First Reading of Ordinance No. 138, 2002, Appropriating Prior Year Reserves in the Street
Oversizing Fund For Transfer to the Capital Projects Fund-Lemay Avenue,Fossil Creek Bridge to
Trilby Road Capital Project to Survey Existing Utilities for the Design of Roadway Improvements
on Lemay Avenue from the Fossil Creek Bridge to Trilby Road.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.

FINANCIAL IMPACT:
This Ordinance appropriates and transfers $35,600 from the Street Oversizing Fund Prior Year
Reserves to the Capital Projects Fund to survey existing utilities for the design or roadway
improvements on Lemay Avenue from Trilby to Fossil Creek. This utility survey will go out to bid
as soon as funds are available. This will not affect the Street Oversizing Program's ability to meet
its other construction obligations in 2002.
EXECUTIVE SUMMARY:
The Street Oversizing Program, in conjunction with the City's construction of Fossil Creek
Community Park, is completing the engineering design of Lemay Avenue from the Fossil Creek
bridge (near Muirfield Way)to Trilby Road. Lemay Avenue will be widened to a four lane arterial
with curb and gutter, landscaped medians,bike lanes and sidewalks. A pedestrian underpass for the
Fossil Creek Recreation Trail will cross Lemay Avenue as part of this project.
The engineering design is 80% complete for Lemay Avenue. However, numerous utility concerns
between the pedestrian tunnel, existing 24" waterline, existing electrical duct banks, existing fiber
optic data lines and the road widening, make construction tolerances extremely tight and with little
margin for error.
To address these utility concerns, staff is recommending that a contractor be hired to do a utility
survey to verify the actual locations of the utilities and incorporate them into the design plans. The
completion of this survey will result in a more accurate design and reduce utility relocations. This
will in turn reduce construction costs and field change orders and realize significant savings to the
project. This ordinance is required to appropriate prior year reserves in the Street Oversizing Fund
for transfer into the Capital Projects fund.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE STREET OVERSIZING FUND
FOR TRANSFER TO THE CAPITAL PROJECTS FUND - LEMAY AVENUE, FOSSIL
CREEK BRIDGE TO TRILBY ROAD CAPITAL PROJECT TO SURVEY
EXISTING UTILITIES FOR THE DESIGN OF ROADWAY IMPROVEMENTS ON LEMAY
AVENUE FROM THE FOSSIL CREEK BRIDGE TO TRILBY ROAD
WHEREAS,improvements are needed at Lemay Avenue from the Fossil Creek Bridge(near
Muirfield Way) south to Trilby Road, in order to mitigate traffic impacts resulting from increased
development in this area, including the building of Fossil Creek Community Park; and
WHEREAS, City staff is recommending that such improvements include widening this
stretch of Lemay Avenue to a four-lane arterial with curb and gutter,landscaped medians,bike lanes
and sidewalk (the "Project"); and
WHEREAS, City staff has identified numerous utility concerns related to the Project,
between the proposed road widening and the pedestrian tunnel, an existing 24-inch waterline,
existing electrical duct banks, and existing fiber optic data lines, that should be verified and
incorporated into the final design plans for the Project improvements; and
WHEREAS, a utility survey is needed, at a cost of$35,600, to verify the actual locations of
utilities and to incorporate the locations in the final Project design, thereby reducing Project
construction costs and field change orders; and
WHEREAS,funding for the utility survey is available and has been identified from prior year
reserves in the Street Oversizing Fund; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter")
permits the Council to appropriate by ordinance at any time during the fiscal year such funds for
expenditure as may be available from reserves accumulated in prior years,notwithstanding that such
reserves were not previously appropriated; and
WHEREAS, it is the desire of the Council to appropriate $35,600 from prior year reserves
in the Street Oversizing Fund and to authorize the transfer of said amount to the Capital Projects
Fund-Lemay Avenue,Fossil Creek Bridge to Trilby Road capital project,for appropriation therein,
to be used for a utility survey associated with the Lemay Avenue,Fossil Creek Bridge to Trilby Road
project.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated from prior year reserves in the Street Oversizing Fund
the sum of THIRTY-FIVE THOUSAND SIX HUNDRED DOLLARS ($35,600) for transfer to the
Capital Projects Fund - Lemay Avenue, Fossil Creek Bridge to Trilby Road capital projects to be
used for a utility survey associated with the Lemay Avenue, Fossil Creek Bridge to Trilby Road
project.
Introduced and considered favorably on first reading and ordered published this 17th day of
September, A.D. 2002, and to be presented for final passage on the I st day of October, A.D. 2002.
