENTY DOLLARS ($633,320), upon receipt from the Great Outdoors Colorado Trust Fund to be used for the acquisition and development of open space, trails, and natural areas. Introduced and considered favorably on first reading and ordered published this 15th day of January, A.D. 2002, and to be presented for final passage on the 5th day of February, A.D. 2002.
