RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL, IMPACT: This project will be constructed using existing appropriations from project savings and a cash contribution in aid from the adjacent development. Contribution in Aid (Street Oversizing Fund) $ 78,951.60 Transfer of Appropriations from Capital Projects $802,909.80 110 Total Project Cost $881,861.40 EXECUTIVE SUMMARY: Fossil Creek Parkway is an important collector street in this southeast area of the City. The portion of roadway from College Avenue to Mail Creek Lane was originally constructed with the County development of Fossil Creek Estates. Recently the Huntington Hills development completed the connection to Fossil Creek Parkway. As part of the off-site impacts,the developers were required to increase the structural strength of the existing county street with a planned overlay. Staff is taking advantage of the planned construction to upgrade this section of roadway to City standards. New curbs and gutters will be installed to provide edge protection for the asphalt pavement and to collect roadway run-off. A sidewalk will be constructed on the north side and Fossil Creek Trail will be constructed along the south side to accommodate pedestrian movements. The existing medians will be preserved and the roadway will be rebuilt and sized for both automobile and bike lanes. These improvements are desirable because of the new development in the area,including anew City Park. In addition, these upgrades will provide facilities and increase safety for students travelling to the existing Werner Elementary School. DATE: April ITEM NUMBER: 15 The project will be entirely funded through the developer's contribution and the Street Oversizing Program. Because this segment of roadway was originally constructed in the County, funding was not immediately available or budgeted in the Street Oversizing Program. However the program has realized significant cost savings in the construction of its last few projects and will be able to fund the construction through existing appropriations. This Ordinance transfers existing appropriations in the Capital Projects Fund from the Kechter Road Project into the Fossil Creek Parkway Improvements Project. The developers' offsite contribution will also be appropriated from the Street Oversizing Contribution in Aid account for use on the project. ORDINANCE NO. 051, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES IN THE STREET OVERSIZING FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN PROJECTS IN THE CAPITAL PROJECTS FUND FOR THE CONSTRUCTION OF IMPROVEMENTS TO FOSSIL CREEK PARKWAY WHEREAS, improvements have been identified and are needed at Fossil Creek Parkway from College Avenue, east to Mail Creek Lane, in order to mitigate traffic impacts resulting from increased development in this area, increase safety for students traveling to Werner Elementary School, and to upgrade this important collector street to City standards; and WHEREAS,the aforementioned portion of Fossil Creek Parkway was originally constructed with the County development of Fossil Creek Estates, and WHEREAS, with the recent development of Huntington Hills, developers were required to overlay the existing County street; and WHEREAS, City staff is recommending making improvements to Fossil Creek Parkway from College Avenue,east to Mail Creek Lane including construction of curb and gutter,a sidewalk along the north side of the street,Fossil Creek Trail along the south side,median improvements,and sizing of the roadway to accommodate automobile and bicycle traffic (the "Project"); and WHEREAS, the estimated cost of the Project is $881,862; and WHEREAS,funding for the Project has been identified from prior year reserves in the Street Oversizing Fund($78,952), representing a developer contribution received in 2001,from Andover Fossil Creek, LLC, and project savings from the Kechter Road Improvement Project ($802,910), representing a portion of that project that was funded from Street Oversizing Fees; and WHEREAS, upon completion of the bid process, the Project is expected to begin in the spring of 2002, with final completion and landscaping scheduled for summer of 2002, prior to the start of the 2002-2003 school year; and WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter") permits the Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years,notwithstanding that such reserves were not previously appropriated; and WHEREAS, Article V, Section 10, of the Charter authorizes the Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; the purpose for which the funds were initially appropriated no longer exists; or the proposed transfer is from a fund or capital project account in which the amount appropriated exceeds the amount needed to accomplish the purpose specified in the appropriation ordinance; and WHEREAS,the purpose for which the previously appropriated funds in the Capital Projects Fund-Kechter Road Improvements project were initially appropriated no longer exists,and the City Manager has recommended that said unspent and unencumbered funds be transferred into the Capital Projects Fund- Fossil Creek Parkway Improvements project and that such funds be earmarked for expenditures associated with the proposed Fossil Creek Parkway improvements; and WHEREAS, the purpose for which the requested appropriations in the Street Oversizing Fund, will remain the same, upon transfer to the Capital Projects Fund - Fossil Creek Parkway Improvements project; and WHEREAS, it is the desire of the Council to appropriate $78,952 from prior year reserves in the Street Oversizing Fund and authorize the transfer of said amount to the Capital Projects Fund- Fossil Creek Parkway Improvements project,for appropriation therein,and to authorize the transfer of existing appropriations in the Capital Projects Fund - Kechter Road Improvements project, totaling $802,910, to the Capital Projects Fund-Fossil Creek Parkway Improvement project to be used for expenditures associated with the proposed Fossil Creek Parkway improvements. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated from prior year reserves in the Street Oversizing Fund for transfer to the Capital Projects Fund - Fossil Creek Parkway Improvements project and appropriated therein the sum of SEVENTY-EIGHT THOUSAND NINE HUNDRED FIFTY-TWO DOLLARS ($78,952)to be used for expenditures associated with the proposed Fossil Creek Parkway improvements. Section 2. That the unexpended appropriated amount of EIGHT HUNDRED TWO THOUSAND NINE HUNDRED TEN DOLLARS($802,910)is hereby authorized for transfer from the Capital Projects Fund-Kechter Road Improvements project to the Capital Projects Fund-Fossil Creek Parkway Improvements project and appropriated therein to be used for expenditures associated with the proposed Fossil Creek Parkway improvements.
