First Reading of Ordinance No. 058, 2011,Authorizing the Lease of the City's Historic Water Works Property at 2005
North Overland Trail to the Poudre Landmarks Foundation.
EXECUTIVE SUMMARY
The City is the owner of the 25-acre property located at 2005 North Overland Trail. The property has not been a part
of the Water Utilities'operating infrastructure since 1904,yet is a valuable historic resource. The Poudre Landmarks
Foundation has leased the property since 1996 and desires to continue leasing the property for use as an interpretive
center/museum for water.
BACKGROUND / DISCUSSION
The City's historic Water Works Building was built in 1883 on approximately 25 acres located at 2005 North Overland
Trail. The property consists of four buildings: the old Water Works Building, a three-bedroom residence, a barn and
a shed. The Water Works site remained in use until 1904 when it was replaced by a system that could supply the
growing needs of the community. In 1971, the Water Works site was named Fort Collins'first local historic landmark
district.
The Foundation agreed to lease the Property in 1996 to preserve the buildings. During the fifteen year lease period,
the Foundation restored the inside of the Water Works building and used the Property for an interpretive center and
museum for water.
The term of the new lease is for fifteen years at an aggregate rent of$75, or$5 per year. The City will be responsible
for the maintenance of the exterior of the Water Works building and the residential structure. The Foundation will
continue to be responsible for the maintenance of the interior of the buildings. The 1996 lease permitted the
Foundation to have a caretaker live in the residence on the property. The Foundation would like to continue this
practice, as it has greatly reduced vandalism on the property.
FINANCIAL/ ECONOMIC IMPACTS
Cost of utility service for the Water Works building will be paid by the City while the residence's utility service costs
will be paid by the Foundation.
STAFF RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.

ORDINANCE NO. 058, 2011
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF THE CITY'S HISTORIC WATER WORKS
PROPERTY AT 2005 NORTH OVERLAND TRAIL TO THE POUDRE
LANDMARKS FOUNDATION
WHEREAS,the City is the owner of a parcel of real property approximately 25 acres in size
located at 2005 North Overland Trail, Fort Collins, Colorado (the "Property"); and
WHEREAS,the Property includes four structures:the City's historic Water Works building
(built in 1883), a three-bedroom residence, a barn and a shed (the "Buildings"), which together
constitute the City's Historic Water Works site; and
WHEREAS, on May 21, 1996, the City Council adopted Ordinance No. 059, 1996,
authorizing the lease of the Property to the Poudre Landmarks Foundation (the "Foundation") for
a period of 15 years; and
WHEREAS,since 1996 the Foundation has restored the interior of the Water Works building
and used the Property as an interpretive center and museum; and
WHEREAS,the Foundation desires to continue leasing the Property from the City,and City
staff is recommending that the City continue leasing the Property to the Foundation for a period of
15 years for a total aggregate rental of Seventy Five Dollars ($75.00); and
WHEREAS, leasing the Property to the Foundation will serve the public purposes of
preserving the Property as an important historic site and providing the public with an educational
opportunity relating to the importance of water in the historical development of this community;and
WHEREAS,the 1996 lease permitted the Foundation to have a caretaker live in the residence
on the Property and for a number of years the Foundation has sublet the residence for nominal rent
to tenants who also perform some maintenance and caretaker duties for the Foundation; and
WHEREAS,the Foundation would like to continue the practice of subletting the residence
as it has significantly reduced vandalism on the Property; and
WHEREAS, Section 23-111 of the City Code authorizes the City Council to sell,convey or
otherwise dispose of any interest in real property that is part of the City's water utility system if the
City Council first finds, by ordinance, that such disposition is in the best interests of the City, will
not materially impair the viability of the City's water utility system as a whole, and will be for the
benefit of the citizens of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, as follows:
Section 1. That the City Council hereby finds that leasing the Property to the Foundation
pursuant to the terms of this Ordinance will serve the public purposes of preserving an historic site
and of providing citizens with an educational opportunity, and further finds that such lease is in the
best interests of the City, will not materially impair the viability of the City's water utility system
as a whole, and will be for the benefit of the citizens of the City.
Section 2. That the City Manager is hereby authorized to execute a lease agreement for
the Property consistent with the terms of this Ordinance, together with such additional terms and
conditions as the City Manager,in consultation with the City Attorney,determines to be appropriate
to protect the interests of the City or effectuate the purposes of this Ordinance.
Section 3. That the Foundation may sublet the residence on the Property for the purposes
of discouraging vandalism and assisting in the upkeep of the Property, so long as such sublease is
in writing,in a form acceptable to the City and consistent with the Foundation's lease agreement for
the Property, and so long as the proceeds of any such sublease are used by the Foundation for the
benefit of the Property.
