EXECUTIVE SUMMARY The Three-Mile Plan for the City of Fort Collins is a policy document ensures the City complies with the regulations of the Colorado Revised Statues. This is the 2010 update to the Three-Mile Plan. BACKGROUND / DISCUSSION In 1987, the Colorado legislature significantly changed the state's annexation law; municipal annexations were to be limited to no more than three miles beyond a current boundary line in any given year. In addition, each municipality is required to adopt an annexation plan for the three-mile area(commonly known as a Three-Mile Plan). The purpose of a Three-Mile Plan is to ensure that municipalities carefully consider where they want to annex, how services will be provided to these newly annexed areas, and how adequate levels of services will be sustained throughout the rest of the municipality. The current Three-Mile Plan has been in place since it was last amended by Council on November 12, 2008. According to state law, the Plan should be updated and revised annually. There was not an update in 2009 due to an oversight. No annexations are in question because of this oversight. The Three-Mile Plan describes each of the items listed in four categories, as follows: Transportation-related items: • Streets • Subways • Bridges • Parkways • Aviation fields • Other public ways • Terminals for transportation Parks, Natural Areas and Open Lands-related items: • Waterways • Waterfronts • Playgrounds • Squares • Parks • Grounds • Open spaces Utilities and related items: • Public utilities • Terminals for water, light, sanitation, and power provided by the municipality February 1, 2011 -2- ITEM 15 Proposed Land Uses: • Inside Growth Management Area (GMA) • Outside Growth Management Area (GMA) The Three-Mile Plan lists the plans, policies, maps, and other documents that have been adopted by the City Council which generally describe the proposed location, character, and extent of the specific characteristics listed above. In addition, there are some plans and policies that have been adopted not by the City, but by Larimer County, Colorado State University, or adjoining municipalities, as these are also located within the boundaries of the Three-Mile Plan. FINANCIAL/ ECONOMIC IMPACTS The Three-Mile Plan is required by state law, and failure to have a plan in place prior to an annexation could result in a challengeable annexation. Therefore, it is in the City's best interests financially and economically to update the plan accordingly so that future annexations cannot be challenged. The annexations that occurred in 2010 are not in question because the statute of limitations setting the time following the passage of an annexation ordinance has expired on all City annexations. ENVIRONMENTAL IMPACTS The purpose of a three-mile plan is to ensure that municipalities consider where they want to annex, how services will be provided to these newly annexed areas, and how adequate levels of services will be sustained throughout the rest of the municipality. Therefore, it is in the City's best interests from an environmental perspective to update the Plan and ensure that future annexations will not overly strain the City's ability to sustain service provision to its citizens. STAFF RECOMMENDATION Staff recommends adoption of the Resolution. BOARD / COMMISSION RECOMMENDATION At its January 20, 2011 meeting, as part of its Consent Agenda, the Planning and Zoning Board voted unanimously to recommend adoption of the 2010 update to the Three-Mile Plan. RESOLUTION 2011-007 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING THE 2010 UPDATE TO THE THREE-MILE PLAN FOR THE CITY OF FORT COLLINS WHEREAS, Colorado law provides at Section 31-12-105,C.R.S.,that each municipality in the State must prepare a plan for the geographic area within three miles in any direction from the municipality's boundaries(a"Three-Mile Plan"),which Plan must generally describe the proposed location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds,squares,parks,aviation fields,other public ways,grounds,open spaces,public utilities and terminals for water, light, sanitation, transportation and power to be provided by the municipality, and the proposed land uses for the area; and WHEREAS, the City's original Three-Mile Plan was adopted in 1998, which Plan again is in need of being updated; and WHEREAS, City staff has prepared and presented to the City Council a proposed update of the Three-Mile Plan for the City which the City Council has determined should be approved. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the updated Three-Mile Plan for the City, attached hereto as Exhibit "A" and incorporated herein by this reference, is hereby approved and adopted. Introduction What is the Purpose of the Three-Mile Plan ? The Three- Mile Plan for the City of Fort Collins, Colorado, is a policy document that complies with the regulations set forth in the Colorado Revised Statutes . This 2010 document updates the 2008 version of the Three Mile Plan to reflect changes to supporting documents and plans . Section 31- 12- 105 of the Colorado Revised Statutes requires that the City complete a plan within three miles in any direction from any point of such municipal boundary as follows : Prior to the completion of any annexation within the three-mile area, the municipality shall have in place a plan for that area that generally describes the proposed location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the municipality and the proposed land uses for the area.
