SUBJECT:
First Reading of Ordinance No. 062, 2003, Appropriating Prior Year Reserves in the Street
Oversizing Fund and Authorizing the Transfer of Appropriated Amounts To Be Used To
Construct Interim Roadway Improvements On County Road 11 and Douglas Road.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
This Ordinance appropriates unanticipated revenue already received from Contributions in Aid
of Construction' in the Street Oversizing Fund to construct interim roadway improvements on
County Road 11 and Douglas Road. Existing appropriations from the Lemay Avenue Project
represent project savings. This project will go to bid in early summer. Funds will be
appropriated as follows:
Hearthfire PUD $432,930 Contribution In Aid (Street Oversizing)
Richards Lake PUD $261,975 Contribution In Aid (Street Oversizing)
Transfer from Lemay Project $434,277 Street Oversizing Fund
EXECUTIVE SUMMARY:
The Northeast Area Overlay Project was intended to improve roads in the Mountain Vista Sub
Area. Several different developments, as well as currently undeveloped parcels of land, are
included in the project area. The objective of the City is to collect the development portion of
the fees in advance of the work, combining the individual developments into one cohesive
project. The project is funded by Contribution in Aid from local developments and the Street
Oversizing Program. The project is being completed in phases as the revenues are collected.
Phase I from International Boulevard to County Road 52 was completed in the summer of 2000.
Increased development in the area indicates Phase 2 of the project is needed.
Phase II of this project overlays, widens and repairs County Road 9 and County Road 11, from
International to Douglas Road, as well as Douglas Road, from County Road 11 to County Road
13. This phase two overlay project will be an interim improvement project and will provide two
travel lanes and two bike lanes, allowing new development in the area to begin construction.
' Contributions in Aid are cash deposits from developers held by the City for certain road improvements. The term
originally came from the accounting line item in the Capital Projects Fund,"Contribution in Aid of Construction",where these
monies are held. The Street Oversizing Fund has a similar line item accounting for cash contributions from developments for
required road improvements.

This appropriation Ordinance will transfer funds deposited with the City from the developments
for construction of Phase 2 of the overlay project. County Road 11 from County Road 52 to
Douglas Road: and Douglas Road from County Road 11 to County Road 13 will be widened and
overlaid with this project.
BACKGROUND:
The roadway system in the northeast area of Fort Collins between Douglas Road and
International Boulevard consists of existing County roads that do not meet City standards.
Although full development of the area would require that the roadway system be brought into
compliance with City standards in order to maintain an adequate level of service, the current
level of development is limited and spotty and does not necessitate full roadway improvements
at this time. An interim roadway will maintain adequate levels of service at this time. The
development in the area must pay for these interim improvements.
It is in the best interest of the City as well as development to construct the proposed
improvements as a single project, rather than a patchwork of individual projects. The City has
been collecting Street Oversizing Fees and Contributions In Aid from development to fund the
project. Each development has been charged a Contribution in Aid, which was calculated by the
amount of frontage the development has in relation to the project, as well as some additional
segments that will specifically benefit the development, but which may not be directly attached
to the development. These fees will be used to build interim roadway improvements, which will
serve the area until final improvements are built. Combining the improvements will allow a
more efficient construction project, realize cost savings due to economies of scale, reduce the
disruption to the traveling public by only having one construction project, and upgrade a
significant section of older County roadway
The initial Northeast Area Overlay Project, Phase 1, was an interim 36 foot wide roadway
improvement that was funded from the Contributions In Aid collected from phase 1
development. It improved County Road 9 and Mountain Vista Drive from International to
County Road 11. The project was completed in the 2000 construction season in conjunction
with a City 24" waterline project.
Phase 2 of the Northeast Area Overlay Project will include widening the roadway to 36 feet
wide, an asphalt overlay and street repair where necessary along Country Road 11 and Douglas
Road. This will provide two travel lanes and two bicycle lanes and will bring the automobile
and bicycle levels of service in the area up to an acceptable level, allowing new development in
the area to begin construction.
Once development in the area reaches a critical level, the City will make final improvements to
the roadway system, which will include installing curb and gutter, sidewalks, and bringing the
streets up to City standards.
These proposed interim road improvements will allow some growth in the area to continue,
while maintaining an adequate level of service for the citizens of Fort Collins and Larimer
County.
ORDINANCE NO. 062, 2003
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE STREET OVERSIZING FUND
AND AUTHORIZING THE TRANSFER OF APPROPRIATED AMOUNTS
TO BE USED TO CONSTRUCT INTERIM ROADWAY IMPROVEMENTS
ON COUNTY ROAD 11 AND DOUGLAS ROAD
WHEREAS, the roadway system in the northeast area of Fort Collins between Douglas
Road and International Boulevard consists of existing County roads that currently do not meet
City standards; and
WHEREAS, future development of the aforementioned area will require that the current
roadway system be improved in order to comply with City standards for maintaining adequate
levels of service; and
WHEREAS, although current development in the area does not necessitate full roadway
improvements in the area, interim roadway improvements are necessary to maintain adequate
levels of service; and
WHEREAS, final roadway improvements in the area, including installing curb and gutter,
sidewalks, and bringing the streets up to City standards will be constructed by the City once
development in the area has reached a critical level; and
WHEREAS, proposed interim improvements in the area include overlaying, widening,
and repairs to County Road 11 from County Road 52 to Douglas Road; and Douglas Road from
County Road 11 to County Road 13; providing two travel lanes and two bicycle lanes, thus
allowing new development in the area to begin construction (the "Northeast Area Overlay
Project"); and
WHEREAS, the estimated cost of the interim improvements is $1,129,182; and
WHEREAS, staff has identified the following sources to fund improvements associated
with the Northeast Area Overlay Project:

WHEREAS, upon completion of the bid process, the Northeast Area Overlay Project is
expected to begin in June 2003, with final completion scheduled to be completed by October
2003; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the
"Charter") permits the City Council to appropriate by ordinance at any time during the fiscal year
such funds for expenditure as may be available from reserves accumulated in prior years,
notwithstanding that such reserves were not previously appropriated; and
WHEREAS, Article V, Section 10, of the Charter authorizes the City Council to transfer
by ordinance any unexpended and unencumbered amount or portion thereof from one fund or
capital project to another fund or capital project, provided that the proposed transfer is from a
fund or capital project account in which the amount appropriated exceeds the amount needed to
accomplish the purposed specified in the appropriation ordinance; and
WHEREAS, staff has identified project savings in the Lemay Avenue Widening project,
totaling, $434,277, appropriated by City Council by adoption of Ordinance No. 011, 2003, on
February 4, 2003, and the City Manager has recommended that said project savings by
transferred to the Capital Projects Fund - Northeast Area Overlay Project and earmarked for
expenditure therein; and
WHEREAS, it is the desire of the Council to appropriate $694,905 from prior year
reserves in the Street Oversizing Fund and authorize the transfer of said amount to the Capital
Projects Fund - Northeast Area Overlay Project, for appropriation therein, and to authorize the
transfer of existing appropriations, totaling $434,277, in the Capital Projects Fund - Lemay
Avenue Widening project to the Capital Projects Fund - Northeast Area Overlay Project for
expenditure therein.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from prior year reserves
in the Street Oversizing Fund for transfer to the Capital Projects Fund - Northeast Area Overlay
Project and appropriated therein the sum of SIX HUNDRED NINETY-FOUR THOUSAND
NINE HUNDRED FIVE DOLLARS ($694,905) to be used for expenditures associated with the
proposed Northeast Area Overlay Project.
Section 2. That the unexpended appropriated amount of FOUR HUNDRED
THIRTY-FOUR THOUSAND TWO HUNDRED SEVENTY-SEVEN DOLLARS ($434,277) is
hereby authorized for transfer from the Capital Projects Fund - Lemay Avenue Widening project
to the Capital.Projects Fund - Northeast Area Overlay Project to be used for expenditures
associated with the proposed Northeast Area Overlay Project.
