RECOMMENDATION: Staff recommends adoption of the Ordinances on First Reading. FINANCIAL IMPACT: The City has received funds from the following two sources for Police Services: (1) A drug surcharge and court ordered restitution via an agreement where all Larimer County agencies who participate in the Larimer County Drug Task Force (LCDTF) transfer revenues from court fees to Fort Collins Police Services; and (2) a grant in the amount of $32,680, to be used to purchase police radios and digital cameras for use by the Latimer County Drug Task Force. There are no local matching funds required. EXECUTIVE SUMMARY: A. First Reading of Ordinance No. 076, 2003, Appropriating Prior Year Reserves in the General Fund for Police Services for the Larimer County Multi-Jurisdictional Drug Task Force. B. First Reading of Ordinance No. 077, 2003, Appropriating Unanticipated Grant Revenue in the General Fund for Police Services for the Latimer County Multi-Jurisdictional Drug Task Force. Drug surcharge and court ordered restitution: For the past 16 years, Fort Collins Police Services has worked together with other members of the Latimer County Drug Task Force (LCDTF), including the Loveland Police Department, Larimer County Sheriff's Department, Drug Enforcement Administration (DEA), and the Colorado State University Police Department, in drug enforcement in Larimer County. These funds provides for office supplies, equipment, and repairs for the Larimer County Drug Task Force. Funds in the amount of $26,052 are currently in a General Fund reserve restricted for the LCDTF. This Ordinance appropriates that amount to be used for the operating costs associated with that task force. DATE: ITEM NUMBER: Rocky Mountain High Intensity Drug Trafficking Area Grant: For the past 16 years, Fort Collins Police Services has worked with other members of the Latimer County Drug Task Force, including the Loveland Police Department, Larimer County Sheriff's Department, Drug Enforcement Administration (DEA), and the Colorado State University Police Department, in drug enforcement in Larimer County. This equipment allows unit members to communicate on a common police radio channel and the cameras will provide another method of evidence collection. This grant ($32,680) is awarded through the Rocky Mountain High Intensity Drug Trafficking Area, of which Larimer County Drug Task Force is a designated area. ORDINANCE NO. 076, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES IN THE GENERAL FUND FOR POLICE SERVICES FOR THE LARIMER COUNTY MULTI-JURISDICTIONAL DRUG TASK FORCE WHEREAS, for the past 16 years, Fort Collins Police Services has worked with other members of the Latimer County Drug Task Force (the "LCDTF') including the Loveland Police Department, Larimer County Sheriff's Department, Drug Enforcement Administration, and the Colorado State University Police Department, in drug enforcement in Larimer County; and WHEREAS, the City of Fort Collins has received revenue via an agreement wherein all Larimer County agencies who participate in the LCDTF are required to transfer money from court fees to Fort Collins Police Services; and WHEREAS,Fort Collins Police Services administers these funds to provide for ongoing operation of the LCDTF; and WHEREAS, the current balance of the General Fund reserve for the LCDTF is $26,052; and WHEREAS,these funds are to be used for office supplies, equipment, and repairs for the Larimer County Drug Task Force; and WHEREAS,Article V,Section 9,of the Charter of the City of Fort Collins permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years,notwithstanding that such reserves were not previously appropriated. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from General Fund prior year reserves the sum of TWENTY-SIX THOUSAND FIFTY-TWO DOLLARS($26,052),for operating costs of the Larimer County Drug Task Force. Introduced, considered favorably on first reading, and ordered published this 20th day of May, A.D. 2003, and to be presented for final passage on the 3rd day of June, A.D. 2003. Mayor ATTEST: City Clerk ORDINANCE NO. 077, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE GENERAL FUND FOR POLICE SERVICES FOR THE LARIMER COUNTY MULTI-JURISDICTIONAL DRUG TASK FORCE WHEREAS,for the past 16 years,Fort Collins Police has worked with other members of the LCDTF to include the Loveland Police Department, Larimer County Sheriffs Department, Drug Enforcement Administration(:)EA),and the Colorado State University Police Department,in drug enforcement in Larimer County; and WHEREAS,the City of Fort Collins Police Services has received a grant from the Executive Office of the President, Office of National Drug Control Policy, in the amount of$32,680, for the Larimer County Drug Task Force (the "LCDTF'); and WHEREAS,the funds will be used to purchase police radios and digital cameras to be used by the LCDTF for communication and evidence collection; and WHEREAS,Article V,Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous • appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,City staff has determined that the appropriation of the Executive Office of the President,Office of National Drug Control Policy Grant funds as described herein will not cause the total amount appropriated in the General Fund to exceed the current estimate of actual and anticipated revenues to be received in the General Fund during 2003. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated from unanticipated grant revenue in the General Fund the sum of THIRTY-TWO THOUSAND SIX HUNDRED EIGHTY DOLLARS ($32,680) for expenditure in the General Fund for Police Services to purchase equipment for the Larimer County Drug Task Force. Introduced, considered favorably on first reading, and ordered published this 20th day of May, A.D. 2003, and to be presented for final passage on the 3rd day of June, A.D. 2003.
