STAFF: Helen Matson _ Kayla Ballard Resolution 2011-034 Authorizing the Lease of City-Owned Property Located at 200 West Mountain Avenue, Suite A, to Beet Street for Up to Two Years. EXECUTIVE SUMMARY Beet Street is a non-profit arts and culture economic development organization formed by the Fort Collins Downtown Development Authority (DDA) to help develop Fort Collins into a nationally recognized arts and culture center and destination by distinguishing themselves as an intellectually vital community that fosters, celebrates, and inspires human creativity. Beet Street is in need of a larger office space and has approached the City to utilize approximately 1,808 square feet of space located at 200 West Mountain Avenue, Suite A. Beet Street plans to move into the Carnegie Building after the new Fort Collins Museum/Discovery Science Center is built, subject to approval of a lease for that space by the City Council. BACKGROUND / DISCUSSION Beet Street is currently operating in a small facility and desires to expand their space. Beet Street has received approval from its Executive Committee to lease 200 West Mountain Avenue Suite A. Beet Street enhances the community's cultural offerings and organizations, develops cooperative programming with existing arts and culture organizations and assets, and adds to the economic vibrancy and development of downtown by building arts and culture as a unique economic engine. It hosts a wide range of thematic events each year that tap into the extremely high level of talent that already exists in the community. In addition to cultural events and programming, Beet Street provides incubator-style economic development services to the arts and culture community, and advocates for the development and availability of cultural facilities to aid in growing the arts and culture industry in Fort Collins. Because Beet Street's cultural programming efforts are designed to be collaborative and to presentthe creative talents of the broader arts and culture community, Beet Street works closely with most Fort Collins arts groups and many individual artists.Through its Streetmosphere program in 2010, it collaborated with 56 different arts and entertainment acts made up of 185 performers. At Creative Garden at Bohemian Nights at NewlNestFest, Beet Street presented 15 arts groups on the Performing Arts stage and 20 individual artists were invited to be vendors. Through its professional development efforts,itworked with 10 arts groups for a 10-week entrepreneurial skills development class last fall and 25 individual artists for the upcoming weekend intensive class. Beet Street started as a committee of the DDA, but has been an independent 501c3 since 2007. Beet Street has continued to receive funding support from the DDA. This funding support is currently phasing out, with the last investment from the DDA coming in 2012. FINANCIAL/ ECONOMIC IMPACTS In lieu of rent, Beet Street will pay utilities costs during its occupancy, including electricity, water, natural gas, sewer and storm water. Mountain Suite A Lease Location �' RESOLUTION 2011-034 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 200 WEST MOUNTAIN AVENUE, SUITE A, TO BEET STREET FOR UP TO TWO YEARS WHEREAS, the City is the owner of the property located at 200 West Mountain Avenue, Suite A, Fort Collins, Larimer County, Colorado (the "Property"); and WHEREAS, from 2004 to 2010 the City purchased the Property in furtherance of the Civic Center Master Plan and has not yet finalized specific plans for the Property; and WHEREAS, the Property was leased by the City as part of the Rocky Mountain Innosphere (formerly RM12) program but it is now vacant; and WHEREAS, Beet Street, a non-profit organization, needs a larger facility for the operation of its arts and cultural center for a period of approximately one year, after which period of time it plans to move into the City's Carnegie Building, subject to City Council approval of a lease for that space; and WHEREAS, City staff has determined that the Property would be an appropriate facility for Beet Street to rent; and WHEREAS,because of the public benefit provided by Beet Street, and its non-profit status, City staff is recommending that Beet Street not be charged rent for its use of the Property; and WHEREAS, Beet Street would be required to pay its share of utilities for the Property; and WHEREAS, under Section 23-114(a) of the City Code, the City Council is authorized to lease, for a definite term of two years or less, any and all interests in real property owned in the name of the City,provided that the City Council first finds,by resolution,that the lease is in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby finds that leasing the Property to Beet Street for UP to two years under the terms listed above is in the best interests of the City. Section 2. That the City Manager is hereby authorized to execute a lease agreement consistent with the terms of this Resolution, together with such additional terms and conditions as the City Manager,in consultation with the City Attorney,determines to be appropriate to protect the interests of the City or effectuate the purposes of this Resolution, including any necessary changes to the description of the Property, as long as such changes do not materially increase the size or change the character of the property to be leased.
