SUBJECT:
First Reading of Ordinance No. 025, 2003, Appropriating Unanticipated Revenue in the Capital
Projects Fund - Downtown Railroad Track Consolidation Project to be Used for Additional
Costs to Install Crossing Warning Devices at the Lincoln Avenue Crossing of the Union Pacific
Railroad Tracks Northeast of Jefferson Street.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading
FINANCIAL IMPACT:
Federal "ISTEA" funds will pay for 100% of the additional cost for the new crossing warning
devices. $148,844 in Federal Funds have been budgeted and appropriated into the Railroad
Consolidation Project Fund for this project. This Ordinance will appropriate an additional
$37,000 to cover the additional costs. The total appropriation will then be $185,844.
EXECUTIVE SUMMARY:
The Agreement with the Colorado Department of Transportation (CDOT), and the Union Pacific
Railroad Company (UPRR), is for installation of crossing warning devices at the Lincoln
Avenue crossing of the Union Pacific Railroad tracks northeast of Jefferson Street. The project
consists of constructing new signals and gates to improve safety at the crossing.
The City applied for and received Federal ISTEA Funds to pay for 100% of the cost to install the
crossing warning devices. The original Appropriation Ordinance provided $148,844 in Federal
Funds budgeted towards the project into the Railroad Consolidation Project Fund. The
additional $37,000 are also Federal ISTEA Funds to cover the additional costs to cover 100% of
the costs to install the crossing warning devices. This appropriation will allow for the final
payment to the Union Pacific Railroad for installation of the crossing warning devices at the
Lincoln Avenue crossing of the Union Pacific Railroad tracks northeast of Jefferson Street.
No additional City funds are required.
Construction of the improvements has been completed.

OF THE COUNCIL OF THE CITY OF FORT C01 LINS
APPROPRIATING UNANTICIPATED REVENUE IN THE
CAPITAL PROJECTS FUND-DOWNTOWN RAILROAD TRACK CONSOLIDATION
PROJECT TO BE USED FOR ADDITIONAL COSTS TO INSTALL CROSSING WARNING
DEVICES AT THE LINCOLN AVENUE CROSSING OF THE UNION PACIFIC RAILROAD
TRACKS NORTHEAST OF JEFFERSON STREET
WHEREAS,City Council adopted Ordinance No. 7, 2000,on January 4, 2000,authorizing
the appropriation of Colorado Department of Transportation (CDOT) Intermodal Surface
Transportation Efficiency Act (ISTEA)funds,totaling$148,844,to be used to install new crossing
warning devices at the Lincoln Avenue crossing of the Union Pacific Railroad tracks, northeast of
Jefferson Street (the "Project"); and
WHEREAS, local matching funds, totaling $6,156, required in conjunction with the
aforementioned appropriation of ISTEA funds,were identified in the form of existing appropriations
in the City's Capital Projects Fund-Downtown Railroad Consolidation project,resulting in a total
Project cost of$155,000; and
WHEREAS, the final Project cost is $192,000, and CDOT has made available to the City
additional ISTEA funds, totaling $37,000, to complete the installation of new crossing warning
devices at the Lincoln Avenue railroad crossing, northeast of Jefferson Street; and
WHEREAS, no additional local matching funds are required; and
WHEREAS,Article V,Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of ISTEA funds from CDOT,
as described herein, will not cause the total amount appropriated in the Capital Projects Fund -
Downtown Railroad Consolidation project to exceed the current estimate of actual and anticipated
revenues to be received during any fiscal year; and
WHEREAS, it is the desire of the Council to appropriate the sum of $37,000 in federal
ISTEA funds to be used to complete the installation of new crossing warning devices at the Lincoln
Avenue Crossing of the Union Pacific Railroad Tracks Northeast of Jefferson Street.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Capital Projects Fund - Downtown Railroad Track Consolidation project, the sum of THRTY-
SEVEN THOUSAND DOLLARS ($37,000), upon receipt from Colorado Department of
Transportation Intermodal Surface Transportation Efficiency Act funds, to fund the completion of
the installation of new crossing warning devices at the Lincoln Avenue crossing of the Union Pacific
Railroad Tracks Northeast of Jefferson Street.
Introduced and considered favorably on first reading and ordered published this 18th day of
February, A.D. 2003, and to be presented for final passage on the 4th day of March, A.D. 2003.
