RECOMMENDATION: Staff recommends adoption of the Resolution. FINANCIAL IMPACT: The North College Improvement Project Phase I is projected to cost $2,796,698. In 20, $335,000 has been appropriated for design and right of way acquisition. The total estimat'A of the design services contract with FHU is $200,000. EXECUTIVE SUMMARY: Felsburg Holt & Ullevig (FHU) was selected in July of 2000, using the City's requff proposal process, to perform the project planning and conceptual design of the North Col,(.; Corridor Improvements Phase I. When FHU was selected it was anticipated that a set' ' request for proposal process would be used for preliminary design, final design and conso relat-d professional services. The reason for this was that construction was not schedule 2005. Now the construction schedule has been accelerated so that construction is plan,,,.co 2003. Time is now of the essence, and allowing FHU to move directly from conceptual d the preliminary and final designs will help the project proceed as quickly and effi6 H possible. FHU is the most qualified firm for this work and has proven to have the expertis very high quality work during the conceptual design phase. The firm has demonstrates `i( capability to complete the design work in a timely manner while meeting all of the Cit, CDOT requirements. It is important for the project to move from the conceptual desipc into the preliminary and final design phases as quickly and efficiently as possible in o '10 this design work to be completed by the end of 2002 so that construction can begin )3. Putting the remaining services out for a new bid would result in higher cost to the City of the project. RESOLUTION 2002-029 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE PURCHASE OF DESIGN SERVICES FROM FELSBURG HOLT &ULLEVIG AS AN EXCEPTION TO THE COMPETITIVE PURCHASING PROCESS WHEREAS, Felsburg Holt & Ullevig ("FHU") was selected in July of 2000, using the City's request for proposal process, to perform the project planning and conceptual design of the North College Corridor Improvements Phase I; and WHEREAS, the construction schedule has been accelerated so that construction is planned for 2003; and WHEREAS, FHU is the most qualified firm for this work, has proven to have the expertise to do very high quality work during the conceptual design phase, and has demonstrated the capability to complete the design work in a timely manner while meeting all of the City and CDOT requirements; and WHEREAS, it is important for the project to move from the conceptual design phase into the preliminary and final design phases as quickly and efficiently as possible in order for this design work to be completed by the end of 2002 so that construction can begin in 2003; and WHEREAS, funds are available in the Building Community Choices Capital Project Fund, North College Improvement Project Phase I; and WHEREAS, Section 8-161(d)(1)(b) of the Code of the City of Fort Collins authorizes the Purchasing Agent to negotiate the purchase of supplies and services without utilizing a competitive purchase process where the Purchasing Agent determines that although there exists more than one (1) responsible source, a competitive process cannot reasonably be used or, if used, will result in a substantially higher cost to the City, will otherwise injure the City's financial interests or will substantially impede the city's administrative functions or the delivery of services to the public; and WHEREAS, the Purchasing Agent has determined that use of a competitive purchasing process would result in substantially higher cost to the City and would impede the City's delivery of services to the public; and WHEREAS, the Purchasing Agent has submitted the requisite justification to the City Manager for approval; and WHEREAS, the City Manager has reviewed and concurred in that determination for this acquisition; and WHEREAS, the total estimated cost of these design services is $200,000; and WHEREAS, Section 8-161(d)(3) requires approval of this purchasing method by the City Council for items costing more than One Hundred Thousand Dollars ($100,000) prior to acquisition. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the purchase of Design Services from FELSBURG HOLT & ULLEVIG as an exception to the City's competitive purchasing requirements, is hereby approved.
