Annexation. RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: The Poudre School District and The Timbers P.U.D. Annexation is 35.53 acres in size. The site is located on the east side of South Timberline Road, approximately one-third mile south of Kechter Road and approximately one-half mile north of Trilby Road. Contiguity with the existing municipal boundary is gained along the south property line with a parcel known as the Westchase Annexation 410 No. 2. The proposed Resolution states that it is the City's intent to annex this property and directs that the published notice required by State law be given of the Council's hearing to consider the needed annexation ordinance. The hearing will be held at the time of First Reading of the annexation and zoning ordinances on May 21, 2002. Not less than 30 days prior, published notice is required by State law. BACKGROUND: This is a 100% voluntary annexation for a property located within the Urban Growth Area. The property satisfies the requirement that no less than one-sixth of the perimeter boundary be contiguous to the existing City boundary. The parcel is located within the Fossil Creek Reservoir Area Plan. There are two owners of the Annexation that are co-applicants on the Annexation Petition. . RESOLUTION 2002-039 OF THE COUNCIL OF THE CITY OF FORT COLLINS FINDING SUBSTANTIAL COMPLIANCE AND INITIATING ANNEXATION AND ZONING PROCEEDINGS FOR THE POUDRE SCHOOL DISTRICT AND THE TIMBERS P.U.D. ANNEXATION WHEREAS, a written petition, together with four (4) prints of an annexation map, was heretofore filed with the City Clerk requesting the annexation of certain property to be known as the Poudre School District and The Timbers P.U.D. Annexation; and WHEREAS,the Council of the City of Fort Collins desires to initiate annexation and zoning proceedings in accordance with law. NOW, THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby accepts the annexation petition for the Poudre School District and The Timbers P.U.D. Annexation, more particularly described as situate in the County of Larimer, State of Colorado, to wit: Tract A and Tract B,Poudre School District and Paragon Point Partners,LTD,(being . a Minor Land Division) as described in Latimer County Records under Reception No. 2000054081, dated August 8,2000, located in the Northwest Quarter(NW 1/4) of Section Eight (8) and a parcel of land being a part of the East Half (E1/2) of Section Seven (7), all located in Township Six North (T.6N.), Range Sixty-eight West (R.68W.), Sixth Principal Meridian (6thP.M.), County of Latimer, State of Colorado and being more particularly described as follows: BEGINNING at the West Quarter Comer of said Section 8 and assuming the West line of said NW1/4 as bearing North 00°17'41" West with all other bearings contained herein relative thereto: THENCE South 89°3110" West a distance of 30.00 feet to the West Right-of-Way (ROW) of Timberline Road; THENCE North 00°17'41"West along said West ROW a distance of 771.54 feet to a point on the North line extended of said Poudre School District and Paragon Point Partners, LTD; THENCE along said Poudre School District and Paragon Point Partners, LTD the following seventeen courses and distances: THENCE North 89026'32" East a distance of 937.63 feet; THENCE South 48°19'44" East a distance of 87.78 feet; THENCE South 52'15'28" East a distance of 175.25 feet; THENCE South 54°32'03" East a distance of 421.57 feet; • THENCE North 83011'59" East a distance of 342.51 feet; THENCE South 86°46'58" East a distance of 22.03 feet; THENCE North 80°46'24" East a distance of 64.75 feet; THENCE North 71°58'20" East a distance of 130.60 feet; THENCE North 79°56'09" East a distance of 109.19 feet; THENCE North 8901044" East a distance of 199.15 feet; THENCE South 83°18'26" East a distance of 33.47 feet; THENCE North 83003'41" East a distance of 107.33 feet; THENCE South 76°08'43" East a distance of 149.06 feet; THENCE South 69°0631" East a distance of 40.60 feet; THENCE South 75°43'39" East a distance of 45.41 feet to the East line of said NW1/4; THENCE South 00°26'36"West along said East line a distance of 407.53 feet to the Center Quarter Corner of said Section 8; THENCE South 89*31'10" West along said South line a distance of 2671.35 feet to the POINT OF BEGINNING. That the Council hereby finds and determines that the annexation petition and accompanying map are in substantial compliance with the Municipal Annexation Act. Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said Notice establishes the date,time and place when a public hearing will be held regarding the passage of annexation and zoning ordinances pertaining to the above-described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in the Municipal Annexation Act. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 16th day of April, A.D. 2002. Annexation,said Annexation being more particularly described in said Resolution,a copy of which precedes this Notice. That,on May 21,2002,at the hour of 6:00 p.m.,or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall, 300 LaPorte Avenue, Fort Collins, Colorado,the Fort Collins City Council will hold a public hearing upon the annexation petition and zoning request for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation and for the purpose of determining the appropriate zoning for the property included in the Annexation. At such hearing,any persons may appear and present such evidence as they may desire. The Petitioner has requested that the Property included in the Annexation be placed in the 'LlvIN" Low Density Mixed Use Zone District. These sites are located along Timberline Road north of the intersection with Trilby Road. The Timbers site is located directly south of the Poudre R-1 Elementary school. The Timbers project consists of 176 multi-family dwelling units and one clubhouse. These developments exemplify many of the Principles and Policies of the City of Fort Collins City Plan including: PRINCIPLE LU-2: The city will maintain and enhance its character and sense of places as defined by its neighborhoods, districts, corridors, and edges. Policy LU-2.1 City-Wide Structure Policy LU-2.2 Urban Design Poudre R-1 Elementary and the Timbers will create a neighborhood with distinct edges that fit within the city structure plan. The designs of these sites meet the guidelines for new construction to form a citywide structure with diverse identities. PRINCIPLE LU-4: More specific subarea planning efforts will follow the adoption of these City Plan Principles and Policies, which tailor City Plan's citywide perspective to individual neighborhoods, districts, corridors, and edges. Policy LU4.1 Planning within the Context of City Plan. Policy LU4.2 Generic Scope. Policy LU4.3 Collaboration. Policy LU4.5 Priority Subareas. • These developments are located within the Intergovernmental Agreement Area for the Fossil Creek Reservoir Area Plan. They have met specific standards that apply to this location. The Timbers has had a joint review process through Larimer County and the City of Fort Collins and does comply with both landuse-planning codes. PRINCIPLE T-1: The physical organization of the city will be supported by a framework of transportation alternatives that maximizes access and mobility throughout the city, while reducing dependence upon the private automobile Policy T-1.1 Land Use Patterns Policy T-1.2 Multi-Modal Streets Policy T-1.3 Street Design Criteria These sites are located along the Timberline Road major arterial. Proposed development is to connect with existing street bicycle lanes as well as provide pedestrian and bike paths through landscaped areas in order to provide connectivity to adjacent neighborhoods. PRINCIPLE T-5: The City will acknowledge pedestrian travel as a viable transportation mode and elevate it in importance to be in balance with all other modes. Direct pedestrian connections will be provided and encouraged from place of residence to transit, schools, activity centers, work and public facilities. Policy T-5.1 Land Use Policy T-5.2 Connections The multi-family and public school project will provide a mix of land uses that create pedestrian mobility throughout the community. The pedestrian connections will be clearly marked, signed and striped. PRINCIPLE CAD-1: Each addition to the street system will be designed with consideration to the visual character and the experience of the citizens who will use that street system and the adjacent property. Together, the layout of the street network and the streets themselves will contribute to the character,form and scale of the city. Policy CAD-1.1 Street Design Standards Policy CAD-1.3 Streetscape Design Policy CAD-1.4 Street Tree Design All of the public streets around the proposed developments shall meet the street design criteria from the Larimer County Urban Area Street Standards. All of these streets will be lined with canopy shade trees to provide for a functional, safe and visually appealing layout. The majority of the tree plantings will be canopy trees with a diversity of species represented. PRINCIPLE CAD-4: Security and crime prevention will continue to be important factors in urban design. Policy CAD-4.2 Lighting and Landscaping SLighting and landscaping will be designed to promote security and comfortable area-wide visibility. PRINCIPLE ECON-1: The City will pursue a balanced and sustainable economic development program. Policy ECON-1.4 Jobs/Housing Balance The type of housing that will be located on the Timbers site will have options for different levels of income. PRINCIPLE HSG —1: A variety of housing types and densities will be available throughout the urban area for all income levels. Policy HSG-1.1 Land Use Pattems Policy HSG-1.2 Housing Supply Policy HSG-1.4 Land for Residential Development The Timbers development and the Poudre R-1 Elementary school are adding additional housing and schooling opportunities for residents in southern Fort Collins. PRINCIPLE AN-4: Design policies for residential buildings are intended to emphasize creativity, diversity, and individually. The following design policies are based on the premise that truly creative design is responsive to its context and the expressed references of citizens, and contributes to a comfortable, interesting community. Policy AN-4.1 Multiple-Family Housing Characteristics Policy AN-4.2 Multiple-Family Building Variation Four different types of multi-family buildings are to be proposed on the Timbers site.
